ART & JAZZ SIGN UP

Back by popular demand… the Downtown Development Authority in partnership with the Downtown Merchant and Business Association, brings back Art & Jazz on the Avenue to downtown Delray Beach! The DDA will host four individual Art and Jazz on the Avenue events throughout the Downtown. Each will take place throughout the downtown neighborhoods closing down a section of the street for activation. Each event will be themed a little differently, enlist community participation and provide all with the opportunity to have a little fun!

BUSINESS PARTICIPATION:

The Delray Beach Downtown Development Authority (DDA) is inviting all businesses within Downtown Delray Beach and the surrounding area to participate.

We encourage all businesses to ACTIVATE your business location when Art & Jazz is in your neighborhood OR sign up to pop-up if your business is located outside of the event footprint.  

If you are a business located outside of the DDA downtown district - there will be an application process to be accepted as a vendor, more details sent when you fill out this form.  *The DDA reserves the right to refuse any vendor.  Art or Jazz related businesses or themes recommended.

MERCHANT, ARTIST, BUSINESS PARTICIPATION APPLICATION:

The following application and contract consist of (1) the rules and regulations before, during and after the Event, (2) the application process and fees, (3) facts and information about the event and (4) the event checklist and Indemnification Hold Harmless Agreement. The contract must be filled out completely. By signing this contract, you acknowledge that you have read and understand the information provided and requirements for vendor participation and agree to the terms herein provided.

The vendor shall provide a certificate of general liability insurance with a minimum of $1,000,000 coverage naming the DDA and the City of Delray Beach, as an additional insured and providing for 30 days’ notice of cancelation.  If there are any questions regarding this requirement, please email MGatto@downtowndelraybeach.com. The DDA has the right to refuse vendors. 

MERCHANT/BUSINESS PARTICIPATION APPLICATION AND CONTRACT
DUE BY FRIDAY, JULY 8 TO BE INCLUDED IN PROGRAMS AND OTHER PRINTED MARKETING COLLATERAL FOR THE SOFA EVENT.

If you selected "no", please note that you will be required to rent a tent through the DDA for $125. This fee includes the tent, lights, and a table.  MUST BRING YOUR OWN LINENS. Personal tents are not allowed.

VENDOR RULES AND REGULATIONS

1.     Health Department inspection & approval: Your information will be sent to the health department by the Downtown Development Authority.

2.     Fire Department inspection & approval: Your information will be sent to the Delray Beach Fire Department by the Downtown Development Authority.

3.     You, your staff, and your area must remain neat, clean and kept in an orderly fashion. Exhibits and displays must be contained within booth space. Conduct and displays must be appropriate.

4.     Someone from your staff should be managing the booth before and during the event up until breakdown of the event.

5.     Vendors are responsible for the collection and payment of their own sales tax.

6.     The event staff will not be liable for any losses or damages of any kind that occurs at your booth.

7.     You must provide a copy of your liability insurance certificate with the Downtown Development Authority listed as an additional insured and e-mail it to: dda@downtowndelraybeach.com

8.     THE DDA HAS THE RIGHT TO REFUSE VENDORS.

INDEMNIFICATION AND HOLD HARMELESS AGREEMENT

The undersigned agrees as follows:

(Business Name) shall indemnify, defend and save harmless to the extent of its insurance coverage, the Downtown Development Authority (DDA) and its member entities which consist of the City of Delray Beach (CITY); Business agrees to defend, indemnify and save harmless the Indemnitees, their officers, agents and employees, against any liability arising from or based upon the violation of any federal, state, county or city laws, by-laws, ordinances or regulations, including but not limited Trademark and Copyright Laws by the Contractor, his subcontractors, agents, servants or employees. Business further agrees to defend, indemnify and save harmless the Indemnitees, their officers, agents, or employees from all such claims, fees, and from any and all suits and actions for every name and description that may be brought against the Indemnitees or their officers, agents or employees on account of any claims, fees, royalties, or costs for any invention or patent, and from any and all suits and actions that may be brought against the Indemnitees, their officers, agents or employees for the infringement of any and all patents or patent rights claimed by any person, firm, or corporation.

The indemnification provided above shall obligate the Business to defend, at his/her own expense or to provide for such defense, at the Indemnitees' option, any and all claims or liability and all suits and actions of every name and description that may be brought against the Indemnitees, their officers, agents, or employeees which may result from the operations and activities under this Contract whether the work be performed by the Business, his/her subcontractor or by anyone directly or inderectly employed by either. This Indemnification and Hold Harmless Agreement include all costs and fees including attorney's fees and costs at trial and appellate levels.
