RELEASE & WAIVER OF LIABILITY

IN CONSIDERATION of being permitted to compete, officiate, observe, work, or participate in any way in the EVENT(S) or being permitted to enter for any purpose any RESTRICTED AREA (defined as any area requiring special authorization, credentials, or permission to enter or any area to which admission by the general public is restricted or prohibited), EACH OF THE UNDERSIGNED, for himself, his personal representatives, heirs, and next of kin:

Acknowledges, agrees, and represents that he has or will immediately upon entering any of such RESTRICTED AREAS, and will continuously thereafter, inspect the RESTRICTED AREAS which he enters, and he further agrees and warrants that, if at any time, he is in or about RESTRICTED AREAS and he feels anything to be unsafe, he will immediately advise the officials of such and if necessary will leave the RESTRICTED AREAS and/or refuse to participate further in the EVENT(S).
HEREBY RELEASES,WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the promoters, participants, racing associations, sanctioning organizations or any subdivision thereof, track operators, track owners, officials, car owners, drivers, pit crews, rescue personnel, any persons in any RESTRICTED AREA, sponsors, advertisers, owners and leassees of premises used to conduct the EVENT(S), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or EVENT(S) and each of them, their directors, officers, agents, employees, representatives, owners, members, affiliates, successors and assigns all for the purposes herein referred to as "Releasees," FROM ALL LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the UNDERSIGNED’S INJURY OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF RELEASEES or otherwise.
HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED, also expressly Acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.
HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasees, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the State or Province in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, otwithstanding, continue in full legal force and effect.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

EXCLUSION OF LIABILITY - Assumption of risk for minors under the age of nineteen years of age:

The undersigned parent/guardian of (the"Minor") in consideration of the Campbell River Motocross Association allowing the Minor to use the facilities of the Campbell River Motocross Association, agrees to accept full responsibility for damages, loss or expenses which may be caused to the Minor as a result of the us of the Campbell River Motocross Association Facilities including damages, loss or expenses associated with personal injury, property damage or death.

The undersigned parent/guardian will be bound by the exclusion of liability and assumption of risk set forth above with respect to the Minor. The undersigned parent/guardian will indemnify and hold the Campbell River Motocross Association, its employees, volunteers, directors and agents harmless from and against all claims, costs or expenses arising as a result of the use of theCampbell River Motocross Association facilities by the Minor including claims arising as a result of negligence or breach of contract. The undersigned parent/guardian acknowledges that by allowing the Minor to participate in a motor sport, the parent/guardian recognizes that there is a risk of a serious personal injury, property damage or death.

The undersigned and/or parent guardian consent to Campbell River Motocross Association, its employees, volunteers, directors and agents, requesting emergency medical assistance or ambulance, and assume all costs associated in case of emergency.

The undersigned will KEEP THE ENTRANCE GATE CLOSED AND LOCKED AT ALL TIMES

CAMPBELL RIVER MX & TRAILS TERMS & CONDITIONS

As a condition of use of the facilities owned or operated by the Campbell River Motocross Association, the undersigned assumes all risk of personal injury, death or property loss resulting from any cause whatsoever including but not limited to the inherent risks of the motocross sport, the use of the motocross track, a collision with natural or man-made objects or other motocross operators or their equipment, negligence, breach of contract, or breach of statutory duty on the part of Campbell River Motocross Association and it's employees, volunteers, directors and agents. The undersigned agrees that the Campbell River Motocross Association and it's employees, volunteers, directors and agents shall not be liable for any such personal injury death or property loss and releases Campbell River Motocross Association, it's employees, volunteers, directors and agents and waives all claims against them.

The undersigned has read the above, understands it and signs this document on the understanding that he/she is over the age of nineteen, that no oral representations, statements or inducements apart from the foregoing have been made and that the purpose of this document is to make the undersigned entirely responsible for any personal injury, property damage or death and to preclude any recovery for damages, costs or expenses by the undersigned against the Campbell River Motocross Association.

All rules regarding the use of the Campbell River Motocross Association facilities will be adhered to. Any infractions may result in reprimands or suspension as seen fit by the Campbell River Motocross Association officials.
