NuVi Express, LLC P+C Agreement

We kindly ask that you read, understand, fill where's needed and sign to safe guard both you Carrier and NuVi Express, LLC.

This Procurator-Carrier Agreement (hereinafter "Agreement" is made and entered in on this Date of Service of form submitted by and between "NuVi Express LLC", a Michigan limited liability company, hereafter referred to as "Procurator" and the CARRIER listed below. The PROCURATOR is an independent transportation Procurator tendering transitions between SHIPPERS and/or BROKERS and the CARRIER who are authorized by the FMCSA to operate as a Registered Property Carrier Pursuant to the licenses issued.

The transportation service provided by CARRIER for Shippers/Brokers and is not between PROCURATOR. PROCURATOR is not a broker nor acting as a broker to the CARRIER.

Both PROCURATOR and CARRIER enter into this Agreement for the purpose of providing and receiving specified professional procurement services under specified rates and conditions. PROCURATOR and CARRRIER deem it essential to their respective interest to establish and maintain an independent Contractor relationship in the execution and performance of the agreement;

PROCURATOR is NOT responsible for the following: load problems, Hours of Service issues, equipment issues, billing issues, advances, handling and storage of paperwork (all paperwork may be sent to CARRIER, at CARRIER'S expense), DOT compliance issues,

NOW, THEREFORE, for and in consideration of the mutual covenant and undertaking herein, and subject to the terms and conditions hereinafter set forth, the Parties hereto warrant, covenant and agree as follows:

CARRIER desires to retain PROCURATOR by executing a Limited Power of Attorney to find, negotiate, and procure/dispatch CARRIER'S equipment at the following rates:

Confirmation will be signed by CARRIER and electronically delivered to PROCURATOR. Payments are due to the PROCURATOR for services rendered and are not contingent on outstanding payments due to the CARRIER for loads that (s)he has hauled for the SHIPPER or BROKER.

Your electronic signature below confirms that you agree to the stated terms. Failure to pay the PROCURATOR for services rendered will result in immediate termination of contract and services unless otherwise determined by the PROCURATOR.
