2022 DRYTC Waivers/Releases and Policies & Procedures
Please read the Waivers and Releases below relevant to your application for membership and program participation, as well as the Deep River Yacht and Tennis Club's Policies and Procedures. These are integral to your Membership Agreement with the Club. The rights and obligations under this Agreement shall be interpreted and construed in accordance with the laws of the Province of Ontario.
Waiver 1 - DRYTC Audit Exemption
The annual income of the club is projected to be less than $100,000. Therefore, I agree that the Club will not be required to conduct a formal audit and understand that it will provide financial statements for the current financial year at its Annual Meeting.
Waiver 2 – DRYTC Adult Member Waiver/Release
I understand that an element of risk is inherent in my/our participation in the activities of the Club and, in consideration of being permitted to participate therein, I/we, being an adult or adults having attained the age of eighteen years, agree to assume all risks of my/our participation in the activities and I/we, my/our executors, heirs, successors, assigns and persons who may be dependent on me/us waive any and all rights to any and all claims I/we may have, release the Club from any liability, and indemnify the Club holding it harmless against any and all costs related to claims against the Club, its directors, staff, and volunteers for loss of property, injury or death arising from the activities or my/our participation therein notwithstanding that such claims may arise from the negligence of the Club, directors, staff, or volunteers.
Waiver 3 - DRYTC Junior Member Waiver/Release
I understand that an element of risk is inherent in participation in the activities of the Club and, in consideration of the child or children named herein being permitted to participate therein, I/we agree to assume all risks of the child/children's participation in the activities and I/we, my/our executors, heirs, successors, assigns and persons who may be dependent on me/us waive any and all rights to any and all claims I/we may have, release the Club from any liability, and indemnify the Club holding it harmless against any and all costs related to claims against the Club, its directors, staff, and volunteers for loss of property, injury or death arising from the activities or participation therein by the child or children, notwithstanding that such claims may arise from the negligence of the Club, directors, staff, or volunteers.
I agree that I am responsible for the behaviour of the child/children named herein and that I am liable for any damages to property caused by him/her/them.
Waiver 4 - Storage of Watercraft
In consideration of being permitted as a Club Member and watercraft owner to store watercraft and related equipment on Club property, I agree to assume all risk and liability for the watercraft and its equipment including but not limited to loss, theft, or damage thereto. I/we, my/our executors, heirs, successors, assigns and persons who may be dependent on me/us waive any and all rights to any and all claims I/we may have, release the Club from any liability, and indemnify the Club against any and all claims against the Club, its directors, staff, and volunteers for loss of property, injury or death arising from the storage of my/our watercraft notwithstanding that such claims may arise from the negligence of the Club, directors, staff, or volunteers.
Watercraft storage means any privately-owned vessel including sail dinghies on the beach in the summer and/or stored in the Hexagon in the winter; keelboat, houseboat, pontoon boat, motorboat, and trailer in the boat yard during the summer or winter; and canoe and kayak on the Club racks in summer and/or Hexagon in the winter. In addition, I agree to insure these watercraft and to provide a copy of the insurance certificate to the Sailing Director upon request.
This agreement does not grant or extend rights to the owner with respect to any specific space throughout the term of this agreement. The Club may require the owner to move the watercraft, trailer, and/or other equipment to another storage area on Club property that the Club considers to be appropriate. The owner agrees to move the watercraft and/or associated equipment in accordance with the Club's instructions and authorizes the Club to move these items at its discretion and the owner's risk when unattended.
The owner agrees to pay the costs of all damage to the Club's property and to the property of other Club Members resulting directly or indirectly from the owner's negligence or the negligence of their agents, invitees, crew, family members, and/or guests. Without limiting the foregoing, the owner covenants to indemnity and save harmless the Club against all loss, cost, suits, claims (including penalties and fines) arising out of or in connection with the discharge or release of any fuel, chemicals, waste or other pollutants, and/or violations of any statue or regulation relating to the storage or operation of the watercraft by the owner, their agents, invitees, crew, family members, and/or guests.
