Electric Bike & Traditional Bicycle Test Ride Waiver and Release of Liability

I acknowledge that by signing this document I am releasing Cyclerie, LLC from liability. This application is a contract with legal consequences. I have been advised to read it carefully before signing. In consideration of the acceptance of my application for entry into this club, I hereby freely agree to and make the following agreements:

Please Enjoy your test ride(s) on a Pedal Assist Electric Bike (“e-bike”) or Traditional Bicycle!

Before doing so, please be aware of the following:

• An e-bike/bicycle is capable of going much faster than you may be used to. Please start your ride with the pedal assist mode on the off or zero position if equipped.. Get used to the bike before you use the faster speed modes.

• An e-bike is a much heavier bike, (due to the battery and motor) so it will handle differently. Please be stable on your ride.

• Please make sure you are physically capable of riding an electric bike.

• I agree to wear a bicycle helmet (Snell or ANSI approved) during the test ride.

In consideration of permission to TEST RIDE e-bikes or Electric Scooters, I agree to the following:

• All types of biking, and physical activity involve risks, I understand and assume these risks (serious injury or death) and freely accept the responsibility associated with biking.

• It is my responsibility to determine the safety of the areas where I ride.

• I release and agree not to sue Cyclerie, LLC. (“CYCLERIE”) , its agents, members, and employees (collectively the “Releasees”) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and I further agree that if, despite this Waiver and Release of Liability, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify and hold harmless each of the Releasees from litigation expenses, loss, liability, damage, or cost which may result as of the result of such claim.

I certify that a representative of CYCLERIE has explained to me and I understand how to:

Operate the gears and brakes.
Operate the pedal assist controls.
Operate the throttle assist controls.

I AM 18 YEARS OF AGE OR OLDER, HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT, HAVE SIGNED IT VOLUNTARILY AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT. THIS AGREEMENT IS GOVERNED BY THE APPLICABLE LAWS OF THIS STATE.
