• Fish Buyer License Application and Agreement 

  • No person or entity shall buy fish or other seafood from a Nooksack Tribal fisher unless he or she shall have a valid fish buyer’s license issued by the Nooksack Tribe. The director of fisheries management shall have the authority to approve or deny license applications based on criteria established by the Nooksack Fish Commission or Nooksack Tribal Council.

  • 8. Application Fee:

    I will pay for the license checked above, for a home station, plus $ 25.00 for each additional buying station(s). If the application is not approved, I understand the license fee shall be returned to the applicant.
  • License will expire December 31 of the Issuance year

  • 9. Fish Tax:

  • I agree to withhold a 2% tax from every sale of fish or other seafood from a Nooksack tribal fisher. In the event that the taxes remitted do not reflect the true market value, the tax will be calculated according to a consensus of the current market value as determined by the tribal harvest manager.

    I agree to remit taxes on a quarterly basis.  The taxes from the previous quarter would be due the following month.  The tax payment schedule is as follows:

    To insure proper credit, please include the fish ticket numbers when remitting tax payment.  Checks and money orders shall be payable to the Nooksack Fish Commission.

    “I agree to pay interest at the rate of two percent (2 %) per month on taxes not remitted as required above.” 

    Tribal members who have not remitted taxes in full from the previous year may not renew their buyer’s license and their commercial fishing permits.   

     

  • 10. Biologist Sampling:

  • I agree to allow the Tribal Natural Resource Staff to enter upon my business premises, including any tenders or buying stations, at reasonable times and upon reasonable notice to sample, segregate, and gather data for fisheries management purposes.

  • 11. Fish Ticket Information:

  • I agree to ensure that all fish tickets are filled out accurately, legible, and fully, including the amount of the fish tax withheld and the name of vessel and/ or tribal boat registration I.D. number.  An imprint of both the fisher’s embossed tribal fishing permit and the buyer’s Washington State or Nooksack Tribal issued buyers license card must appear on the fish ticket. I agree to comply with all state and tribal requirements for reporting the sale and purchase of fish and handling of fish tickets.

    Dealers are required to send the tribal copy (yellow copy) of the Treaty Indian Fish Receiving Tickets to the Nooksack Tribe’s Post Office box listed below (PO Box 157, Deming, WA 98244) within four (4) working days of the landing date.  The WDFW (green copy) and NWIFC (pink copy) are to be mailed to the NWIFC in compliance with the Washington Department Fish and Wildlife’s timeliness requirements, which state that receiving tickets must be delivered to the NWIFC within four (4) working days from the date of landing.  In turn, the NWIFC will deliver these tickets to the Washington Department of Fish and Wildlife.

  • 11. NON-COMPLIANCE:                                                                                                       

  • I understand that failure to comply with this agreement and the laws for the Nooksack Tribe applicable to Fish Buyer’s may result in revocation of the Fish Buyer’s License and civil penalties.
