AGC STUDENT/PARTICIPANT WAIVER

In consideration of participating in the activities at Aerial Gymnastics Club, LLC, the parent(s) and/or legal guardian(s) of the minor participant named below agree:

The parent(s) and/or legal guardian(s) consent to and will instruct the minor participating in any Aerial Gymnastics Club activity or event and regularly thereafter, that he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the instructor of such condition and refuse to participate.

Participant shall be instructed to and shall carefully review and follow all Aerial Gymnastics Club Safety Guidelines.

I/we fully understand and will instruct the minor participant that:

1. There are risks and dangers associated with participation in gymnastic events and activities including but not limited to those of bodily injury, partial and/or total disability, paralysis and death;
2. The social and economic losses and/or damages, which could result from those risks and dangers described above, could be severe;
3. These risks and dangers may be caused by the negligence of the participant or the negligence of others;
4. There may be other risks not known to us or not reasonably foreseeable at this time.

I/we accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused or alleged to be caused in whole or in part by the negligence of Aerial Gymnastics Club, LLC all event hosts, other participants, coaches, instructors, officials, sponsors, advertisers, owners, lessors and lessees or the premises used to conduct the event or activity and each of them, their officers, directors, agents, and employees.

I/we agree that Aerial Gymnastics Club, LLC shall retain all rights to use for publicity and/or any lawful purpose any and all video or photographic material that may contain images of participants taken at any and/or all events or activities.

I/we agree that this Consent and Assumption of Risk Statement covers each and every event or activity sponsored by Aerial Gymnastics Club, LLC.

I hereby COVENANT NOT TO SUE and FOREVER RELEASE Aerial Gymnastics Club, LLC affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in Aerial Gymnastics Club's program(s), from all liability and for any and all damages and injuries suffered by me or my student(s) during instruction, supervision, and/or control during any and all classes or extra activities, or any activities incidental thereto while at Aerial Gymnastics Club, LLC wherever, whenever or however the same may occur. This includes any activities outside while on the property or at home. 

Indemnify for Possible Future Medical Expenses: As the parent or legal guardian of the participating child(ren). I hereby agree to individually protect for the possible future medical expenses which may be incurred by my child as a result of any injury sustained while participating in any program of instruction, recreation or competition at, for or under the direction of Aerial Gymnastics Club or for any injury sustained on the outdoor areas of the property.

In the event that my child/children should require medical care or treatment, I authorize Aerial Gymnastics Club, LLC to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AED’s, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

I HEARBY CERTIFY THAT I AM THE PARENT/ GUARDIAN OF A MINOR AND SIGN ON BEHALF OF THIS INDIVIDUAL. I/WE HAVE READ AND UNDERSTAND THE ABOVE WAIVER AND SIGN IT VOLUNTARILY.

AGC PARENT/PARTICIPANT WAIVER

IN CONSIDERATION OF the risk of injury that exists while participating in Aerial Gymnastics Club class, events and/or activities and

IN CONSIDERATION OF my desire to participate in any Aerial Gymnastics Club classes, events and/or activities and being given the right to participate

I HEREBY knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in Aerial Gymnastics Club classes, events and/or activities.

I am voluntarily participating in the Aerial Gymnastics Club classes, events and/or activities entirely at my own risk. I am aware of the risks associated with participating in Aerial Gymnastics Club classes, events and/or activities, which may include, but are not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, economic or emotional loss and death. I understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel to and from Aerial Gymnastics Club or from conditions at Aerial Gymnastics Club. Nonetheless, I assume all related risks, both known and unknown to me of my participation in classes, events or activities.

I acknowledge that that Aerial Gymnastics Club classes, events and/or activities may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. I agree not to participate in Aerial Gymnastics Club classes, events and/or activities unless I am medically able and properly trained, and I agree to abide by the decision of the Aerial Gymnastics Club, LLC official or staff, regarding my approval to participate in any classes, events and/or activities.

I further acknowledge that Releases are not responsible for errors, omissions, acts or failure to act of any party or entity conducting a specific event or activity on behalf of Releases. In the event that I should require medical care or treatment, I authorize Aerial Gymnastics Club, LLC to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AED’s, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.

I further agree to indemnify, defend and hold harmless the Releases against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs which may in any way arise from my or my family’s use of or presence upon the facilities of Aerial Gymnastics Club, LLC.

I HEREBY acknowledge that I have carefully read this WAIVER AND RELEASE OF LIABILITY and fully understand that it is a release of liability. I expressly agree to release and forever discharge Aerial Gymnastics Club, LLC, their affiliates, partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, managers, owners, directors, volunteers and other members involved in Aerial Gymnastics Club's program(s), from any and all claims or causes of action including any physical or psychological injury that I may suffer as a direct result of my participation in Aerial Gymnastics Club classes, events and/or activities. I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against Aerial Gymnastics Club, LLC for personal injury or property damage.

I affirm that I am of the age of 18 years or older and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract that I am signing of my own free will.
