Copyright Release Form
I am requesting Dies Direct (a PMA Industries, Inc. company) to make products using designs I have supplied. I know that Dies Direct will not manufacture materials using designs subject to someone’s copyright, or that would be used for trademark infringement. I understand that I must confirm for Dies Direct that I have the right to use the designs I am supplying to create the final product I am requesting and that doing so will not result in copyright infringement nor will it lead to or contribute to trademark infringement.
I understand the reproduction of another party’s works could constitute copyright infringement. I also understand that if someone’s trademark is used in a way that might create confusion, or mistake, or deception as to the source of those works could constitute trademark infringement
I understand that Dies Direct will be relying on the statements and representations I am making in this release in agreeing to manufacture product using the designs I am supplying. I warrant and represent to Die Direct that I either own the material, or have been given permission by the owner of the design to copy, print or reproduce it in any fashion, or have been given a license by the owner of the design to use, copy, print or reproduce in any fashion, or the design is in the public domain, or the design is to be on file with a public agency or is intended to be on the record in a court proceeding.
I agree to indemnify, defend and hold Dies Direct harmless from any loss, demand, suit, damages, claim or action arising out of or related to the foregoing representation or my use of design or the copying, printing or manufacturing of the design. I agree to pay any judgment, loss, costs and fees (including reasonable attorney fees) incurred by Dies Direct in connection with such a suit, demand, claim or damages in connection with Dies Direct enforcement of the indemnification against me.
