NON-REFUNDABLE AGREEMENT

3. WAITING LIST RETAINER FEE

• A non-refundable retainer is required by the BUYER to go onto the WAITING LIST or MASTER LIST (used interchangably) for the only time period stated in this agreement. This retainer for the waiting list does not apply to the price of the puppy.

 

• Funds Accepted : Zelle, Cash, PUBLIX money order, Bank Transfer/Wire. 
  • CASH OR PUBLIX MONEY ORDER MUST BE HAND DELIVERED. GOOD DOG BUYERS MUST PAY VIA GOOD DOG PAYMENT WITH ADDITIONAL FEES

 

• Taxes, processing fees, or any other fees are not included in the $100 non-refundable retainer, and will be the responsibility of the BUYER

 

WAITING LIST

BREEDER reserves the right to hold the first 1 spot for BREEDER PICKS with every single litter available for professional development and sales. BREEDER PICK can be held back for the origional breeder or be placed with outside breeder. 

 

WAITLIST FAMILIES ARE CONTACTED ONLY VIA EMAIL FOR WAITLIST UPDATES AND SELECTIONS. WAITLIST FAMILIES MUST RECEIVE AND OPEN EMAILS FROM BREEDER. 

 

 

 

 

FINAL PUPPY SELECTIONS

Once BUYER has requested to make a puppy selection they will have until the end of the day to finalize their puppy selection with a commitment payment and completed official selection form. 

 

Final balance payment is due on day of pick up in CASH unless specifed otherwise in advance by BREEDER

 

Out of state buyers and BUYERS utilizing transport must complete payment between 6-7 weeks in compliance with out of state policies

In the event a BUYER does not make a puppy selection they will remain on the WAITING LIST.

 

 

 

 

 

 

PICK UP

  

BREEDER will establish the date and time and location for puppy pick up. All BUYERS or an agent of the BUYER must make arrangements to be present at the set date, time, and location for their puppy pick up. 

All puppies must be picked up within 48 hours of passed a Health Certificate, at the designated pick up location date and time

 

Final payment is due at pick up in CASH ONLY for in-state BUYERS not requiring transport or due at 7 weeks of age via zelle/bank wire if BUYER is out of state or requiring transport 

 

If puppy is to be held past 48 hours the BREEDER will require completed final payment from BUYER no later than 7 weeks old. In the event that something unexpected has delayed a BUYER from picking up at the scheduled pick up the BUYER must complete the balance no later than 8 weeks and 2 days old, or within 24 hours of the unexpected event

 

Buyer will be charged a $35/day boarding fee starting on day three after the Health Certificate and all additional vetting expenses are separate from boarding and are the financial responsibility of the buyer

BUYER must have an activated incidental pet insurance policy activated no later than 8 weeks and 2 days old, with immediete coverage.

 

BUYER must confirm scheduled pick up between 24-48 hours prior to pick up in writing 

 

OUT OF STATE buyers must have transportation approved and set no later than 7 weeks 0 days 

 

BREEDER reserves the right to displace BUYER back to the waiting list and enforce the LATE TRANSFER POLICY if BUYER does not provide confirmation prior to pick up, if BUYER is a no call no show for pick up, if BUYER does not complete payment by the deadline, or if BUYER is unable to arrange transportation by the deadline (pick up is no later 8 weeks 2 days and final travel plans must be submitted no later than 7 weeks and 0 days old).

 

 

We do not permit transfers after puppy selections. If a buyer removes themself from a puppy they are forfiting any money paid towards that puppy

If it has exceeded the waiting period since placing a retainer and the BUYER is not matched with a specific puppy, they will need to submit an additional retainer for continuation of another waiting period.

BREEDER reserves the right to make changes to the business including but not limited to selection process and requirements for how/when final payment is due for any BUYER on a waitlist or prospective BUYER. WAITLIST RETAINERS ARE NOT REFUNDABLE.

Breeder will not disclose any BUYER specific preference to another BUYER as a wish list can change.

 

Once a final selection has been made the BUYER is not able to change to another puppy or transfer back to the waiting list 

 

All photos and videos and content taken from birth to release date of the litter and/or selected puppy are property of Whitney Charisma for life. Ownership of the media content does not transfer with purchase of the puppy. All photos or media must be reposted or shared with a watermark or photography stamp and photography credit should be given at all times. The BUYER can not sell or monotize any media content before pick up,  at any time. Whitney Charisma reserves the right to use all media for advertising, social media, marketing, showcasing, personal use, ect. 

Puppy selection is virtual with a phone call option for all BUYERS. In person visits prior to puppy pick up are not permitted under any circumstances, except at the vet office directly following completed vetting. 

 

The BREEDER has the right to refuse sale or return payment without explanation and at any given time while puppy remains with BREEDER, voiding the sale and agreement. Any returned commitment payment will be processed back to the BUYER via mailed check

 

In the event death or injury of a selected puppy while still in the care of BREEDER occurs, any placed commitment payments will be offered as a refund or may stay on file as a credit. The WAITLIST retainers, taxes, processing fees, ect are not refunded. BUYER may not be compensated for costs associated with travel/pick up/puppy supplies.

ALL PUPPIES ARE SOLD AS PET QUALITY AND NO BREEDING RIGHTS OR PERMISSION IS AUTOMATICALLY GIVEN. BREEDING RIGHTS are assessed on an individual basis and will be offered in writing with an upcharge. The BREEDER reserves the right to refuse breedings rights prior to breeding right upcharge. 

 

Should the dog who is not provided with breeding rights be bred, whether male or female, a $2000 per puppy penalty will be assessed if legal action is taken due to unapproved breeding

Should pet registration paperwork be offered,  the registry papers will be held until proof of spay / neuter sent directly from the vet

 AKC pending paperwork may create a delay in registration papers and is out of the control of the BREEDER. BREEDER has up to 12 months from pick up to provide breeding papers should the dog be purchased with breeding rights. 

 

Any papers, including breeding papers will be at the cost of the buyer. 

 

Breeder does not guarentee breeding quality on any dog produced and buyer must make their own professional decision on whether they will breed their breeding-approved dog or not. Breeder will not guarentee genetic results or color results on any specific puppy. Breeding rights will not be refunded in any case except vet confirmed death prior to first heat cycle, or 6 months old

 

Breeder complies with FLORIDA STATUTE 828.29 in regards to puppy lemon laws and health guarentees. 

 

If a puppy is discounted or reduced price, there is no health guarentee offered with the puppy. Buyer waives health guarentee by accepting the lower price

 

Breeding price will still honor a health guarentee as long as the total purchase price is equal or greater to the original listing price. Breeding upcharge is seperate and not factored into the puppy lemon law.

 

Buyer acknowledges that an assistant, volunteer or third party may provide services on behalf of the breeder for any aspect related to their breeding business. Payments may go through a 3rd party at the BREEDER'S request.

Even though a puppy may be selected via the selection process all BUYERS must understand that ownership does not transfer until payment is completed in full, purchase agreement is signed, and puppy is picked up by the BUYER or agent of the BUYER.

Every single puppy is raised, loved and owned by the BREEDER until pick up. This means until that time the BREEDER is the only person who can make decisions for the puppy in regard to their health and wellbeing. We hope that you can understand the responsibility and emotions we have invested in every single puppy and respect how we raise, treat, and care for our babies.

 

The Purchase Agreement is a seperate document and is required to be signed by the BUYER no later than pick up 

 

Taxes and electronic fees apply and are not included in the listing price

 

BUYER agrees to refrain from posting negative reviews, "breeder bashing" , slander or libel, while under contract and up to 60 days from puppy pick up, with the BREEDER and BREEDER'S kennel name.

 

BUYER agrees to voice any concerns directly to BREEDER or agent of the Breeder to attempt to come to resolution and harmony. 

 

Should legal action occur any and all court proceedings will take place in SEMINOLE COUNTY, FLORIDA.

I, the undersigned buyer, have read, understand, and agree with all of the terms and conditions set forth in this non-refundable retainer contract. I agree to not make any attempts to reverse payments or retainers as I acknowledge that the services are rendered at time of payment. 

I, the BREEDER, have read, understand this non-refundable retainer contract. I agree that a non-refundable waiting list payment and executed contract will secure a spot on the waiting list for the BUYER for up to 12 months. I verify that this executed contract has been reviewed any signature to my name is authentic to myself.
