General Responsibilities of the Broker of Record/Designated REALTOR®
Each firm (or office in the case of firms with multiple office locations) shall designate in writing one REALTOR® member or Appraiser member who shall be responsible for all duties and responsibilities of membership including the obligation to arbitrate (pursuant to Article 17 of the Code of Ethics) and the payment of Association dues (Article X on the NAR bylaws).
The Broker of Record/Designated REALTOR® is responsible for the following:
• Notification of all new licensees affiliated with the office
• Notification of all licensees terminated from the office
• Notification of all contact information changes
• Variable Broker Dues for all affiliated licensees who do not become members (pursuant to the Realtor®
Association bylaws article X, section 2, dues). See below for additional details on Variable Broker Dues.
• Affiliated licensees compliance with the REALTORS® Code of Ethics
• Affiliated licensee's compliance with all NAR required activities such as Code of Ethics training.
Variable Broker Dues
The Broker of Record/Designated REALTORS® dues increase under the following circumstances:
• A licensee affiliated with the firm chooses not to become a member of the Realtor® Association
• An existing licensee with the firm chooses not to renew their membership
In either case, the Broker of Record/ Designated REALTORS® dues will be increased by an amount (determined by NAR) annually for each individual pursuant to bullet one and two above. This increase in the Broker of Record/Designated REALTOR® dues does not give the individual licensee involved any rights or privileges of membership and the licensee would simply be listed as a Non-Member Salesperson with the Broker of Record/Designated REALTOR®.
Failure by the Broker of Record/Designated REALTOR® to pay the Variable Broker Dues will result in membership termination and termination of all services, including MLS.
REALTOR® Membership Agreement
Please read the agreement and acknowledge below.
I hereby apply for REALTOR® membership in the Broward, Palm Beaches & St. Lucie Realtors®. My dues and application fee will be returned to me in the event of non-acceptance. In the event of my acceptance, I agree to abide by the Code of Ethics of the National Association of REALTORS® (NAR), which includes the duty to arbitrate, and the Constitution, Bylaws and Rules and Regulations of the above-named Association, BeachesMLS, the State Association, and National Association. I further agree to complete a course of instruction covering the Bylaws and Rules and Regulations of the local Association, the Bylaws of the Florida Association of REALTORS®, and the Constitution and Bylaws and Code of Ethics of the NATIONAL ASSOCIATION OF REALTORS® and shall pass such reasonable and nondiscriminatory written examinations thereon as may be required by the Association. I understand membership brings certain privileges and obligations that require compliance. I agree that failure to provide complete and accurate information as requested or any misstatement of fact, shall be grounds for revocation of my membership.
Upon acceptance of my application and fees, I understand that I am granted provisional membership with temporary rights and responsibilities of membership and that my application fees or dues paid are NON-REFUNDABLE.
I understand my acceptance to full membership will not be final until I complete my Orientation Course obligations and the approval process.
I further understand that if I fail to successfully complete an Orientation Course within sixty (60) days of application without a reason considered valid and acceptable by the Association and the granting of an extension, that all fees and monies paid shall be forfeited and my application and provisional membership will automatically be terminated.
The undersigned subscriber acknowledges registration of Private ID numbers for use by Subscriber in connection with BeachesMLS services. Subscriber further acknowledges and accepts full responsibilities for the confidentiality and security of said ID number(s). In the event of disclosure and or ID number use by anyone other than the subscriber, a fine of $5,000.00 will be assessed by BeachesMLS against that subscriber. In the event the subscriber requests a fax copy of this statement, the Association is not held responsible for disclosure or misuse of the ID number by anyone other than the subscriber.
Membership is final only upon approval by the Association and may be revoked should completion of requirements, such as orientation, not be completed within the time frame established in the Association's Bylaws. I understand that I will be required to complete periodic Code of Ethics training as specified in the Association's Bylaws as a condition of membership. NOTE: Applicant acknowledges that if accepted as a member and he/she subsequently resigns from the Association or otherwise causes membership to terminate with an ethics complaint pending, the Association may condition renewal of membership upon applicant's certification that he/she will submit to the pending ethics proceeding and will abide by the decision of the hearing panel.
If applicant resigns or otherwise causes membership to terminate, the duty to submit to arbitration or mediation continues in effect even after membership lapses or is terminated, provided the dispute arose while applicant was a REALTOR®. I hereby certify that the information furnished by me is true and correct, and I agree that failure to provide complete and accurate information as requested, or any misstatement of fact, shall be grounds for revocation of my membership if granted.
Dues are prorated according to the month joining.
*REALTOR® Party -Contributions are not deductible for federal income tax purposes. Contributions are voluntary and will be used for political purposes. Contributions are not a condition of membership in the Association and a member may refuse to contribute without reprisal. Seventy percent of each contribution is provided to the Florida Realtors PAC in Florida to support state and local candidates and state and local issues. The balance is sent to the National Association of REALTORS® Political Action Committee and will be charged against your contribution limits prescribed by 52 U.S.C 301106, except when donations are made from corporate funds or are designated cases in which case the balance is provided to the National Association of REALTORS® Political Advocacy Fund for use for federal political purpose.
NEW REALTOR® CODE OF ETHICS TRAINING
Applicants for REALTOR® Membership and provisional REALTOR® Members (where applicable)shall complete a training program on the Realtors® Code of Ethics of not less than two hours and thirty minutes of instructional time. This requirement does not apply to applicants for REALTOR® Membership or provisional members who have completed comparable Ethics training within the current cycle from another association, provided that REALTOR® Membership has been continuous, or that any break in membership is for one year or less.
NEW MEMBER ORIENTATION
In addition to the required Realtors® Code of Ethics training, applicants are required to complete an association orientation program. This requirement does not apply to applicants applying for REALTOR® Membership or provisional members that were formerly members of Broward, Palm Beaches & St. Lucie Realtors®, who previously completed the Association Orientation training, provided that REALTOR® Membership has been continuous, or that any break in membership is for one year or less. Additionally, if a member transfers from another Association and can provide proof of attending a comparable Orientation with another board within the past year, the requirement may be waived.
I hereby certify that the foregoing information furnished by me is true and correct, and I agree that failure to provide complete and accurate information as requested, or any misstatement of fact, shall be grounds for revocation of my membership if granted. I further agree that, if accepted for membership in the Realtors® Association and MLS, I shall pay the fees and dues as from time to time established. NOTE: Payments to the Realtors® Association, are not deductible as charitable contributions. Such payments may be as an ordinary and necessary business expense. Dues are non-refundable.
