All vendor booths are minimum space of 10” x 10’ = 100 sq. ft. The City of North Miami Beach will supply the tent unless the vendor has a mobile concession stand which must be pre-approved by City of North Miami Beach staff. The Participation Fee will cover the cost of tent, plus one table, and two chairs. Vendor is responsible for the extension cord. Vendors are responsible for the Tables and chairs from the time of delivery until pick-up time. It is the Vendor’s responsibility to make sure all equipment is returned in the condition in which it was received. The participation fee is subject to change by the City of North Miami Beach and does not include electrical services and generators. Cancellations must be in writing two weeks in advance; e-mail is acceptable.
Absolutely no exceptions.
The vendor may sell only the products which are listed in the vending contract. Confirmation of space with instructions for parking will be emailed to each vendor.
APPLICATION ATTACHMENTS
1. Table and Chair order form must be attached to this application if requesting additional tables and chairs beyond what is provided in the rental fee. 2. Electricity order form must be attached to this application, if requesting additional wattage.
FOOD VENDORS MUST ALSO PROVIDE:
1. A copy of your current state and local license (FL Department of Food and Beverage) 2. Menu listing with.0 prices of all food products to be sold. 3. At least one photograph of the food mobile, labeled with the vendor’s name and showing food products, signage, booth/cart front, and cooking area in full operation. 4. Binding proof of insurance for bodily injury, property damage and public liability, (including product liability) attributable to the vendor’s activities in the festival in the minimum amounts of $250,000 for any one person, $1,000,000 aggregate limit. The policy must be written by a carrier licensed to write such policies in the State of Florida. Applications will not be processed without original certificate of insurance. Upon acceptance to the Festival, vendor must name the City of North Miami Beach as additional insured.
VENDOR RULES AND REGULATIONS
1. Permission to sell at the festival is subject to the terms and conditions of the Vending Contract. The City of North Miami Beach agrees to permit the vendor to sell the foods or beverages at prices not to exceed those listed on the Vendor’s application. Vendor must have ample supply of food to serve through the entire event. The Vendor agrees not to sell, distribute, or otherwise provide to any person at the Festival, with or without compensation, any type of alcoholic beverage. The Vendor agrees not to sell, distribute, or otherwise provide to any person at the Festival, with or without compensation, any goods, foods, beverages, or other products other than the Vendor’s products. 2. Vendor shall set up beginning an hour before the event starts and must have food preparation area completely set up Please note that no vehicles will be allowed in the intersection. Vendors shall close or break down their booths no earlier than 10 minutes before the end of the event. Vendors and all their equipment must be off the premises by 30mins after the close of the event. 3. All vendors shall occupy the space which is assigned. No transfers, assignments, licensing, or subletting of booths is allowed. The size of the space shall be 10’ x 10’ and booths must be placed within the designated space. The Vendor shall provide an attractively designed sales booth for each space to be occupied by the Vendor. It must be at least the quality shown in the Vendor’s submitted photographs. All cooking with charcoal or other flammable materials will be conducted in the open areas, and reasonable precautions will be taken to protect the public from accidental contact with the cooking areas. All fuel containers and other flammable materials must be kept away and at a reasonable distance from the cooking areas. Generators and cooking facilities must be turned off completely before refueling. 4. Vendor and all employees shall be properly attired always. Vendor and employees are not permitted to drink or serve alcoholic beverages. Vendors shall wear plastic disposable gloves to serve in public and are subject to inspection by a North Miami Beach Code Compliance Officer. Any vendor closed by the Health Inspector or the North Miami Beach Staff will not be entitled to a refund. 5. The Vendor shall post an attractive sign, visible to the public, listing all items of the Vendor’s products for sale during the Festival and including the selling price for each item. 6. Vendor shall supply gas-powered generators. Gas-powered generators must be whisper quiet and equipped with sound barriers (loud generators will not be accepted.) Absolutely no cords or hoses will be permitted to lie across the streets -- NO EXCEPTIONS. Vendors may rent the generators from the City through an electricity order form. 7. Vendors who will be cooking shall have a five-pound fire extinguisher at each sales booth or cart, with a class A or B rating. If a vendor uses a fryer it must be of commercial grade and must also have a certified class K extinguisher.
All cooking vendors should have a K extinguisher as per Miami Dade County.
The extinguisher must be in serviceable condition. If no extinguisher is present, the Vendor will be shut down until one is obtained. At the end of the day, all coals must be removed from the festival grounds and may not be discarded within the festival site. All upright propane tanks must be secured in a manner to prevent accidentally being knocked over. Fire inspectors are on duty throughout the festival and will inspect each food vendor’s operations. 8. Vendors shall furnish trash containers for customers and be responsible for keeping their areas clean continuously throughout event hours. Vendor shall provide at least two trash barrels, clearly labeled with the vendor’s name, and sturdy plastic trash bags at each sales booth. Trash, in securely fastened trash bags is to be deposited on a regular basis throughout each day in the nearest available dumpster. Any vendor not leaving booth space clean and trash-free will forfeit their security deposit. Absolutely no dumping of cooking oils, coals or any other food products into public street drains. 9. Vendors shall be solely responsible for the security and safety of vendor’s cash, equipment, goods, inventory, supplies and other property. 10. The vendor may not assign or otherwise transfer the Vendor’s rights and obligations under the contract without the prior written consent of the City of North Miami Beach. No part of the contract maybe amended or waived except by a written instrument agreed to by both parties. 11. The contract shall be governed in all respects by, and constructed with, the laws of the State of Florida without regard to principles of conflicts of laws. Each vendor shall individually comply with the State of Florida tax regulation. In the event of any breach of the contract by the Vendor or any employee or independent contractor thereof, the City may bar or eject the Vendor from the premises of the Festival without any refund or credit for any payments made by the Vendor in connection with the contract. Such action shall be in addition to and not in lieu of any claim by the Festival for damages resulting from such a breach. 12. In the event that the event is interrupted or prevented without contributory fault or negligence of either party because of war, act of God, fire, national or local calamity, riot, or civil disorder, any act or regulation of public authorities, or any unforeseen occurrence or labor dispute, including strike or lockout of employees, then the obligations of the parties shall be suspended to the extent made necessary, but no refund shall be due or payable to the vendor from the City of North Miami Beach for any fees paid. Neither the vendor nor the City is liable to the other for any damages caused thereby. 13. The Vendor shall indemnify, defend and hold harmless the City from and against any and all claims or assessments, regardless of the validity thereof, including any attorney’s fees and costs, attributable to or otherwise arising of any and all activities undertaken by or on behalf of the vendor in connection with the North Miami Beach

, including, without limitation, the preparation of sales of food or beverage(s). 14. Vendor understands that the City cannot guarantee exclusivity of their product. 15. Vendor understands that the City reserves the right to assign or reassign any or all booth/trailer locations and spaces. No guarantee of a specific booth or space location is given by the City. 16. Vendor understands that this application is not a contract. Space will only be granted to Vendor by contract after the City has accepted by application after staff review. 17. Vendor will not be allowed to exhibit or sell at the event unless he has a signed contract, paid all fees in full and provided an insurance binder naming the City of North Miami Beach as additional insured (applies to food vendors only). 18. Vendor understands he cannot sell any alcoholic beverages. 19. Vendor understands that he may not sell T-shirts, sweat-shirts or any other new novelty clothing or accessories without the express written consent of the City of North Miami Beach. I understand that I may not sell posters. 20. Vendor understands that a surcharge may be levied for any late payments. Vendor understands that he will be charged a fee for a bounced check. 21. Vendor understands that he may only sell what is approved from the description provided to the City of North Miami Beach. 22. The City does not provide water & ice. Vendor must plan to bring these items. 23. Vendor must provide all necessary labor and management in the operation of the booth. 24. Proof of insurance must accompany the application. Public liability insurance coverage certificate naming the City of North Miami Beach as additional insured for the time, date, place and name of the event, in the amount of $1,000,000 is required prior to the event. 25. You may decorate your booth in good taste with the intent to enhance the festival atmosphere. You must keep the booth(s) neat and clean to provide a general good appearance. 26. Keep any perishable or potentially spoilage food (e.g.dairy products, meats, poultry, fish and salads) properly refrigerated or heated as consistent with applicable health laws. Failure to keep these products properly is a breach of this agreement and shall result in immediate termination of participating in the festival. 27. Vendor has read, understands and will comply with the attached electricity notice. 28. It is understood and agreed that Vendors, its agents and/or assigns shall indemnify, hold harmless and defend the City of North Miami Beach Events, its corporate sponsors, and the City of North Miami Beach from all liability for loss, damage, or injury to any person or property in any manner arising out of or incident to this Vendor application or the performance of its terms and provisions. Vendor shall be solely responsible for securing, at his sole cost, workers’ compensation insurance, disability benefits insurance and any other insurance as may be required by law. The City of North Miami Beach may change its event venue if necessary. 29. The City of North Miami Beach shall retain the sole rights for the sale of alcoholic beverages. The City of North Miami Beach, its designated security personnel or the North Miami Beach Police Department shall have the authority to remove any vendor from the premises for unauthorized sale of alcoholic beverages. 30. No amplifiers or speakers shall be permitted other than those scheduled by the City of North Miami Beach. 31. All vendors will be provided with 2 preferred parking passes for entrance to event premises. 32. Vendor accepts all the terms set forth in this application and certifies all the information supplied to be correct to the best of vendor’s knowledge.
