You, as the "Client" are entering into a professional service relationship with Heather Wright/Fitmind Wellness Solutions LLC contracted as a health and wellness consultant and certified holistic nutritionist, herein "Professional".
By signing this agreement, you understand and agree to the following:
- Heather Wright is NOT a registered dietitian and will NOT provide Medical Nutrition Therapy (MNT) Prescription diets, specific written meal plans, or any nutritional therapy plan to solely treat disease, weight loss, weight gain, medical disorders etc.
-Heather Wright will NOT diagnose, treat, or cure any disease, condition, injury or otherwise unless working in tandem under direct Physician supervision and guidance. She may refer clients to professionals for consultation in those areas of concern.
- Heather Wright is a Certified Holistic Nutritionist and Mindset Coach who utilizes self-help methods such as Cognitive Behavior Therapy (CBT) exercises and work sheets to help clients become more mindful. These services are NOT a substitution for or equivalent to psychotherapy or mental health counseling.
- Heather Wright is a Spiritual Coach & Shaman. She will provide guidance and suggestions for you to consider and apply at your own risk.
-Heather Wright WILL provide macro-based nutrition recommendations based on the published data of nutrition journals, AMA, AADP and other reputable nutrition education entities to assist clients in reaching their wellness goals while maintaining scope of practice.
- Heather Wright WILL work in conjunction with other professionals at the clients request as it pertains to the client's individual case while maintaining scope of practice.
- Any plans or educational material written/created/provided by Heather Wright is copyright protected intellectual property. Any attempt made by the contracted client to share any advice, guidance or information provided by Heather Wright to a non-contracted client may result in legal action.
- Any "done for you" or "sample" meal plans, and any Gut Prime or Hormone Restore Protocol Plans are intended to be used as a reference for clients to create their own meals using the guidelines provided. These plans are not intended to treat, cure or diagnose disease, but are tailored specifically to the goals, preferences, and ailments of the client. Consultation with the client's current medical team by the client is recommended prior to making any lifestyle changes.
- Participation in any lifestyle program, nutrition, fitness, mindset or lifestyle coaching program is done so at the patient's own free will and at their own risk.
- Any Third Party professional services made available to contracted clients such as meal prep and delivery, lab testing etc. is the responsibility of the client to maintain any business or financial relationship and Heather Wright will not be held financially, physically, or legally responsible.
Regular Hourly Rate
The Professional's regular hourly rate is $150/hour for all planning, preparation, evaluation, communication (with client or other professionals), documentation/charting services, counseling and consultation services.
Any additional time spent outside of what's included in posted service packages or originally quoted within Custom Program Quotes will be billed at the hourly rate accordingly. This includes texting, phone/video calls, e-mailing, plan or report writing, communicating with other individuals or professionals about the client's case, etc. Hourly rate may be discounted or pro-rated at the Professional's discretion at any time.
Concierge Level Care & Support Clients
Clients who are enrolled in Concierge Level Care and Support programs with this Provider will have access to the Provider 18 hours per day 7 days per week via text message, but also via phone, email, and video chat when necessary. Provider will also be available 24-hours in the event of a crisis or emergency involving care and support of the client within their scope of practice as part of the client's care team. In the event the Provider is unavailable or out of town, the Provider will notify the client ahead of time to plan accordingly.
Interventional/Intensive Coaching Service Rates
Interventional/Intensive Coaching services are rendered at the rate of $250/hour with a 4-hour minimum for the initial set up, and then $150/hr accordingly after.
This includes texting, phone/video calls, e-mailing, plan or report writing, communicating with other professionals about the client's case, etc.
Interventional/Intensive Coaching Services are only available for contract by licensed Mental Health Professionals or Physicians who intend to work in tandem for case management of their client.
Emergency/Same Day Fit In Sessions
These sessions are considered Concierge or Interventional and are billed at the $250/hour rate.
In Home Nutrition, Lifestyle, Coaching and Shop-Along Services
In-home services or Shop Along services are billed at the Provider's hourly rate and a 2-hour minimum. Travel rate of $25 applies for any locations more than 10 miles in any direction from 33064, Provider's address.
Client-Professional Coaching/Nutrition Program Relationship and Expectation Requirements
BASIC ETTIQUETTE
Accountability and showing up for yourself is mandatory in all of the programs. Respect for everyone's time is expected to be reciprocal.
The lifestyle/wellness programs are in-depth and individually tailored curriculums that focus on the needs of the client in the emotional, mental, physical, nutritional and fitness capacities. Each program is designed specifically for the needs of the client, and there is nothing cookie-cutter about it! These programs require full attention and intention from the Client and Professional alike.
Each client will be expected to invest the same time and effort into learning the fundamentals of nutrition along with creating healthier relationships with food, mindfulness and cognitive behavior exercises where appropriate to reverse old habits and consistently create and retain new ones as I, Heather Wright, (the professional), will invest in carefully crafting your care plan and providing the necessary resources for education, illustration and support.
Accountability is EVERYTHING in my curriculum. I will show up for you, but I can't do the work FOR you.
Success Guarantees
There will be no guarantee of success demonstrated in cured ailments, weight loss, body composition, or by any other definition provided to the client upon enrolling in a program with the provider. Success is determind on a case by case basis according to individual challenges and limitations.
Clients should have realistic expectations surrounding building healthier lifestyle habits that they can retain long-term and building a supportive relationship with the Provider.
PROGRAM EXPECTATIONS
Clients are expected to:
(1.) Follow the recommendations provided and study the educational materials provided unless otherwise advised not to by medical providers. Reading the Educational Materials is MANDATORY. Scheduled assigned reading for clients who struggle with retention is available upon request.
(2.) Check In regularly via text, electronic form submission, Google Drive, or scheduled check-in methods/frequencies set forth by Heather Wright and the client (coaching program clients only). Professional will reach out to you according to the level of support you purchased. If you choose not to engage, this is entirely up to you, but your support does not extend beyond what you have paid for unless you satisfy another installment.
(3.) Plan and log meals ahead for each day (at least one day ahead of time) in the app unless otherwise directed by Heather Wright (coaching program clients only). It is required that you plan your meals ahead of time and notify Heather Wright so that she may assist in any adjustments where necessary, if you purchased this level of support.
(4) When you begin your program, your duration begins from there. This means your "clock" starts running and will not be paused or extended unless prior approval is granted by Professional, with advanced notice from the Client. Some exceptions are unforseen events or circumstances beyond Professional or Client control such as death, state of health, accident, work obligations, etc.
Course Documents and Material Access
All course documents for education, resources, nutrition planning etc. will be provided in a secure Google Drive where only the Client and Professional will have access via a private link or shared folder with their e-mail. If the client is not computer literate,other methods will be discussed.
All clients are expected to utilize web-based platforms for accessing all course documents, check-in forms, communication etc. Special accommodations may be made at the discretion of the Professional to provide all curriculum materials in another fashion for the client's needs.
In signing this agreement, you are agreeing to and acknowledging that you understand the terms and your responsibilities, and if at any point you are "insubordinate" with no other factors beyond your control, that the Professional is not responsible for any compensation or refund.
Regular Hours of Professional Contact
Client may contact the Professional within the alotted amounts, methods, and durations as outlined in any program or individual quote provided to the client and agreed upon mututally by both parties within the hours of 8AM to 8PM unless otherwise instructed or permitted by the Professional.
Concierge Hours
Clients who are enrolled in Concierge Level Care and Support programs with this Provider will have access to the Provider 18 hours per day 7 days per week via text message, but also via phone, email, and video chat when necessary.
AUTOMATIC TERMINATION OF RELATIONSHIP BY PROFESSIONAL
Any failure to:
1.) Failure to Plan, prepare and pack meals ahead using the assigned tracking app as required by the program/package you purchased.
2.) Failure to Follow any program curriculum recommendations for fitness, reading educational literature, or abiding by check-in/responsibility schedules is grounds for immediate termination with refund from any program.
3.) Failure to Check-in or communicate with Heather Wright in the amount of 2 consecutive offenses or for a maximum of 14 consecutive days while in a coaching program will result in an automatic termination of the professional relationship, no refund will be issued, and no extension of benefits will be granted. Special consideration will be given to sudden injury, illness, death or other serious life event that prevents you from communicating in a timely fashion.
NOTICE OF CLIENT INITIATED TERMINATION
If at any time the client wishes to terminate the program or relationship, a notice must be provided to Heather Wright immediately via written e-mail. Pro-rated Refunds for Coaching Packages will be evaluated on a case-by-case basis and only be issued if termination is requested within the first 14-days days of beginning a Coaching program. At that time, a pro-rated refund may be available at the professional's discretion for the remaining unused services, if any still remain, provided that the client has not violated any of the expectations set forth in this agreement, but is not a guarantee.
Missed Appointments/No Show/Late Cancel
There will be an $50 charge for any client who misses a scheduled text appointment, scheduled phone call, consultation, video chat, etc. OR cancels less than 2 hours prior to their scheduled appointment. You purchase my time so that nobody else may reserve it and I provide my undivided attention to you. Accountability and respect is crucial in a relationship; professional or personal.
Social Media Sharing
Professional may share a screenshot or snippet of a client's progress (via text, email, photo, video etc) for marketing purposes. Professional may also share any progress photos to demonstrate comparisons and efficacy of programs for marketing or educational purposes. All client demographics, personal information and identification (faces, names, social media handles etc) will be EXCLUDED from these posts or advertisements in an effort to protect client confidentiality. Social media tagging is permitted with client consent only. Your privacy is Heather's number one priority, but sharing progress for educational purposes is a mission, so with your help and approval this is possible.
Professional Agreement
All clients must sign this Professional Agreement prior to any payments being received or the start of any program.
Payments
Payments must be received in full prior to receiving plans, recommendations, consultations, advice or engaging in programs or services offered by Heather Wright/Fitmind Wellnesss Solutions LLC unless otherwise approved and arranged. Venmo, Cash, Zelle, or Paypal is accepted.
E-Book, Ready to Go Plans & Self Study Plan Purchases
All E-book & Plan Purchases are non-refundable. Payment is required when placing the order. Instructions for placing the order are provided via the website. Venmo, Cash, Zelle or Paypal is accepted.
Mobile RMR Analysis Services
All clients who participate in the Mobile RMR Analysis Services must agree to and understand the following sections:
RMR Reservation Deposit
50% of your service fee must be paid in advance at the time of reservation via Venmo, Paypal, Zelle etc. Usernames will be provided at the time of quote or reservation by the Professional. Your deposit must be received a minimum of 24 hours prior to your scheduled appointment otherwise your reservation will be canceled.
RMR Reservation Travel Charges
Any travel greater than 15 miles outside of the 33064 zip code in any direction is subject to a $25 travel charge at the discretion of the Professional.
RMR Reservation Cancellation
All reservation cancellations must be received and confirmed 24 hours prior to their originally scheduled date and time. In the event the client cancels less than 24 hours prior, the reservation deposit will be kept and not eligible for refund to the client nor can this be used or applied to the balance for future re-scheduled services.
Special consideration for emergency circumstances will be reviewed on a case-by-case basis and may be refunded at the discretion of Heather Wright.
RMR Preparedness
All Clients are responsible for arriving properly prepared for the RMR Analysis services to include adhering to fasting requirements and testing environment as provided by the Professional. In the event that the client is not properly prepared for their RMR Analysis upon Professional's arrival OR within the 8-hour required minimum window, the Client's deposit will be kept and not refunded.
Client needs to notify Professional immediately if RMR Analysis preparation instructions have not been met or voided by consumption or exercise of a prohibited item.
RMR Nutrition Plan Upgrades
RMR Analysis services include a brief review of the test results with the client. The RMR service price does NOT include a nutritional recommendation, consultation, plan or advice unless otherwise advertised. Nutritional recommendations, consultation, Plans and advice are considered upgrades and these upgrades are available for purchase separately. These upgrades are non-refundable. All nutrition plans or written recommendations will be provided to the client via e-mail within 3 business days post RMR testing session.
RMR Result Delivery
All RMR Results will be provided via e-mail to the client within 24 hours of the end of the testing session.
Clients who wish to receive a printed copy of their RMR Results on the day of the test must provide access to a wireless printer.
Clients who select a Nutrition Plan Upgrade will receive their plans via e-mail within 3 business days post RMR testing session.
RMR Professional and Client Conduct
Heather Wright(Professional) will enter your home, office or business as contracted by you, the Client, for the sole purpose of conducting RMR Analysis Services only.
Any nutrition recommendations provided to the client by Heather Wright is NOT a diagnosis, treatment or cure for any health or medical condition. The Client is responsible for their own health and consulting with their medical professional prior to making any changes to their current lifestyle.
The Client will participate in the RMR Analysis services at their own risk.
The Client agrees to provide a professional, safe and clean environment to host the RMR Analysis services to ensure the safety of the Professional (Heather Wright) and the client.
Any intent or attempt to bring injury or harm to the other by either Professional or Client is subject to prosecution.
Any intent or attempt by the Client to vandalize the equipment owned and provided by the Professional is subject to prosecution and financial responsibility to repair or replace damaged property.
