By signing this contract, the artist agrees to the following:
- A complete listing of the works being exhibited including title, medium, and value, will be provided by the artist for reference and for insurance purposes. A copy of this listing will be provided to the WAC.
- Works of art may be offered for purchase and the price may be set by the artist.
- The commission split is 30/70 for art sales from the gallery or gift shop. The artist receives the greater of the two. The commission split is 25/75 art sales for “Artist in Residence."
- Work will be delivered to the Exhibiting Space or the Watauga Arts Council Offices in a timely manner at a mutually agreed-upon date and time.
- WAC reserves the right to reject any artwork if it does not fit the curatorial goals once we have it in our possession. We may also reject work based on damage or if it is not ready to hang/showcase.
- The WAC will facilitate hanging the work unless otherwise arranged.
- The Artist will pick up their artwork promptly after an exhibit. Any artwork that is not picked up within 30 days of an exhibit will be considered a donation to WAC, and a donation receipt will be given to the artist. If other arrangements for pick-up are needed, final agreement must be in writing and agreed upon by both parties.
- WAC will issue Artist Payments within 30 days of the exhibitions close.
- If artwork sells due to our exhibit within a month after a show, we ask that a donation of 15% be made to the Arts Council.
- The Watauga County Arts Council will take all possible precautions to ensure the safety of the works exhibited in this program, including limited insurance coverage for fire and theft and damages incurred during transport, but cannot be responsible for other occurrences.
- The Arts Council insures the work, but if there is damage or theft, there is a $1,000 deductible for each occurrence paid in part by the artist. WAC will cover up to $500 of the damages or deductible. It is suggested that artists procure separate insurance to help cover the deductible cost.
- Should there be damage, loss, or theft of a piece of art, the artist should be prepared to present proof of the market value of the work established through documentation of sales of comparable elements, previous gallery contracts establishing value, or the professional opinion of an appraiser. If in the judgment of WAC, the stated value of a work submitted to the program is questionable, documentation of value may be required in advance.
- I permit WAC to use photos I provide for the promotion of this exhibit or in grant reports, if applicable.
