I ACCEPT the ACCIDENTAL DAMAGE WAIVER (ADW) for $15 per ATV per day - The ADW Damage Waiver is NOT insurance. It provides you limited protection against your liability to Paradise Cart Rentals for physical damage of the rental equipment while in you care. If a Damage Waiver is purchased and you damage the rental unit, you would ONLY be legally responsible for any and all damages up to the full amount of the damage deposit paid to repair the rental unit - instead of the entire out of pocket costs If you purchase ADW, we will waive our right to collect from you for damage to the Vehicle over the amount of the security deposit. ADW does not cover all instances of damage to the Vehicle (Including theft, tire damage,vandalism or loss)-see Paragraph 5 on the reverse side of this Agreement. ADW is optional and may be declined.
I DECLINE ACCIDENTAL DAMAGE WAIVER: If the ADW is NOT purchased, you will be legally responsible for the full amount of damage up to the full replacement of the equipment, plus any loss of rental income and can include additional recovery fees and loss of equipment.
I understand Paradise Cart Rentals provides NO MEDICAL INSURANCE coverage and NO LIABILTY INSURANCE. We provide no coverage for tire damage of any type.
I understand and agree that protective riding gear must be worn at all times, while using or operating the Vehicle. Protective riding gear is defined as the following: helmet, eye protection, sash or equivalent. Provided by Paradise Moto Rentals.
I agree to immediately notify Paradise Cart Rentals if I feel any aspect of the Moto to be unsafe. I will operate the Vehicle with reasonable precaution for the safety of myself, others, the equipment and the environment and will at all times comply with Costa Rican law.
Paradise Cart Rentals reserves the right to terminate any rental agreement at any time without notice or refund if Paradise Cart Rentals feels the motorcycle is operated against the terms of the agreement in a manner that is unsafe to renter, the Moto or others.
I understand that ATVs are considered adventurous and can pose a certain risk to my health/or safety. All such risks are hereby assumed by myself and I release Paradise Cart Rentals from all claims and causes of action that may arise after damages or personal injuries or even death as a result of participating in these rentals. Carrying a passenger on the rear seat of rack can interfere with center of gravity, balance and operation, so it is not recommended.
I understand I will be charged for the amount of fuel used and if not returned full there will be a $5.00 refueling fee.
