CREDIT REVIEW AUTHORIZATION
The Applicant authorizes Select Pool Products to obtain credit information about the Applicant from trade references, financial institutions, credit reporting agencies, and other lawful sources for the purpose of evaluating and monitoring creditworthiness. This authorization continues for the life of the account.
PAYMENT TERMS & DEFAULT
Invoices are sent when order ships via email only and are due per approved terms. Past due amounts may result in credit hold, COD terms, or account closure.
Overdue balances may accrue interest at the lesser of 2% per month or the maximum allowed by law, calculated monthly.
Applicant agrees to pay all reasonable collection costs, including agency fees, legal fees, and court costs where permitted.
DISPUTES / SHORTAGES / RETURNS
Claims for shortages/damages must be reported within [3] days of receipt of order.
Invoice disputes must be submitted in writing within [3] days of invoice date.
Returns require prior written authorization from Select Pool Products and will be subject to restocking fees and return conditions.
CREDIT LIMIT / SECURITY
Credit limits are assigned at Select Pool Products discretion and may be changed or withdrawn at any time.
Security Interest: Applicant grants Select Pool Products a continuing security interest in goods supplied and proceeds thereof until all amounts owed are paid in full, where permitted by law.
GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of Province of Ontario, Canada, and the parties agree to the courts located in Province of Ontario, Canada for any dispute, unless prohibited by law.
PRIVACY
Applicant acknowledges that personal information may be collected, used, and disclosed as necessary to evaluate credit, administer the account, and collect amounts owing, in accordance with applicable privacy laws and Select Pool Products privacy policy.
