A] The designer is not responsible if you, the client/builder make changes to selections and/or orders without notification to the designer.
[B] Designer’s purpose is to SPECIFY, gather product data and transmit information to appropriate parties when necessary. Once information is transmitted it is the responsibility of the merchant to order, ship, and receive and/or inform us on the proper method to receive. The designer[s] is not responsible for the work performed and/or quality of work by craftsmen, manufacturers, and/or merchants.
[C] Retainer fee of $5,000 for the Four PHASE Residential New Construction, or Interior Architecture Design Services. Client will receive a statement, reflecting hours used every two weeks, or every month [depending on the magnitude and time allocated for the project]. The Retainer fee is Non Refundable, it provides the client with 22 hours of Construction Consulting. Once you exceed the 22 hours, you can select the bundle deal [for six hours at a time]. Hourly, isn't an option, because it is always more than an hour.
[D] The Contractual agreement may be terminated by either party upon seven (7) days written notice. In the event of termination by you, you shall pay the designer for all services performed and reimbursable expenses due up to the date of termination.
[F] Any Controversy or claims arising from/or relating to this project or breach thereof, shall be subject to review and settled by arbitration. The arbitration shall be in accordance with the rules of the American Arbitration Association. The decisions of the arbitrator shall be final and binding on both parties.
[G] The designer or representatives of the designer reserves the right to photograph the project upon completion.
[H] The Design Firm is not responsible Builder/Contractors work or schedule. The Design Firm is not responsible for pick up, delivery or install. Install includes assembly, hanging, etc., ACDD will provide client with the furniture placement plan [if applicable] to follow. However, client must purchase items and schedule delivery services for pick up and delivery. All art will need to be hung by a HANGING service company, for best results.
[I] Designer keeps a design-time log for services and will keep the client informed, in regards to billable hours, if applicable. The Retainer fee is good until we reach 22 hours, or 6 month[s], it isn't a fee that can be rolled over for years or thru delays.
[J] Purchasing or Procurement: A designer will not place orders nor procure goods on behalf of a client until the receipt of a deposit. In most cases, vendors require full payments when an order is placed so the client is expected to pay in full for such goods.
[K] Merchandise REFUNDS: Once furniture or furnishing items have been purchased from vendors, most items bought cannot be returned, if customized. However, if not and it's a stock item and the manufacturer has a return policy it can be returned a return fee may apply.
[L] Cancellations: Just as it is with returns, cancellations of orders placed after the signing of the contract cannot be affected. And when a client wishes to cancel an already agreed-upon order, he or she will be responsible for payment requests to cover cancellation costs which may be billed hourly, depending on the interior designer.
In some instances, requests to cancel will be assessed on a per-item basis with no guarantees of cancellation. These are one of the reasons why ‘cuttings for approval’ (CFA) are important.
[M] Reimbursable Expenses - client agrees to reimburse the Designer for ANY out-of-pocket expenses, incurred by ACDD Consultant[s], in relation to the client[s] interior design project. This may include things like delivery, freight and/or postage, hanging art, assembly of furniture, drafting, or renderings services, freight and/or postage charges, and delivery and/or storage costs.
Travel [that exceeds a 60-mile radius] regardless if it’s in, or on, an airplane, automobile, train, boat, etc…, Travel and Lodging will be booked by ACDD, but paid for by the client, PRIOR to travel. ACDD recommends establishing a Design Card and Travel/Uber and Meal credit or debit card. This allows all expenses for the client[s] project to be tracked and available for end-of-the-year taxes without waiting on ACDD to provide you with documentation.
NOTE: ACDD does not co-mingle funds, nor allow clients to utilize their tax ID or discounts.
NOTE: Drawings are only conceptual and serve as a design concept or guideline to follow. The drawings ACDD creates are not and will not be used to Build from nor will they serve as "Construction Drawings" or proposed concept, used to provide as a form of communication to the builder/contractor/homeowner; and not to be used for other purposes. If the client desires detail drawing[s], floor plan[s], or construction drawing[s] that will be outsourced or provided by a or the Architect, or draft/drawing person from a particular design showroom, i.e., kitchen/bath/media, etc.
TERMS OF COMPENSATION
A designer will not place start work or place, procure or secure product or finishes on behalf of the client until the receipt retainer or design payment has been received. In most cases, vendors require full payments when an order is placed so the client is expected to pay in full for such goods.
Retainer fee or payment of services is required in order to activate services.
