“Activities” means any use of the Facilities in any way whatsoever.
“Facility, Facilities” means all equipment used while participating in the Activities.
“I” means personally or by his/her parent or guardian.
“DYNAMIC” means their officers, teachers, assistants and committee members.
1. Participation in class
To the fullest extent permitted by law, DYNAMIC disclaim all liability for any injury, loss or damage that you/your child may suffer while participating in the Activities including, but not limited to, personal injury and loss of or damage to your/your child’s personal property. I release DYNAMIC from liability for, and indemnify them against, all claims and costs (including legal costs on a full indemnity basis), suffered or incurred by me or caused by my act or omission arising out of, or in connection with, my participation in the Activities including, but not limited to:
1.1 claims for personal injury sustained by me/my child while participating in the Activities;
1.2 claims for personal injury to, or death of, others (including claims for compensation by their estate, dependants, heirs and successors) as a result of my/my child’s act or omission while participating in the Activities;
1.3 claims for compensation my estate, dependants, heirs and successors may have in the event of my/my child’s death during the Activities;
1.4 loss or damage to, or theft of, any property owned by me/my child, or in my/my child’s possession, during the Activities;
1.5 loss or damage to the Facilities and any property of the owner and/or operator of the Facilities;
1.6 loss or damage to the property of other participants, observers and any other person while participating in the Activities;
1.7 loss or damage arising from my/my child’s failure to obey instructions from DYNAMIC during the Activities;
1.8 loss or damage arising from any pre-existing medical or psychological condition; and
1.9 loss or damage arising from any negligent act or omission of DYNAMIC during the Activities.
2. Health and Safety
I acknowledge that there may be dangers to me or my child’s personal safety while participating in the Activities and that the Activities may include:
2.1 Physical exertion.
2.2 Excessive Stretching.
3. Medical / health conditions
I accept all the inherent risks of the proposed Activities.
3.1 I warrant that I have supplied to DYNAMIC all relevant information regarding my health/my child’s health and any medical conditions that I/my child have to enable DYNAMIC to involve me/my child in these Activities.
4. Participation
In entering into this contract, I acknowledge that I have not relied on any oral, written or visual representations or statements by DYNAMIC or any other inducement or coercion to participate in the Activities, and do so of my own free will.
5. Privacy
5.1 DYNAMIC are committed to protecting your privacy. We use the information you provide to advise about and assist with your activities. We do not trade, rent or sell your information.
6. Photographic Policy:
6.1 I understand if I have selected ‘Yes’ in the registration form, I give permission for any photographic material taken at class, competitions or club activities by officials or committee members to be used for advertising purposes and/or newsletters.
6.2 if I decide at a later date that I no longer wish to give permission for photographic consent, I will send in an email to the club email stating this information.
7. Fees
7.1 I agree that all fees are to be paid on time.
7.2 I understand that other fees may be applicable throughout the year and these must be paid.
7.3 I understand DYNAMIC will issue an account via email to each member prior to the beginning of each term for the term fees payable.
7.4 I understand that if the term fee account is not paid by the due date (shown on the account):
7.4.1 I will be unable to attend any further classes until paid.
7.4.2 I will be unable to compete in further inter-club, champion girl or team competitions.
8. Volunteer
8.1 I agree to give voluntary services to DYNAMIC when required for the following but not limited to:
8.1.1 Canteen/BBQ/Door/Setup/Clean up at DYNAMIC’S Interclub and end of year showcase.
9. Competition
9.1 I agree to represent DYNAMIC in uniform at all competitions.
9.2 I will uphold a good reputation and represent our club with pride.
9.3 I agree to follow the APDA Ltd rules at all competitions.
10. Member information
I hereby certify that the information given to DYNAMIC upon registration is true and correct. I understand the DYNAMIC Committee might decide to suspend or terminate my registration and membership at any time without a refund if:
10.1 Information given to DYNAMIC upon registration is not true and correct.
10.2 I do not pay fees by due date.
10.3 I do not act in the best interests of DYNAMIC and APDA Ltd, and cause conflicts or issues.
10.4 I do not uphold a good reputation of DYNAMIC at APDA Ltd competitions and DYNAMIC events at all times.
10.5 I do not abide by APDA Ltd and Dynamic code of conducts.
11. Agreement
I confirm that I have read, understand and agree to this contract and shall be governed in all respects by and interpreted in accordance with the law in force in the state of New South Wales.
