Article I - MEMBERSHIP
Section 1. Titleholder. All Titleholders who reside in the Kentlands and immediate family members who reside in the unit as a primary residence.
Section 2. Transfer to Tenant. The Lessees of record on a valid lease where Titleholders have assigned their use privileges for the Kentlands Recreation Facilities to their Lessees.
Article II - DELINQUENT ACCOUNTS
Section 1. Delinquent Accounts. The Board of Trustees may suspend use privileges for the Clubhouse to any Titleholder, Lessee of a Titleholder or other resident or non-resident person who pays the Annual Local Assessment for the Clubhouse and who is more than sixty (60) days delinquent in the payment of any assessment or other fee to the Assembly or who has an outstanding violation of the Assembly’s founding Documents or any policies, rules, and regulations promulgated by the Board of Trustees.
Article III - TERMINATION/SUSPENSION OF MEMBERSHIP
Section 1. Voluntary Resignation. In the event the Property Owner Member sells their property or Tenant Member moves out of the owner's property, they resign their membership. In this case, all outstanding charges must be paid in full upon termination.
Section 2. Involuntary Suspension. Kentlands Recreation Facilities use may be suspended or revoked, after due process, due to failure to comply with any of the rules and regulations adopted by the Board of Trustees or for conduct the Board of Trustees and/or Managing Agent determines to be improper or contrary to the best interest of the Clubhouse and its members. The suspension period shall be determined by the Board of Trustees.
Article IV - WAIVER OF LIABILITY
Section 1. Waiver and Release of Claims. All Titleholders, Lessees of a Titleholder, or guests of Titleholders/Lessees of Kentlands who utilize the Kentlands Recreation Facilities are required to sign the Kentlands Waiver and Release of Liability.
Article V - RULES AND REGULATIONS
Section 1. Registration. Members must check in and present their facilities pass each time they enter the Clubhouse. Access may be denied if a facilities pass is not presented.
Section 2. Guests. A guest is defined as a non-member who is invited by the member. Guests may use the Clubhouse facilities when accompanied by a member and must sign in at the reception desk. Members are responsible for the appropriateness of attire and conduct of their guest(s). The number of guests that an eligible household can bring to the Kentlands Recreation pools during any day shall be limited to five (5) guests, regardless of age; limited to three (3) guests on the tennis and pickleball courts and four (4) guests on the basketball court.
Section 3. Attire and Equipment. Proper attire is required for participants using the Clubhouse, tennis courts, pickleball courts, basketball court, and tot lots. Shoes and shirts are required in all public and recreation areas. Appropriate footwear must be worn on basketball, pickleball, and tennis courts. Non-potty-trained children must wear a swim diaper. Athletic attire is not permitted to be left in the Clubhouse overnight.
Section 4. Damages. The cost to repair damage to the Kentlands Recreation Facilities property caused by a member or a member’s guest shall be paid by the member.
Section 5. Rule Not Inclusive. The rules contained herein are not inclusive. Amendments to the Clubhouse rules and regulations may be made from time to time as necessary. On all questions regarding the construction of rules and regulations, the decision of the Board of Trustees will be final.
Section 6. Dependents/Children. No person under the age of twelve (12) shall be eligible to enter the Clubhouse building or to use the swimming pools unless accompanied by a resident age sixteen (16) or greater.
No person under the age of twelve (12) may enter or use the Fitness Center unless accompanied by a resident aged sixteen (16) or greater. The use of fitness equipment shall be used in accordance with the manufacturer’s guidelines and recommended restrictions.
No person under the age of ten (10) shall be eligible to use the other amenities besides the pool and Fitness Center unless accompanied by a resident age sixteen (16) or greater.
Article VI - MEDICAL EXAMINATION
Section 1. All Members are strongly encouraged to have a complete physical examination by a medical doctor prior to beginning any new program of strenuous activity. If a resident has a history of heart disease, it is recommended they should consult a physician before using the Recreation Facilities.
