  • ASAP is our After School Arts Program offered here at The Artz that features pick-up straight from school in one of our Artz vans and transported to our Studio. Activities currently include Aerial and Art classes. We pick up from most public and private schools within a 5-mile radius of our studio and some surrounding schools. Please email us at info@theartz8.com to check if your child's school is within our route. We follow Houston ISD’s school schedule and we pick up every day that HISD is in session. After arrival at our studio, we offer a snack, private dressing rooms to change clothes and use restrooms before picking a class of their choice, followed by free time.

     

    Before registering, please understand that we are not a daycare and we are not just transportation. In our program we expect students to participate in the whole activity so that all students learn and enjoy their experience.

  • AFTER SCHOOL AERIAL PROGRAM (ASAP) POLICIES

    Please check after each section to verify that you read and understand our policies.
  • BOOKING
    When your student is enrolled, they are booked according to the pass purchased and which days of the week they are attending. These set days are chosen upon enrollment and cannot be changed week to week. If you need to cancel or make changes to your permanent schedule, we require advanced notice via email at info@theartz8.com to avoid unwanted charges. ASAP enrollment requires a semester-long commitment. Students with semester passes have first priority on the spots available. ASAP follows the HISD student calendar and picks up every day HISD is in sessions. If your student attends a private school that does not follow HISD schedule and has school on an HISD-recognized holiday, other arrangements may need to be made for your student as The Artz does not pick up on these holiday closures. Here is a link to HISD’s academic calendar for this school year with the closure dates. HISD CALENDAR  Spring semester runs January through May/June and has approximately 20 weeks. The fall semester runs from August through December and has approximately 18 weeks. Please note that there will be no after school program on the following dates: September 1-2 ; October 2-3; November 7, 24-28; December 22 -31; January 1-5 , 19; February 13, 16; March 9-13, 30; April 3, and May 25.
             

  • BILLING
    Billing happens automatically on the 1st of each month to a card you keep on file. If you begin in the middle of a month, drop-in fees will be due at that time. Your monthly billing will begin the following month and will be billed on the first of each month thereafter. Payment is always required to secure your student’s spot in the van and in class. Your monthly auto-renewal enrollment guarantees your student’s reserved spot. If you need to change or cancel your card please notify us right away to avoid declined payments or late fees.

    A registration fee is billed once a year at the beginning of each school year or at the time of enrollment. This $150 yearly fee is due at time of enrollment.

    There is a $20 late fee if payment is not received by the 3rd of the month. Additional fees that apply will also be billed automatically to your student’s account as necessary and cannot be refunded. While payments are billed monthly each enrollment is a semester-long commitment. Because our monthly tuition prices are based on 4-week months (48 weeks per year), holidays and school breaks are not pro-rated. This includes 2 weeks for Winter break, 1 week for Thanksgiving break, and 1 week for Spring break. As well as individual days that may vary each school year. The standard monthly rates for these months with holiday breaks will not change and we do not offer additional prorates, refunds, or make-ups for these closures. All program cancellations or changes to billing must be emailed to us at info@theartz8.com and require a 30-day written notice in order for changes to take effect by the 1st of the next month.
             

  • PARENT PICK-UP
    A parent or an authorized pick-up can arrive any time between 4:00 - 5:30 pm. While it is most beneficial to pick up after class ends, you can pick up your student at any time. Students must be picked by 5:30 pm unless you've purchased extended care prior to late pick-up. Please note pick-up days are set days every week and must be registered in advance. We require a notice of change at least 2 weeks prior, otherwise, a drop-in pass will be required for your student to be picked up.
             

  • DROP-IN PASSES
    Drop-in passes are available to purchase for additional days during the week for unpredictable or changing schedules. These passes are offered at $47 per day for active ASAP Pass Holders. Drop-in passes are the best option for families with changing or irregular schedules. Because ASAP passes require a semester-long commitment, drop-ins should be used for those students that cannot commit to the entire semester. This one time drop-in can be used all throughout the week but expires one month after the date of purchase and requires at least 24 hours notice of booking via email at info@theartz8.com to guarantee an open spot for your student on that day.
             

  • EXTENDED CARE
    Extended Care is an option for your student to further utilize our studio and receive additional free time on the apparatuses after ASAP classes have ended. Extended care runs from 5:30pm until 6:00pm. The rate for extended care is $5 per day, per student, or $20 per student for the entire week. When selecting days, The Artz must be noticed via email at info@theartz8.com prior to starting and is billed on a monthly basis. Standard late fees apply for late parent pick-ups after 6:00 pm.
             

  • 30-DAY CANCELLATION NOTICE
    We require a signed 30-day Cancellation Notice to cancel your enrollment. A student is considered enrolled and the account holder is billed monthly until we receive this notice. Billing and enrollment will cease 30 days from when the notice is received. We consider your student enrolled until we receive a signed 30-day Cancellation Notice and will continue to bill your account accordingly. Tuition will be pro-rated based on your billing date and the date the notice is received. Verbal cancellations will not be accepted. ABSOLUTELY NO MONETARY REFUNDS WILL BE ISSUED for used or unused ASAP DAYS. If notice is given less than 30 days prior to cancellation, the customer is responsible for the full upcoming monthly tuition.
             

  • NO SHOW FEES                                                              
    No show fees are billed automatically if your student is not at school on their scheduled pick-up day and we do not receive notice. This $20 fee will be billed for each day we are not notified of absence and our van shows up to your student’s school when the student is not present. Fees are nonrefundable. Please notify The Artz as soon as possible if your student will not be at their school for pick up to avoid this confusion.
             

  • LATE FEES
    Late fees will be automatically billed to the card on file after check out when a student is picked up after 5:35pm and has not purchased extended care. A $10 charge will be applied for every 15 minutes that student is not picked up after 5:35pm (6:00pm for extended care). Fees are nonrefundable. After 6:00pm without pick up or contact, our office will begin contacting your students' emergency contacts on file.
             

  • DISCOUNTS
    Discounts are offered for multiple students living in the same family household. We offer $10 off the second and third student's monthly passes each month of enrollment. We also offer discounts on ACE Camp if HISD is out of school for holidays or in-service days, active ASAP students will receive $20 off each full day or $10 off each half day of our ACE Camps hosted that same day HISD is out of school.
             

  • STUDENT ABSENCES 
    Absences from your students' school pick-up days require notice via email at info@theartz8.com at least 2 hours before your student’s scheduled pick-up time. Failure to notify The Artz or having no-shows at school pick-up will result in a no-show fee billed to your account. Since your monthly pass reserves your student’s spot in our program each day, we do not offer make-ups or transfers for any missed days, student absences, holidays, studio closures, or HISD school closures.

    The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
    The Artistic Realm of Talentz (The Artz) has put in place preventative measures to reduce the spread of COVID-19; however, The Artz cannot guarantee that you, your child(ren), or the participating parties will not become infected with COVID-19. Further, attending The Artz could increase your risk, your child(ren)’s risk or the participating parties risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren), the participating party and I may be exposed to or infected by COVID-19 by attending The Artz and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at The Artz may result from the actions, omissions, or negligence of myself and others, including, but not limited to, The Artz employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren), the participating parties or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, the participating party or my child(ren) may experience or incur in connection with my child(ren)’s attendance at The Artz or participation in our programming (“Claims”). On my behalf, on behalf of the participating parties and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless The Artz, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of The Artz, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any program.

  • WAIVER, TERMS, AND CONDITIONS


    This Assumption of Risk, Waiver of Liability, and Indemnification Agreement (Agreement) is entered into on the date this Agreement is executed by the Adult Participant as identified by typed name/signature below, and if any minor(s) is/are named below, the Adult Participant on behalf of and as parent or legal guardian for such Child Participant(s) as identified below in favor of Cre8ting Your Imagination, LLC (The Artz). Collectively and severally, the Adult participant(s) and Child participant(s), their heirs, successors, and assigns are hereinafter referred to as the Participant. In consideration of The Artz permitting Participant to enter the Premises and participate in the Activities, as defined below, including any of those Activities that may occur in, about, or near 1824 Spring Street, Suite 124, Houston, TX 77007 (Premises) or any other premises owned or operated by The Artz wherever located, Participant agrees as follows:
    Nature of the Activities. The Artz is aerial arts facility, which offers Participants the opportunity to participate actively or passively, in aerial activities focusing on a circus vision, including, but not limited to, jumping, dodgeball, tumbling, aerobics, ninja warrior course, soft play, ropes, fabric, lyra, trapeze, Chinese pole, hammock, straps, aerial net, wall running, diablo, juggling, stilts, slackline, hula hoops, triple trapeze, aerial cube, aerial rings, rope bridge, climbing wall, swinging, contortion, exercising and other miscellaneous aerial and circus activities, use of any equipment or attractions, instruction, training, classes, observation, use of the backroom area, use of the lobby area, use of any portion of the Premises, including, but not limited to, the associated sidewalks, hallways and parking lots, and any competition, event, or program sponsored by or affiliated with the Protected Parties as defined below in Section 5 of this Agreement, (collectively, “Activities”). These activities can help produce many benefits, including pleasure, improved physical fitness, more attractive appearance, more energy, greater enjoyment of life, and many health benefits. Participants acknowledge that aerial and circus activities are active and vigorous and consequently, involve some risks of injury that are inherent to the activity. Even though The Artz (a) has designed the facility with safety in mind, (b) provides instruction in most Activities, (c) provides general supervision of most Activities, and (d) has developed rules and policies that focus on safety, it is impossible to eliminate all risk and possibility of injury.
    Types of Risks. By signing below, Participant acknowledges there are inherent risks in participating in the Activities, including, but not limited to, cuts, bruises, muscle strain, twisted or sprained ankles, knees, shoulders, or wrists, burns, dirt or other materials in eye, concussions, broken bones, physical or emotional injuries, paralysis, death, disability or other injury or damage to Participant, property or to third persons. Inherent risks involved in participation in the Activities include landing wrong, over-exertion, failure of the apparatus or attachments, being hit by a ball, rope, bar, hoop, or other apparatus, collisions with other participants, collisions with standards and supports; tumbling, using improper form or technique; over-exertion, muscle strains, erratic co-participant behavior, slipping, falling, tripping, equipment failure, and error of judgment by staff members. Due to the nature of the Activities, there are more hazards and risks than the foregoing risks, and there are also unknown and unforeseeable hazards. By signing below, Participant(s) acknowledges the inherent risks of the Activities and no amount of care, caution, instruction or expertise can eliminate the inherent dangers associated with the Activities.
    Types of Injuries. It is important that the Participants understand the types of injuries that can typically occur when participating in the Activities. First is a common minor injury. This type includes, but is not limited to, muscle strains and sprains, bruises, abrasions, and contusions. The second type of injury is a serious injury. Examples of serious injuries are broken bones, ligament, and joint injuries, concussions, and eye injuries. These are rare but do occasionally occur. The third type of injury is a catastrophic injury. Some examples of catastrophic injuries are brain injury, paralysis, heart attack, and death. Participant on his/her own behalf and as the parent or legal guardian of the Child Participant(s), acknowledges that he/she is aware of and voluntarily assumes all such risks.
    Assumption of Risks.
    Participant acknowledges on his/her own behalf and the Child Participant(s) that Participant(s) has read this Agreement in its entirety, acknowledges the Activities contain inherent risks, which vary with the activity, understands the demands of the Activities relative to Participant’s physical condition and skill level, appreciates the types of injuries that may occur as a result of the Activities and their potential impact on Participant’s safety, well-being, and lifestyle, and asserts that participation is voluntary. PARTICIPANT AFFIRMS AND REPRESENTS THAT PARTICIPATION IN THE ACTIVITIES IS VOLUNTARY AND ALL PARTICIPANTS KNOWINGLY, WITH UNDERSTANDING OF THE INHERENT RISKS AND POTENTIAL INJURIES ASSUME ALL RISKS INHERENT WITH THE ACTIVITIES. BY SIGNING BELOW, PARTICIPANT ACKNOWLEDGES THAT THE PROTECTED PARTIES (AS DEFINED BELOW) WILL NOT HAVE ANY RESPONSIBILITY FOR ANY INJURY TO PARTICIPANT OR PAY FOR ANY COST OR EXPENSES INCURRED BY PARTICIPANT IF PARTICIPANT IS INJURED.
    Participant(s) agrees to exercise ordinary and reasonable care and to not consume alcohol to the extent Participant’s judgment is impaired. Participant(s) understands the potential risks associated with the consumption of alcohol and acknowledges Participant does not have and is not aware of any medical condition that would result in any injury or damage to Participant(s) because of Participant(s) consumption of alcohol. Participant assumes the risks associated with alcohol consumption and takes full responsibility for Participant’s own actions, safety, and welfare. NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, ANY FEES PAID BY PARTICIPANT FOR ENTRY INTO THE PREMISES, OR ANY REPRESENTATIONS MADE BY ANY EMPLOYEES, IN ABSOLUTELY NO EVENT WILL PARTICIPANT BE ALLOWED TO PARTICIPATE IN ANY ACTIVITIES ONCE THE PARTICIPANT HAS CONSUMED ANY ALCOHOL. THIS PROHIBITION WILL NOT BE WAIVED.
    Release of Claims. In full appreciation of the foregoing risks, and in consideration for the right to use, access and enjoy the Premises and voluntarily participate in the Activities, TO THE FULLEST EXTENT PERMITTED BY LAW, PARTICIPANT (AND ON BEHALF OF ANY CHILD PARTICIPANT AND HIS/HER HEIRS, EXECUTORS AND REPRESENTATIVES) RELEASES AND AGREES NOT TO SUE THE ARTZ, CRE8TIVE INTERPRETATION, LLC, CRE8TING YOUR IMAGINATION, LLC., THE LEGAL OWNER OF THE PREMISES, THE ARTZ’S LANDLORD (“LANDLORD”), LANDLORD’S MORTGAGEES AND MANAGEMENT COMPANY OF THE PREMISES, AND ANY OF THEIR AFFILIATES OR SUBSIDIARIES, RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, MANAGERS, PARTNERS, AGENTS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, HEIRS, ASSIGNS, VOLUNTEERS, INDEPENDENT CONTRACTORS, EQUIPMENT PROVIDERS, AND INSURERS OF ALL OF THEM (COLLECTIVELY, THE “PROTECTED PARTIES”) FROM AND AGAINST ALL LIABILITIES, LOSSES, DAMAGES, CLAIMS, DEMANDS, ACTIONS, SUITS, CAUSES OF ACTION, COSTS, FEES, AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND COURT OR OTHER COSTS) RELATING TO, RESULTING FROM, OR ARISING OUT OF OR ALLEGED TO HAVE ARISEN OUT OF (IN WHOLE OR IN PART) ANY BODILY INJURY TO, DISABILITY, OR DEATH OF PARTICIPANT OR DAMAGE TO OR LOSS OF PARTICIPANT'S PROPERTY (A) THAT MAY ARISE IN CONNECTION WITH PARTICIPANT’S USE OF THE PREMISES AND/OR DURING OR RELATING TO PARTICIPANT'S PARTICIPATION, WHETHER ACTIVELY OR PASSIVELY, IN THE ACTIVITIES, INCLUDING, BUT NOT LIMITED TO, GENERAL JUMPING, DODGEBALL, TUMBLING, AEROBICS, NINJA WARRIOR COURSE, SOFT PLAY, ROPES, FABRIC, LYRA, TRAPEZE,CHINESE POLE, HAMMOCKS, STRAPS, AERIAL NET, WALLRUNNING, DIABLO, JUGGLING, STILTS, SLACKLING, HULA HOOPS, TRIPLE TRAPEZE, AERIAL CUBE, AERIAL RINGS, ROPE BRIDGE, CLIMBING WALL, SWINGING, CONTORTION, EXERCISING AND OTHER MISCELLANEOUS AERIAL AND CIRCUS ACTIVITIES, USE OF ANY EQUIPMENT OR ATTRACTIONS, INSTRUCTION, TRAINING, CLASSES, OBSERVATION, USE OF THE BACK ROOM AREA, USE OF ANY PORTION OF THE PREMISES, INCLUDING, BUT NOT LIMITED TO, THE ASSOCIATED SIDEWALKS, HALLWAYS, AND PARKING LOTS, AND ANY COMPETITION, EVENT, OR PROGRAM SPONSORED BY OR AFFILIATED WITH THE PROTECTED PARTIES, (B) OCCURRING IN OR ABOUT THE PREMISES WHERE ANY OF THE ACTIVITIES ARE TAKING PLACE, CONDUCTED, OR PERFORMED BY PARTICIPANT OR ANYONE ELSE, OR IN TRANSPORTATION TO AND FROM ANY OF THE ACTIVITIES, (C) RESULTING IN PERSONAL INJURY, INCLUDING MINOR INJURY, SERIOUS INJURY, OR CATASTROPHIC INJURY AS DESCRIBED ABOVE IN SECTION 3 OF THIS AGREEMENT ARISING FROM, GROWING OUT OF, OR CAUSED DIRECTLY OR INDIRECTLY BY THE NEGLIGENT OR GROSSLY NEGLIGENT ACTS OR OMISSIONS OR STRICT LIABILITY OF THE PROTECTED PARTIES, (D) RESULTING FROM DAMAGE TO, LOSS OF, OR THEFT OF PERSONAL PROPERTY OF PARTICIPANT REGARDLESS OF WHETHER DUE TO THE NEGLIGENCE, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT OF THE PROTECTED PARTIES, (E) RESULTING FROM THE CONSUMPTION OF ALCOHOL AT THE PREMISES BY PARTICIPANT OR ANY OTHER INVITEE OF THE ARTZ. THE RELEASE CONTAINED IN THIS PARAGRAPH, INCLUDING ALL SUBPARTS, SHALL APPLY EVEN IF ANY SUCH INJURY OR DAMAGE IS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR STRICT LIABILITY OF THE PROTECTED PARTIES OR PARTICIPANT.
    Indemnity. ADULT PARTICIPANT, ON BEHALF OF ADULT PARTICIPANT AND HIS/HER HEIRS, ASSIGNS, EXECUTORS AND REPRESENTATIVES AGREES TO INDEMNIFY, DEFEND, RELEASE, AND HOLD HARMLESS THE PROTECTED PARTIES FROM AND AGAINST ALL CLAIMS, CAUSES OF ACTION, SUITS, LOSSES, LIABILITIES, DAMAGES, FINES, PENALTIES, LIENS, JUDGMENTS, SETTLEMENTS, PROCEEDINGS, COSTS, FEES, AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND COURT OR OTHER COSTS) OF ANY NATURE WHATSOEVER FOR OR RELATING TO INJURY, DEATH AND/OR DISABILITY, BODILY INJURY OR PROPERTY DAMAGE IN ANY WAY RESULTING FROM, RELATING TO, OR CAUSED BY (WHETHER IN WHOLE OR IN PART) ANY OF THE FOLLOWING MATTERS (WHICH NECESSARILY INCLUDE ALL CLAIMS THAT DO OR MAY BELONG TO THE CHILD PARTICIPANT(S)): (A) PARTICIPANT'S ACTS, OMISSIONS OR PRESENCE ON OR ABOUT ANY PART OF THE PREMISES OR OTHER PREMISES WHERE ACTIVITIES ARE TAKING PLACE, CONDUCTED, OR PERFORMED BY PARTICIPANT OR ANYONE ELSE, (B) PARTICIPANT'S ACTIVE OR PASSIVE PARTICIPATION IN, OR OBSERVANCE OF, ANY OF THE ACTIVITIES; (C) ANY CLAIMS ARISING OUT OF THE NEGLIGENT, GROSSLY NEGLIGENT, OR WILLFUL ACTS OR OMISSIONS OF THE PROTECTED PARTIES, PARTICIPANT OR ANY GUEST OR INVITEE OF THE PROTECTED PARTIES, PARTICIPANT, OR ANY OTHER PERSON PARTICIPATING IN ACTIVITIES ON THE PREMISES (D) PARTICIPANT'S USE OF ANY FIXTURES, EQUIPMENT OR PERSONAL PROPERTY IN, ON OR ABOUT PREMISES OR OTHER PREMISES WHERE ACTIVITIES ARE TAKING PLACE, CONDUCTED, OR PERFORMED BY PARTICIPANT OR ANYONE ELSE, OR (E) PARTICIPANT’S CONSUMPTION OF ALCOHOL AT THE PREMISES. THE INDEMNITY CONTAINED IN THIS PARAGRAPH, INCLUDING ALL SUBPARTS, WILL APPLY EVEN IF ANY SUCH INJURY, LOSS, DISABILITY, DEATH, OR DAMAGE IS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR STRICT LIABILITY OF THE PROTECTED PARTIES OR PARTICIPANT, BUT WILL NOT APPLY TO THE EXTENT ANY SUCH INJURY OR DAMAGE IS CAUSED BY THE WILLFUL MISCONDUCT OF THE PROTECTED PARTIES.
    Dispute Resolution.
    Waiver Of Jury Trial. TO THE EXTENT PERMITTED BY LAW, ADULT PARTICIPANT ON BEHALF OF HIM/HERSELF AND THE CHILD PARTICIPANT AND THE ARTZ KNOWINGLY, WILLINGLY, AND VOLUNTARILY, WITH FULL AWARENESS OF THE LEGAL CONSEQUENCES, AFTER CONSULTING WITH COUNSEL (OR AFTER HAVING WAIVED THE OPPORTUNITY TO CONSULT WITH COUNSEL) AGREE TO WAIVE THEIR RIGHT TO A JURY TRIAL OF ANY DISPUTE AND TO RESOLVE ANY AND ALL DISPUTES THROUGH ARBITRATION. THE RIGHT TO A TRIAL BY JURY IS A RIGHT PARTIES WOULD OR MIGHT OTHERWISE HAVE HAD UNDER THE CONSTITUTIONS OF THE UNITED STATES OF AMERICA AND THE STATE IN WHICH THE PREMISES IS LOCATED.
    Acknowledgments by Participant. Participant acknowledges on behalf of him/herself and the Child Participant(s) that Participant would not be granted access to the Premises or the ability to participate in the Activities but for these acknowledgments:
    Child Participant(s) and Adult Participant possess a sufficient level of skill and physical fitness for safe participation in the Activities. The participant also agrees to attempt only activities that the Participant feels he/she is capable of performing safely. Further, the Participant agrees to stay in areas that will not place the Participant in undue danger.
    Neither Adult Participant nor the Child Participant(s) has any health problems that would not allow me to participate in the Activities.
    The Participant has received either medical clearance from his/her physician prior to participation in the Activities or has determined that such clearance is not necessary for his/her safe participation in the Activities.
    The Artz may (but shall not be obligated or required to) administer to Participant emergency aid, CPR, and use other medical procedures deemed necessary by The Artz.
    The Artz may (but shall not be obligated or required to) secure emergency medical care or transportation (i.e., EMS) when deemed necessary by The Artz and the Participant shall assume all costs of emergency medical care and transportation.
    It is the Participant’s duty to inform The Artz and cease participation in the Activities if the Participant should feel any unusual discomfort (e.g., faintness, shortness of breath, high anxiety, chest pains).
    The Artz may (but shall not be obligated or required to) terminate Participant’s participation when it determines Participant to be incapable of safely participating in the Activities.
    The participant agrees to obey all safety rules while participating in the Activities and alert the staff of any rules violations or dangerous behavior.
    Authority. As the parent or legal guardian of the Child Participant(s), the undersigned represents to the Protected Parties he/she has the legal capacity and authority to act for and on behalf of the Child Participant(s), and agrees to INDEMNIFY AND DEFEND THE PROTECTED PARTIES FROM AND AGAINST ALL CLAIMS OR LIABILITIES RESULTING FROM OR RELATING TO ANY INSUFFICIENCY OF THE UNDERSIGNED'S LEGAL CAPACITY OR AUTHORITY TO ACT FOR OR ON BEHALF OF THE CHILD PARTICIPANT(S).
    Misc. Terms. This Agreement constitutes the entire agreement between the Protected Parties and the Participant, supersedes all previous oral or written promises or agreements, and may only be modified in writing. Participant expressly agrees that this Agreement is intended to be as broad and inclusive as is permitted by the laws of the state in which the Premises is located and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Venue for any action brought hereunder or due to Participant’s use of the Premises or participation in the Activities and the shall lie in the County in which the Premises is located. The substantive laws of the state in which the Premises is located shall apply. By signing below, Participant authorizes The Artz to communicate with Participants via email with updates, news, advertisements, and offers. Wherever any words are used herein in the masculine or feminine gender, they shall be construed as though they were also used in another gender in all cases where they would so apply.
    Acknowledgment & Understanding. Participant represents to the Protected Parties that the Participant thoroughly understands this is a complete and final release and indemnity agreement, that Participant is voluntarily entering into this Agreement, and no representations, promises, or statements made by any of the Protected Parties has influenced Participant in signing this Agreement. Participant agrees that there are no oral agreements, representations, promises, or warranties that are not expressly set forth herein and that Participant is not relying on any statements or representations of the Protected Parties that are not expressly contained herein. Participant acknowledges that Participant has read this Agreement in its entirety, fully understands its terms, and understands that he is giving up substantial rights herein, including his/her right to sue. The Participant acknowledges that the Participant is signing this Agreement freely and voluntarily, and intends by the Participant’s signature, to completely and unconditionally release the Protected Parties from all liability due to ordinary negligence and the inherent risks of the Activities to the greatest extent permitted by the laws of the state in which the Premises is located.
    License. For good and valuable consideration the receipt of which is hereby acknowledged, Adult Participant on behalf of him/herself and the Child Participant irrevocably grants The Artz, Cre8tive Interpretation, LLC, Cre8ting Your Imagination, LLC, and affiliates, and Company's assigns, licensees and successors the right to use all or a portion of my image (including real and personal property owned by me) and name in all forms and media including composite or modified representations for all purposes, including advertising, trade or any commercial purpose throughout the world and in perpetuity. ADULT PARTICIPANT ON BEHALF OF HIM/HERSELF AND THE CHILD PARTICIPANT WAIVES THE RIGHT TO INSPECT OR APPROVE VERSIONS OF IMAGES USED FOR PUBLICATION OR THE WRITTEN COPY THAT MAY USED IN CONNECTION WITH THE IMAGES. ADULT PARTICIPANT ON BEHALF OF HIM/HERSELF AND THE CHILD PARTICIPANT RELEASE COMPANY AND COMPANY'S ASSIGNS, LICENSEES AND SUCCESSORS FROM ANY CLAIMS THAT MAY ARISE REGARDING THE USE OF MY STATEMENTS OR IMAGES INCLUDING ANY CLAIMS OF DEFAMATION, INVASION OF PRIVACY, OR INFRINGEMENT OF MORAL RIGHTS, RIGHTS OF PUBLICITY OR COPYRIGHT. The company is permitted, although not obligated, to include my name as a credit regarding the image. The company is not obligated to utilize any of the rights granted in this Agreement.
    Authority. IF I AM SIGNING THIS DOCUMENT ON BEHALF OF MY SPOUSE, CHILD, FAMILY MEMBER, FRIEND, MINOR CHILD, OR OTHER PERSON, I EXPRESSLY WARRANT AND REPRESENT TO THE ARTZ THAT I HAVE SUCH PERSON’S ACTUAL AND IMPLIED AUTHORITY TO EXECUTE THIS AGREEMENT ON THEIR BEHALF, INCLUDING, BUT NOT LIMITED TO, THE ARBITRATION CLAUSE, WAIVER AND RELEASE, INDEMNITY AGREEMENT, AND LICENSE. I ALSO UNDERSTAND THAT MY DIGITAL SIGNATURE WILL BE ACCEPTED AS MY ACTUAL SIGNATURE.
    I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS AGREEMENT. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AGREE TO BE BOUND BY ITS TERMS.
