I am knowingly and voluntarily visiting APT’s Premises and participating in one or more of the following: physical training, physical rehabilitation/recovery, exercise program, occupational therapy or physical therapy under the direction and supervision of a Professional/Company. I recognize that I shall not be granted access to the Premises for said purpose unless I am under the direct supervision of above Professional/Company while I engage in such activities. I understand the risks and liabilities associated with my participation, including the potential of serious physical injury or death, and assume all risks associated with such participation. In the event of liability arising from physical, psychological, or any other type of harm, I agree to indemnify, defend, hold harmless, release, and discharge APT, APT’s assignees, and all parties associated with APT from such liability. 

I understand and accept that there is an element of risk arising out of or related to the COVID virus, similar viruses, or other infectious diseases, and such risks include illness or death to myself and others with whom I come into contact. I am familiar with the CDC guidelines regarding virus protocols and will adhere to all such guidelines that are applicable to me or to my patronage of the Premises. I agree to self-screen before visiting the studio in accordance with the CDC guidelines and will follow all health and safety protocols that the studio may implement in connection with any other viruses or infectious diseases. I agree to forever indemnify, defend, hold harmless, release, and discharge APT of any claims made against APT in connection with any virus or infectious disease, resulting from my failure to adhere to CDC guidelines. I will not make or bring any claims against APT related to contracting or spreading any virus or infectious disease, even if caused by the negligence of APT, APT’s assignees, or otherwise, and I forever release and discharge APT from liability under such claims to the fullest extent permitted by law.

I grant permission to APT the right to photograph and record me in connection with any services that I receive on the Premises. I also grant APT, APT’s assignees, and successors permission to use my image, likeness, and all reproductions thereof and release these parties from any claims that may arise regarding the use of my image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. APT is permitted, although not obligated, to include my name as a credit in connection with the image. APT is not obligated to utilize the rights granted in this paragraph.

This Agreement expresses my complete understanding of the rights and obligations that exist between me and APT. I recognize that outside of this Client Liability Waiver, I am not in privity of contract with APT and shall have no claim for breach of contract for the actions of APT, or APT’s employees, assignees, or successors.

I am knowingly and voluntarily permitting Minor to visit APT’s Premises and participating in one or more of the following: physical training, physical rehabilitation/recovery, exercise program, occupational therapy or physical therapy under the direction and supervision of a Professional/Company. I am familiar with the CDC guidelines regarding virus protocols and will ensure that Minor adheres to all such guidelines to Minor or Minor’s patronage of the Premises. I ensure that Minor self-screen before visiting the studio in accordance with the CDC guidelines and will follow all health and safety protocols that the studio may implement in connection with any other viruses or infectious diseases. I agree to forever indemnify, defend, hold harmless, release, and discharge APT of any claims made against APT in connection with any virus or infectious disease, resulting from Minor's failure to adhere to CDC guidelines. I will not make or bring any claims against APT related to contracting or spreading any virus or infectious disease, even if caused by the negligence of APT, APT’s assignees, or otherwise, and I forever release and discharge APT from liability under such claims to the fullest extent permitted by law.

I am knowingly and voluntarily visiting APT’s Premises and participating in the Event as listed above. I understand the dangers associated with such Event including, but not limited to, the potential of serious physical injury or death, and assume all risks associated with such participation. In the event of liability arising from physical, psychological, or any other type of harm, I agree to indemnify, defend, hold harmless, release, and discharge APT, APT’s assignees, and all parties associated with APT from such liability. 

I understand and accept that there is an element of risk arising out of or related to the COVID virus, similar viruses, or other infectious diseases, and such risks include illness or death to myself and others with whom I come into contact. I First Name*   Last Name*   ("Trainer") am a certified personal trainer through   *   (certifying organization) and will provide accurate & up to date certification verification prior to commencing training services. 

Daily Rate Trainer Terms
Trainer must provide proof of up to date professional certification along with government identification prior to training. Trainer shall have access to the Premises within Operating Business Hours, and during Trainer Scheduling Hours, subject to availability. The Premises will not be used for individual training and Trainer shall not have any right to use the Premises at the exclusion of any other trainer or their clients, or any party affiliated with APT. Trainer is permitted a maximum of one (1) client per training session at a rate of $25/client. Any session exceeding one client must be pre-approved and will result in an additional fee. Per request, Trainer may pre-pay weekly for any requested training dates. Refunds will not be permitted for any pre-paid dates or training dates but funds may be transferred to a future daily rate rental. All fees must be paid by credit card prior to commencement of training session.

APT reserves the right to limit Trainer’s use of the Premises and equipment due to health and safety concerns and/or based on availability of the studio. Such limitation may be made at the discretion of APT or upon government mandate. If a potential limitation on the use of the Premises equipment is foreseeable, APT will make reasonable efforts to inform Trainer of such limitation and any resulting adjustments to APT operations.

Code of Conduct
APT intends to promote a safe, professional, honest, respectful, courteous, and clean environment. Trainer shall also uphold such standards by ensuring that the following rules are followed by Trainer and Trainer’s clients: 

• All clients of the Trainer will be required to complete a client waiver prior to participating in a training session
• Trainer shall promptly communicate all APT expectations, policies, and procedures to clients before the client’s first scheduled training session at APT;
• harassment of any kind, foul language, sexual misconduct, or any similar action is prohibited;
• no solicitation or advertising of any kind is permitted without consent of APT;
• no unauthorized audio or visual recording is permitted without consent of the individual being recorded;
• appropriate fitness attire shall be worn by Trainer and Trainer’s clients (no jeans, open toe shoes, visible undergarments, or visible parts of the body that would generally be considered inappropriate to show in a fitness facility);
• before, during, and after all training sessions, Trainer shall ensure that the Premises remains clean and organized, and that equipment will be cleaned with disinfectant after each use;
• wiping down equipment with disinfectant cleaner, re-racking, stacking or reorganizing training equipment, mopping up perspiration, spills, or fluids caused by Trainer or Trainer’s clients; 
• Trainer shall act and communicate in a courteous and respectful manner with their clients, fellow trainers, and APT staff; and 
• Clients shall act in a controlled respectful manner while on the Premises.

APT, Trainer, and Trainer’s clients shall only use equipment as designed to ensure the longevity of the equipment and safety of all persons on the Premises. If Trainer or Trainer’s clients are found using equipment in an improper or unsafe manner, or in a manner that may damage the equipment, APT will address such misuse. Repeated misuse may result in Trainer or Trainer’s clients losing authorization to use APT equipment. If Trainer or Trainer’s clients damage, destroy, steal, or lose APT equipment, Trainer will be responsible for any costs associated with repairing or replacing the damaged, destroyed, stolen, or lost equipment. Methods of restoring or replacing such equipment, and the associated costs for which Trainer will be responsible, shall be made at the sole discretion of APT.

If Trainer is deemed to be in violation of the above Trainer and Client Expectations, APT will warn Trainer and such incident will be documented. If APT deems such behavior grossly inappropriate, or Trainer or Trainer’s clients repeatedly violate the Trainer and Client Expectations, this Agreement may be immediately terminated at the sole discretion of APT, and Trainer shall forfeit any amounts already paid to APT. Whether Trainer’s or Trainer’s client’s behavior violates this section shall be determined solely by APT.

Trainer Liability Waiver
By signing this Agreement, Trainer acknowledges that Trainer understands the risks and dangers associated with physical exercise, to include the potential of serious physical injury or death, and Trainer assumes all risks associated with such participation. In the event of liability arising from physical, psychological, or any other type of harm, Trainer agrees to indemnify, defend, hold harmless, release and discharge APT, APT’s assignees, and all parties associated with APT from such liability. 

Trainer Authorization to Photograph
Trainer grants permission to APT the right to photograph and record Trainer in connection with any services rendered on the Premises. Trainer also grants APT, APT’s assignees, Trainers, and successors permission to use Trainer’s image, likeness, and all reproductions thereof and releases these parties from any claims that may arise regarding the use of Trainer’s image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. APT is permitted, although not obligated, to include Trainer’s name as a credit in connection with the image. APT is not obligated to utilize the rights granted in this paragraph.

Covid-19 Guidelines 
Trainer understands and accepts that there is an element of risk arising out of or related to the COVID-19 virus, similar viruses, or other infectious diseases, and such risks include illness or death to Trainer and others with whom Trainer comes into contact. Trainer is familiar with the CDC guidelines regarding COVID-19 and similar virus protocols and will adhere to all such guidelines that are applicable to Trainer or related to Trainer’s patronage of the Premises. Trainer agrees to self-screen before visiting the Premises in accordance with CDC guidelines and will follow all health and safety protocols that APT may implement in connection with COVID-19 or any other viruses or infectious diseases. Trainer agrees to forever indemnify, defend, hold harmless, release and discharge APT of any claims made against APT in connection with COVID-19 or any similar virus or infectious disease, resulting from Trainer’s failure to adhere to CDC guidelines. Trainer will not make or bring any claims against APT related to contracting or spreading COVID-19 or any similar virus or infectious disease, even if caused by the negligence of APT, APT’s employees, APT’s Trainers, or otherwise, and Trainer forever releases and discharges APT from liability under such claims to the fullest extent permitted by law.

Short Term Rental Terms
Signee shall have access to the Premises within Operating Business Hours, and during Scheduling Hours, subject to availability. The Premises will not be used for individual training and signee shall not have any right to use the Premises at the exclusion of any other trainer or their clients, or any party affiliated with APT. Primary renter("Renter") is designated as the individual who made the initial appointment request & payment through the scheduling system. Primary renter is permitted the use of APT at a rate of $25/hour. All renters are granted a 15 minute buffer to their appointment totaling 1hour & 15 minutes of rental time. Any session exceeding 1 hour will result in being charged the hourly rate. Refunds will not be permitted for any pre-paid dates. All fees must be paid by credit card prior to commencement of session.

APT reserves the right to limit signee's use of the Premises and equipment due to health and safety concerns and/or based on availability of the studio. Such limitation may be made at the discretion of APT or upon government mandate. If a potential limitation on the use of the Premises equipment is foreseeable, APT will make reasonable efforts to inform Renter of such limitation and any resulting adjustments to APT operations.

Code of Conduct

If Renter or Renter's guests are found using equipment in an improper or unsafe manner, or in a manner that may damage the equipment, APT will address such misuse. Repeated misuse may result in Renter or Renter's guests losing authorization to use APT equipment. If Renter or Renter's guests damage, destroy, steal, or lose APT equipment, Renter will be responsible for any costs associated with repairing or replacing the damaged, destroyed, stolen, or lost equipment. Methods of restoring or replacing such equipment, and the associated costs for which Renter will be responsible, shall be made at the sole discretion of APT.

If APT deems such behavior grossly inappropriate, or Renter or Renter's guests repeatedly violate the Renter and Guest Expectations, this Agreement may be immediately terminated at the sole discretion of APT, and Renter shall forfeit any amounts already paid to APT. Whether Renter or Renter's guests behavior violates this section shall be determined solely by APT.

Liability Waiver
By signing this Agreement, signee acknowledges and understands the risks and dangers associated with physical exercise, to include the potential of serious physical injury or death, and signee assumes all risks associated with such participation. In the event of liability arising from physical, psychological, or any other type of harm, signee agrees to indemnify, defend, hold harmless, release and discharge APT, APT’s assignees, and all parties associated with APT from such liability. 

Authorization to Photograph
Signee grants permission to APT the right to photograph and record signee in connection with any services rendered on the Premises. Signee also grants APT, APT’s assignees and successors permission to use signee's image, likeness, and all reproductions thereof and releases these parties from any claims that may arise regarding the use of signee's image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. APT is permitted, although not obligated, to include signee's name as a credit in connection with the image. APT is not obligated to utilize the rights granted in this paragraph. If signee does not agree to the authorization to photograph terms, signee must provide written notification to contact@apttrainingstudios.com stating so.

Covid-19 Guidelines 
Signee understands and accepts that there is an element of risk arising out of or related to the COVID-19 virus, similar viruses, or other infectious diseases, and such risks include illness or death to signee and others with whom signee comes into contact. Signee is familiar with the CDC guidelines regarding COVID-19 and similar virus protocols and will adhere to all such guidelines that are applicable to signee or related to signee's patronage of the Premises. Signee agrees to self-screen before visiting the Premises in accordance with CDC guidelines and will follow all health and safety protocols that APT may implement in connection with COVID-19 or any other viruses or infectious diseases. Signee agrees to forever indemnify, defend, hold harmless, release and discharge APT of any claims made against APT in connection with COVID-19 or any similar virus or infectious disease, resulting from signee's failure to adhere to CDC guidelines. Signee will not make or bring any claims against APT related to contracting or spreading COVID-19 or any similar virus or infectious disease, even if caused by the negligence of APT, APT’s employees, APT’s Trainers, or otherwise, and signee forever releases and discharges APT from liability under such claims to the fullest extent permitted by law.

I am knowingly and voluntarily visiting APT’s Premises and participating in the Event as listed above. If the Event is physical in nature, I understand the dangers associated with physical exercise, including the potential of serious physical injury or death, and assume all risks associated with such participation. In the event of liability arising from physical, psychological, or any other type of harm, I agree to indemnify, defend, hold harmless, release, and discharge APT, APT’s assignees, and all parties associated with APT from such liability. 

I understand and accept that there is an element of risk arising out of or related to the COVID-19 virus, similar viruses, or other infectious diseases, and such risks include illness or death to myself and others with whom I come into contact. I am familiar with the CDC guidelines regarding COVID-19 and similar virus protocols and will adhere to all such guidelines that are applicable to me or to my patronage of the Premises. I agree to self-screen before visiting the studio in accordance with the CDC guidelines and will follow all health and safety protocols that the studio may implement in connection with COVID-19 or any other viruses or infectious diseases. I agree to forever indemnify, defend, hold harmless, release, and discharge APT of any claims made against APT in connection with COVID-19 or any similar virus or infectious disease, resulting from my failure to adhere to CDC guidelines. I will not make or bring any claims against APT related to contracting or spreading COVID-19 or any similar virus or infectious disease, even if caused by the negligence of APT, APT’s employees, APT’s Trainers, or otherwise, and I forever release and discharge APT from liability under such claims to the fullest extent permitted by law.

I grant permission to APT the right to photograph and record me in connection with any services conducted on the Premises. I also grant APT, APT’s assignees, Trainers, and successors permission to use my image, likeness, and all reproductions thereof and release these parties from any claims that may arise regarding the use of my image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. APT is permitted, although not obligated, to include my name as a credit in connection with the image. APT is not obligated to utilize the rights granted in this paragraph.

This Agreement expresses my complete understanding of the rights and obligations that exist between me and APT. I recognize that outside of this Fitness Photoshoot Authorization & Liability Waiver, I am not in privity of contract with APT and shall have no claim for breach of contract for the actions of APT, or APT’s employees, assignees, Trainers, or successors.

By signing below, I indicate that I have read and understood this Photograph Authorization & Liability Waiver and that I am over the age of 18.

Phive-14 Photography Model Release:

A. Model Release
I hereby give to Phive-14 Photography by Dashaun Graham the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

B. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

C. Copyright & Penalty
Phive-14 Photography by Dashaun Graham retains all copyrights to all images created during client’s session. A print release will be given with digital files to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Phive-14 Photography by Dashaun Graham during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.
