  • Contract of Terms - Mike Wong Fitness

    Your agreement is with Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED who delivers your training. These Terms and Conditions form part of your agreement. Your instruction to commence personal training with MIKE WONG FITNESS LIMITED will constitute acceptance of these Terms and Conditions when you become a Client (a ‘client’ or ‘you’).

    You are advised to read (and are responsible for reading) all information set out in these Terms and Conditions fully.

    The Trainer’s Obligations (MIKE WONG FITNESS LIMITED)

    ·       Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED will use his skills and knowledge to design a safe programme of exercise to achieve the client’s goals.

    ·       This will take into account: the client’s age, health, lifestyle, background, occupation, fitness levels, likes and dislikes related to exercise and personality.

    ·       Apart from the initial consultation, each personal training session will last 60 minutes (a ‘session’). If Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED misses your session without at least 24 hours’ notice you will be credited with a free session.

    ·       You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the sessions. In particular you acknowledge that individual results may vary and no particular result is guaranteed.

    ·       Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED will provide the coaching, supervision, advice and support that the client will need to help achieve their goals during each session.

    ·       All client information will be kept strictly private and confidential.

    The Client’s Obligations

    ·       It is understood between you and Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED that both must commit to your training programme 100% in order for the client to achieve results.

    ·       You are required to arrive on time for each session so that your full training plan is achieved on each visit.

    ·       You are required to wear appropriate clothing and footwear.

    ·       You are required to complete and sign a Physical Activity Readiness Questionnaire (a ‘PAR-Q’) before undertaking your first personal training session.

    ·       You understand and agree that it is your responsibility to inform Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED of any conditions or changes in your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

    ·       If Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED requires further medical information from your GP or Specialist Practitioner, you must provide such details.

    ·       You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED is not responsible, except where the injury was caused by his gross negligence. This applies to all training services, including one-to-one, online and small group sessions.

    ·       The client must bring any medication, or medical equipment that may become necessary throughout physical activity.

    ·       The client is encouraged to bring a sweat towel, a drink and other reasonably requested equipment or apparel.

  • Fees

    ·       Accepted methods of payment are cash, electronic bank transfer or standing order.

    ·       Receipts will not be provided unless expressly requested by the client, and it is the client’s responsibility to record any cash payments they make with MIKE WONG FITNESS LIMITED to ensure it is appropriately recorded.

    ·       All sessions that are purchased in full must be paid for in advance at or before commencement of the first training session.

    Cancellations and Refunds

    ·       To cancel a scheduled session with Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED with no charge or cancellation fee will require a minimum of 24 hours’ notice.

    ·       Cancellations must be made via agreed communication methods (e.g. phone, text or email with Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED.

    ·       If a cancellation is made by the client without at least 24 hours’ notice it will be deemed a ‘late cancellation’ and the session will still be charged as usual. Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED has the discretion as to whether or not a client will be charged for a late cancellation. This discretionary measure is made in extreme circumstances under which the client wishes to make a cancellation and with any other factors Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED deems relevant.

    ·       Clients who do not attend sessions without informing Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED will also be charged in full for the session and will not be given the opportunity to move the session. This is deemed a ‘no show’.

    ·       The time slot for any session that is cancelled by you, in or out of the notice period, will be made available to other MIKE WONG FITNESS LIMITED clients and you will no longer be entitled to that session time.

    ·       If for any reason Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED is unable to attend a scheduled session with the client, Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED will notify the client as soon as practicable, and endeavour to reschedule the session to another time that suits both parties.

    ·       Once sessions are purchased they are non-refundable and non-transferable with the exception of long term absences.

    ·       Long term absences will be dealt with fairly and on an individual basis at the discretion of MIKE WONG FITNESS LIMITED. Sessions can be used when the client is well and able to do so again. If the client is unable to return to the original or amended version of the training programme after an agreed period of time, the sessions may be transferred to another suitable person or refunded.

    ·       All clients must conduct themselves in a respectful manner whilst using MIKE WONG FITNESS LIMITED facilities. Any client who acts in an intimidating, abusive, violent or disrespectful manner may be asked to leave with no recourse for refund of monies already paid.

    Small Group Training Sessions

    ·       A “Small Group Session” is defined as a training session involving two or more clients participating in the same session/programme.

    ·       By participating in Small Group Sessions, clients acknowledge and accept that training is delivered in a group environment and that individual supervision and instruction may be reduced compared to one-to-one personal training. Clients are responsible for exercising within their own capabilities at all times and must follow all instructions given by the trainer.

    ·       Exercises may be adapted or scaled to suit a range of fitness levels; however, sessions are not individually tailored. It is the client’s responsibility to select appropriate options and to inform the trainer if they are unsure or unable to safely perform any exercise.

    ·       All clients booked onto a Small Group Session are expected to attend as agreed. If a client does not attend a scheduled session, that session will be forfeited and is non-refundable and non-transferable.

    ·       Where a Small Group Session continues with one or more clients absent, the session will proceed as planned and absent clients will still be charged at the agreed rate.

    ·       Cancellation of a Small Group Session with at least 24 hours’ notice will allow the session to be rescheduled at the discretion of MIKE WONG FITNESS LIMITED. Cancellations made with less than 24 hours’ notice will be treated as a late cancellation and the session will be forfeited.

    ·       A minimum number of participants may be required for Small Group Sessions to run. Where this number is not met, MIKE WONG FITNESS LIMITED reserves the right to reschedule, modify, or cancel the session.

    ·       MIKE WONG FITNESS LIMITED reserves the right to adjust group sizes, session times, coaches, or session structure where reasonably necessary to maintain service quality and safety.

    ·       Late arrival to a Small Group Session may result in the client being unable to participate in the session, particularly where the warm-up has been missed, due to health and safety considerations.

    ·       Clients must conduct themselves in a respectful and safe manner at all times. Any behaviour deemed unsafe, disruptive, or inappropriate may result in removal from the session without refund.

    ·       Should a client choose to withdraw from a Small Group programme, any sessions already purchased remain non-refundable and non-transferable. Future sessions may be subject to revised pricing for remaining participants where applicable.

     

    Lateness

    ·       If you are late for a session, the session cannot be extended and will end at the scheduled time.

    ·       If Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED is late, additional time will be added to the session or to a subsequent session.

    Health and Safety

    ·       Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED has completed and holds a FAA L3 Award in First Aid at Work (QCF) certificate and FA L2 in Cardiopulmonary Resuscitation and Automated External Defibrillation (QCF) certificate.

    ·       MIKE WONG FITNESS LIMITED has £5 million public liability insurance cover.

    ·       The equipment in use at MIKE WONG FITNESS LIMITED is checked periodically to ensure it is fit for purpose.

  • General

    ·       MIKE WONG FITNESS LIMITED has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. You will be notified of any changes made. If such a change is made to the Terms and Conditions to which you are dissatisfied, you can cancel this agreement once you have made payments already due to MIKE WONG FITNESS LIMITED.

    ·       You are responsible for keeping all your contact information up to date with Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED.

    ·       Please be aware that MIKE WONG FITNESS LIMITED operates CCTV during your session at the Gym for the safety and security of you and MIKE WONG FITNESS LIMITED. You consent to, and waive any and all claims in respect of, your image being recorded by 24 hour CCTV for security purposes and agree to it being reviewed at our discretion by MIKE WONG FITNESS LIMITED.

    ·       The client is asked to park on the concrete driveway or gravelled driveway of MIKE WONG FITNESS LIMITED and not on the road. The client must do all that is reasonably necessary to abide by neighbouring and local parking as well as traffic conditions. MIKE WONG FITNESS LIMITED will accept no responsibility or any liability for any damage, theft or loss to a client’s vehicle or personal belongings.

      CLIENT DISCLAIMER/WAIVER OF LIABILITY

  • I        agree participate a physical programme run by MIKE WONG FITNESS LIMITED, which may include, but not necessarily be limited to functional fitness training and weightlifting.

  • I understand that physical exercise can be strenuous in nature and may push me to the limits of my physical abilities. I acknowledge that participation in physical activity carries inherent risks, including but not limited to injury, illness or, in very rare circumstances, death. By choosing to participate, I do so voluntarily and entirely at my own risk.

    I understand that training sessions may take place on a one-to-one basis, online, or within a group environment. Where sessions take place in a group setting, I acknowledge that supervision and instruction will be shared among participants and may not be provided individually at all times. I accept that I am responsible for exercising within my own capabilities, selecting appropriate exercise options where given, and following all safety instructions provided.

    I agree to inform Michael Wong, Personal Trainer of MIKE WONG FITNESS LIMITED, of any symptoms experienced during exercise, including but not limited to fatigue, shortness of breath, chest discomfort, pain or dizziness. I also confirm that I will disclose any relevant medical conditions, injuries, recent surgeries or medications that may affect my ability to exercise safely, both prior to and during my participation in any training programme.

    I understand that MIKE WONG FITNESS LIMITED is not able to provide medical advice and that any information provided by me is used as a guideline to help deliver training safely. I acknowledge that it is my responsibility to seek medical advice from a qualified professional where appropriate.

    I understand that I will receive instruction on how to perform exercises and use equipment safely, and I agree to ask questions where I am unsure of any instruction given.

    Any recommendations relating to nutrition or supplementation are provided for general guidance only. I understand that I should consult a qualified medical professional before making any significant dietary changes or using supplements.

    In full consideration of the above, I voluntarily agree to waive, release and discharge MIKE WONG FITNESS LIMITED and its employees from any and all claims, demands or causes of action arising out of or in connection with my participation in any training programme. This includes, without limitation, participation in one-to-one, online and small group training sessions, and covers any injury, loss or damage sustained as a result of:
    (a) my participation in any exercise or training session; and
    (b) any instruction, supervision, guidance or dietary advice provided by MIKE WONG FITNESS LIMITED.

    I confirm that I have read and fully understood this waiver, and that I have also read and agree to the MIKE WONG FITNESS LIMITED Terms and Conditions. I acknowledge that I have had the opportunity to ask questions and that I accept these terms voluntarily.
