Release and Waiver of Liability

I (student, member, parent, legal guardian, spouse or guest as applicable) understand the course for which I have applied has an inherent risk of accidental physical injury and I agree that the risk of any such injury is assumed by me. This includes ,without limitation, the use of the equipment, locker room, showers, restroom, parking area, sidewalk and my participation in any activity, class program, personal training or other instruction now or in the future made available. I agree that I am voluntarily participating in these activities and using equipment and facilities and assuming all risk of injury on my contraction of any illness or medical condition that might result there from or any damage, loss or theft of any personal property. I agree on behalf of myself (and my personal representatives, heirs executors, spouse, administrators, agents, assignees or others) to release and discharge Strive Jiu Jitsu and Fitness Academy C (and its owners, principals, instructors, agents, directors, officers, promoters, sponsors, advertisers, affiliates, representatives, successors, and assigns) from any and all claims or causes of action arising out of their negligence. This waiver and release of all liability includes, without limitation, injuries which may occur as a result of (a) my use of any facility or its improper maintenance, (b) my use of any exercise, training equipment which may malfunction or break, (c ) our improper maintenance of any exercise or training equipment (d) our negligent instruction or supervision (e) our negligent hiring or negligent retention of any employee or instructor (f) loss of consortium or (g) my slipping and falling while in any school, institute, club or on the surrounding premises. I acknowledge that I have carefully read this waiver and release and fully understand that it is a release of all liability. In addition, I do hereby waive any right that I may have, by or on behalf of myself, my spouse or any child, (minor or otherwise) to bring a legal action or assert a claim for injury or loss on any kind against Strive Jiu-Jitsu and Fitness academy (and its owners, principals, instructors, agents directors, officers, promoters, sponsors, advertisers, affiliates, representatives, successors, and assigns) for negligence or arising out of or relating to participation by myself my spouse or ch9ild in any of the activities, or use of the equipment, facilities or services provided as described in this paragraph, or on account of any illness or accident or damage to or loss of my personal property. In consideration of being permitted to enroll in the next of kin, hereby release, waive, discharge, and covenant not to sue Strive Jiu Jitsu and Fitness Academy, its owners, principals, instructors agents assigns, heirs, successors in interest and next of kin for all loss or damage whatsoever, and any claim of damage therefore, on account of injury to my person or property or resulting in my death, whether caused by negligence or any other acts of the association.

I (student, member, parent, legal guardian, or guest as applicable) understand that I should consult with a physician before using Strive Jiu Jitsu and Fitness Academy services, schools, institutes or clubs. I understand and acknowledge that Strive Jiu-Jitsu and Fitness ACademy has no expertise in diagnosing, examining, or treating any medical condition. I agree that I will not use the school, institute, club or facility with any medical condition including open cuts, abrasions, sores, infections, maladies, or ability to maintain personal hygiene, if such conditions pose a direct threat to the health or safety of myself or others, and agree that I will use the club or school in accordance with all applicable public health requirements. It is my responsibility to consult with my physician to determine if any of these medical conditions exists and, if so, whether such conditions pose a direct threat to the health or safety of myself and others. Strive Jiu-Jitsu and Fitness Academy owners and staff reserves the right to make the final determination in this regard.

I agree to abide by the rules and regulations of the Academy at all times now in force or in the future adopted by Strive Jiu jitsu and Fitness Academy or their affiliated school, institutes, clubs, facilities, including by not limited to rules and regulations with regard to hours of operation, use of equipment, services and school premises, personal hygiene and attire while on institute premises or at any sanctioned contest or exhibition of martial arts. Strive Jiu Jitsu and Fitness Academy reserves the right to revoke or suspend my membership without refund if I or my guest fails to follow any rules or regulations, for reasons of nuisance, disturbance of other members, moral turpitude or fraud, or if company determines that my actions may endanger myself or other persons. I also understand that the academy assumes no responsibility for lost or damages to personal property, strive jiu jitsu and fitness academy reserves the right in its sole discretion to terminate or suspend any student or member from participation in the course of the instruction in self defense for fighting, assault or other acts of physical violence of violations of the law.

Frequently Strive Jiu-Jitsu and Fitness Academy takes photographs and/or video of students and classes. For good and valuable consideration, I thereby authorize Strive Jiu Jitsu and Fitness Academy and/or any of its agents to photograph and/or video me or my child and grant them the absolute and irrevocable right and permission with respect to the photographs and videos that he/she has taken of me or my child which he/she may be included with others: A) to copyright the the same in Strive Jiu Jitsu and Fitness Academy or any other name that he/she may select B) to use, reuse, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, text, graphics, video, in any medium now or hereafter known, and for any purpose whatsoever, including (but not limited to) illustration, promotion, advertising, trade or sold for profit and; C) to use my name or my child’s name in connection therewith if he/she so decides. I hereby release and discharge Strive Jiu Jitsu and Fitness academy or any of its agents from any and all claims and demands ensuing from or in connection with compensation for appearing in such materials and that this release is binding upon my heirs and assigns.

In the event of any emergency, I hereby authorize any licensed medical personnel to perform any accepted medical procedure deemed necessary and agree to bear the expense of any such treatment. I have read and understood the above and would like myself or my child to try a lesson.
