LOYALTY PROGRAM TERMS
These loyalty program terms describe the terms of our Loyalty Program and any successful referrals provided to us as part of the program, as well as how we reward both the referrer and the referred client in the program. By submitting this form, you agree to these Terms.

Agreement Summary
These terms and conditions of our Loyalty Program (the "Terms") prescribe the terms governing the arrangement entered into between the Parties for the payment of referral rewards (the "Referral Rewards") in exchange for a new client referral.
LEGAL TERMS
1. Client Referral
(a) Each person referred (the "Referred Client") the subject of a referral (the "Referral") must be an Australian-based business that has not previously been our client or engaged us for the provision of Business Accounting & Taxation Services ("Services").
(b) You are not obliged to submit any Referrals to us and may enter into any other similar referral arrangement with other parties.
(c) We may enter into any other similar referral arrangement with other parties.
(d) We are not obliged to engage as our client any Referred Client.
(e) By submitting this form, you warrant that:
(i) you are the Referrer as named in this form; and
(ii) you have personally referred the Referred Client to us.
2. Method of Referral
For the purposes of this Loyalty Program and the Referral Rewards, a Referral is only deemed valid when submitted via this form.
3. The Reward
(a) The Referral Rewards are set out in Schedule 1 of these Terms (the "Referral Rewards").
(b) The Referral Rewards are due and payable by us to you and the Referred Client once the following events have occurred:
(i) you submit this Referral with true, accurate and complete details for both you and the Referred Client, to enable us to properly verify the validity of your Referral and your compliance with these Terms;
(ii) we accept the Referred Client as a client and that Referred Client signs and executes an Engagement Letter with us for the provision of Services;
(iii) that Referred Client receives and pays their first invoice for those Services;
(iv) at the time of you submitting this form, no more than three (3) months have passed since the Referred Client became our client; and
(v) we have had reasonable time to verify the validity of your Referral and your compliance with these Terms.
(c) Once the Referral Rewards become due and payable, we will directly send to both you and the Referred Client the Referral Rewards by email or postal mail at our discretion.
(d) We retain the right, at our complete discretion to alter, amend or substitute the Referral Rewards for both you and the Referred Client.
4. Privacy Protection
We agree to keep all Referred Client information confidential in accordance with our Privacy Policy that can be found at www.floataccounting.com.au/privacypolicy.
5. Restrictions
We have a number of restrictions around this Loyalty Program. These restrictions are set out in Schedule 2 of these Terms.
6. No Agency
(a) These Terms do not create any legal or fiduciary relationship between the Parties.
(b) You, your employees or your agents must not represent, convey, or in any way make out to be an agent, partner, representative, employee, contractor, or affiliate of Float Accounting.
(c) Neither party shall have any right, authority or permission to legally bind the other party to any contract, arrangement, or obligation.
7. Indemnity
You agree to indemnify us against any loss, damage, liability or expense incurred by us arising directly or indirectly from:
(a) a breach of these Terms;
(b) any negligent or wilful act or omission by you or anyone acting on your behalf; or
(c) any third-party claim resulting from or in connection with the Referral Rewards.
8. No Warranties
(a) To the maximum extent permitted by law, nothing in these Terms constitutes a warranty or guarantee from us of any kind.
(b) You agree to hold us harmless against any loss, damage, liability, or expense you incur resulting from or in connection with the Referral Rewards.
9. General Provisions
(a) Without limiting any other clause in these Terms, when participating in this Loyalty Program you must not do anything that may adversely affect our reputation or misrepresent us, our business, our services, or our staff.
(b) We may amend these Terms at any time by updating these Terms on this website.
(c) In the event that any provision of these Terms is held to be invalid, illegal or unenforceable, then such provision will be fully severed, and these Terms will be construed and enforced without that severed provision.
(d) The rights created under these Terms are non-assignable. For the avoidance of doubt, no future Referral Rewards will be due and payable to you or the Referred Client if you breach these Terms, whether the right to the Referral Rewards arose prior to the breach or otherwise, and the relationship between the parties will be severed so that there is no longer an obligation to pay any Referral Rewards.
(e) By submitting this form, you agree to these Terms.
(f) These Terms are governed by the laws of Victoria and the Parties agree to submit to the exclusive jurisdiction of the Courts of that State.
SCHEDULE 1
The Referral Rewards are any one of the rewards selected by the Referrer when completing this form. The Referrer and Referred Client are each entitled to one (1) Referral Reward per Referral.
SCHEDULE 2
Restrictions on the Referrer:
(a) This Loyalty Program is intended for existing clients of Float Accounting only. We invite non-clients (including affiliate marketers) to contact us directly if interested in promoting our services. If you are not an existing client of Float Accounting, please do not submit this form as your Referral will not be deemed valid.
(b) This Loyalty Program is intended for personal and direct word-of-mouth referrals. Distributing or promoting this Loyalty Program via website promotions, affiliate networks, banners, ads, newsgroups, chat rooms, ICQ, message boards, hit farms, counters, guestbooks, etc. is strictly prohibited.
(c) We do not allow Referrals of any non-Australian based Referred Clients.
(d) SPAMMING of any kind is strictly prohibited.
(e) Fraud is a serious offence and will be treated as such. Fraud is defined as any action that intentionally attempts to create fake or inauthentic Referrals for the sole purpose of receiving Referral Rewards. Fraudulent activity may result in suspension of any Referral Rewards and may be reported to authorities. In cases of fraud, we reserve the right to terminate any business relationship or contract we have with a Referrer and/or issue claims or court proceedings against the Referrer.
