iSUP Saugeen Rental Equipment: Waiver of Liability and Terms of Participation

For the purpose of this document [client], is hereby identified as the individual / s whom are filling out the iSUP Saugeen Rental Equipment Participant Agreement Form and who are intending to participate in use of iSUP Saugeen Rental Equipment.
PART 1: Terms of Use (A). For the purpose of this document “iSUP Saugeen” refers to 13725855 Canada inc. operating as iSUP Saugeen.The Rental equipment polices collected within reflect the Transport Canada Rental Boat Safety checklist to ensure competency and secure safety standards. In addition, iSUP Saugeen also uses the Transport Canada Safe Boating Guide as a reference to secure industry specific safety standards and updated regulations. I [Client] understand that there are potential degrees of risk involved in all water sport activities and that swimming ability is fundamental to water sports safety. I agree to keep other people informed of my location and destination when using iSUP rentals and agree that iSUP Saugeen is not liable for my actions or the actions of any third parties whom are in use of the rental equipment for the entire duration of the rental period including the point of pick up, drop off, and or delivery. I, [Client], also understand that assumption of risk and release of liability via a unilateral hold harmless clause is required to take possession of any rental equipment. I agree to the terms included in Part 1 (A).
(B). I [Client], agree that the return deadline for rental equipment is to be enforced and agree to pay a $50.00 a day late fee plus applicable fees. I agree to these terms.
(C). Clients who utilize the iSUP rental equipment in order to participate in recreational watersport activities are considered to be participating in a human-powered pleasure craft outing and will be paddling under the Transport Canada small vessel regulations, specifically the pleasure craft guidelines. I [Client], agree to be 100% Compliant with the polices outlined within and agree to WEAR a life jacket at all times when using iSUP Saugeen rental equipment.
(D). I [Client], agree to be 100% Compliant with the regulations and laws outlined by The Department of Transport Canada’s Small Vessel Regulations and agree that it is my responsibility to obey all relevant laws, bylaws and small vessel regulations when in use of iSUP Saugeen rental equipment.
(E). I, [Client], agree to partake in use of the iSUP rental equipment in a way that takes reasonable care and consideration for the safety / security of myself, other persons, rental equipment, and the environment.
(F). I [Client], understand that there is endangered wildlife and species at risk living in habitats all around Canada’s waterways. I agree to respect and protect Canada’s waterways, wildlife and surrounding environments when enjoying outdoor recreational activities.
(G). Misuse of the iSUP equipment creates unpredictable risks that are potentially capable of inflicting serious personal injury, disappearance, or death, as well as potential loss or damage to rental equipment and or personal property. Knowing the risks I, [Client], agree to assume ALL those risks including, but not limited to; assuming the financial responsibility of any possible litigation arising from any incident in which I may be involved including any unforeseen personal injury, lost, stolen, or damaged personal effects. I release and or indemnify iSUP Saugeen and Amy Caperchione from any and all damage, theft, loss, or personal injury. Any incident involving myself, the location, other peoples or actions of other participants and spectators will be my sole responsibility. I, [Client], agree to assume all and any financial costs associated with my actions- especially actions that are identified within as misuse and or negligence.
(H). I [Client], agree that, “misuse and negligence” is here by being defined as any action or event that fails to adhere to, or disregards the terms of use and safe boating practises outlined within this policy and the Department of Transport Canada.
(I). I [Client], agree that there is a NO pet policy on iSUP Saugeen rental equipment. Failure to comply is a form of negligence & misuse.
(J). I [client], understand that the maximum inflation pressure for iSUP Saugeen rental equipment is 13.5 psi. I agree that failure to monitor inflation is a form of neglect & misuse. Over-inflation leads to damage. In addition, I [client], also agree that over-inflation is a form of neglect and misuse. The weight capacity for iSUP equipment is 275 pounds. Exceeding weight capacity is also a form of misuse and neglect. I agree to monitor inflation capacity and weight capacity at all times.
(K). I [Client], agree that taking the time to research safety equipment, weather conditions, marine forecasts and warnings, water quality, tides, currents and water levels is an essential aspect of safe use of the iSUP equipment. Always inform people of when you are launching equipment into the water; when are you planning on returning? Where are you launching from? Where is your destination? When did you return? If you do not have any contacts available for communication send a text message to 226-222-4641, leave a message in the iSUP Saugeen Facebook group, or reach out online at https://isupsaugeen.ca/ I understand that failure to keep someone on land informed of active use and location is a form of negligence and or misuse of the rental equipment.
(L). I, [Client], understand that, the probability of damage and personal injury occurring is higher if the iSUP is being used in a location with greater risk and understand that I am prohibited from using iSUP Saugeen rental equipment on whitewater rapids or any rapids classified as Class III, Class IV, Class V, or Class VI. I understand that iSUP is not designed to navigate these classes of whitewater. Failure to comply is considered negligence and or misuse of the rental equipment.
(M). I, [Client], understand that, the characteristics of a river or lake can change remarkably as the water level rises or falls. As you might expect, a set of Class II rapids can become raging Class IV when the water is abnormally high due to spring runoff or heavy storms. As a result, I agree to take appropriate care to assess water levels, climate and water temperature, rapids, potential obstacles, and my own ability and or the ability of participants. Failure to do so is considered misuse and negligence.
PART 2: Safe Boating Policy (A). iSUP Saugeen has a Zero Tolerance policy for unsafe boating practice and this includes but is not limited to; unsupervised minors, boating unprepared, misuse of rental equipment, boating without WEARING a life jacket, exceeding weight capacity, littering, destruction of habitats, inflicting deliberate damage to property, boating under the influence of drugs and / or alcohol, and any and all actions that disregard or neglect the policies here listed by iSUP Saugeen and The Department of Transport Canada’s small vessel regulations. I [Client], agree that I am fully responsible for any and all incidents that may arise from disregarding or neglecting marine safety standards, the iSUP Saugeen policies, and / or Canadian laws and bylaws.
(B). In terms of the iSUP Saugeen life jacket rentals; all life jackets are approved by the department of Transport Canada. iSUP Saugeen ensures that lifejackets are tested for in-water performance after each rental period. Quality and Performance standards go hand-in-hand with safety. Life jackets are regularly tested for buoyancy to ensure that the life jackets are in their best working function. Use of the life jacket rentals implied that you consent to the details outlined on the jackets themselves; (the life jacket details can be found in the drop down menu of our website “Online Catalogue” scroll down to Stearns, Fluid & Body Glove and click the “more lifejacket details” link). I agree to these terms.
PART 3: IN THE EVENT OF DAMAGED, LOST, OR STOLEN RENTAL EQUIPMENT (A). I [Client], agree to contact Amy Caperchione at 226-222-4641 Immediately upon any damage, loss, or theft occurring to the rental equipment. I agree that continuing to use damaged equipment is a form of negligence and misuse.
(B). I [Client], agree to return the rental equipment immediately upon damage occurring and understand that the equipment will be assessed for liability and cost of repairs.
(C). In the case of a lost or stolen rental equipment; I [Client], agree that even this unforeseen incident reflects a degree of negligence. In the event of lost or stolen iSUP I understand that I am responsible for replacing or providing collateral for the 10.5’ tour model iSUP by Cottage Sports. Valued at $699.00. In the event of a lost or stolen life jacket, electric pump, or any rental inventory- I agree that I am financially responsible for providing collateral for the retail value of lost or stolen equipment. I agree to these terms.
PART 4: All Rights Reserved (A). iSUP Saugeen has a Zero Tolerance for violence, harassment or any degrading / offensive comments and behaviour. As a result, I [Client], understand that iSUP Saugeen reserves the right to decline rental equipment to any individuals who disregards these terms.
(B). I [Client], understand that iSUP Saugeen reserves the right to request a security deposit to secure personal assets and collateral for the whole sale value of the rental equipment for any applicable rental period. A security deposit may be required to take possession of rental equipment. Security deposits are $400.00. In terms of renting iSUP Saugeen equipment, a security deposit is necessary assurance. iSUP Saugeen uses secure pre-authorisation to hold a security deposit as collateral. Security deposit funds are released upon iSUP Saugeen taking possession of rented inventory.
(C). I [Client], understand that iSUP Saugeen rental fees are subject to change. All base prices are subject to applicable fees including 3.5% convenience fee and 13% sales tax.
(D). I [Client], understand that iSUP Saugeen reserves the right to decline rental or service to any individual who is a minor without parental supervision and or signed parental consent.
(E). I [Client], understand that iSUP Saugeen reserves the right to decline rental or service to any individual that is determined during the client screening process, for whatever reason; to not have adequate competency for safety standards.
(F). I [Client], understand that iSUP Saugeen reserves the right to negotiate and or decline refunds based on the relevant circumstances and the clients level of negligence, misuse, or overall treatment of the rental equipment.
PART 5: Optional Consent (A). I [Client], understand that, by signing this section that I am giving consent to iSUP Saugeen to share images from my session on social media; Instagram @isup.saugeen and Facebook at iSUP Saugeen, for marketing purposes without compensation.
PART 6: Age Requirements, Minors & Liability (A). As of January 2022, The Department of Transport Canada classifies SUP & iSUP as a human-powered watercraft / human-powered pleasure craft & has no minimum age regulation for use. Although there is no minimum age regulation at this time; this information is subject to change. Transport Canada is always updating regulations so check their website regularly. In Ontario Canada anyone under the age of 18 is classified as a minor. I [Client], understand that iSUP is not recommended for ages 10 and under.
(B). I [Client], understand that minors must always be supervised while using iSUP rental equipment.
(C). I [Client], understand that experience, ability and swimming skill are all relevant aspects of iSUP safety and agree to uphold my responsibility of ensuring that any minor participating with rental equipment is competent, able, and using the applicable safety equipment at all times when using the iSUP rental equipment.
(D). I [Client], understand that I am responsible for any unforeseen damage to rental equipment, lost, or stolen property that is caused by a minor.
(E). I [Client], hereby agree that I am responsible for any financial or legal repercussions that may be a result of unforeseen actions taken by, or involving a minor or any 3rd party who is in use of this rental equipment.
(F). I [Client], understand that a PFD or life jacket is NOT a substitute for adult supervision and agree to supervise any minor who is in use of the rental equipment or at all times when boating or being on or near the water.
