  • The purpose of this agreement is to set out our mutual understanding on the basis

    of which you will take on a HollyRoseFen/Webbs Paws puppy in order to avoid

    misunderstandings and to foster a happy and productive working relationship.

  • This is to confirm that the above dog is subject to a Guardian initiative agreement

  • DETAILS OF ALL PARTIES:

  • Registered owners (trading as HollyRoseFen/Webbs Paws) and referred to in this contract as 'I', or 'me' or 'the breeder' :

  • The above puppy will reside in the Guardian family home but will return to the Breeder at intervals to have 3 litters, never more than one a year, and starting when we feel she is sufficiently mature to be a mum. Registration of the puppy will remain with HollyRoseFen until she is retired from breeding. After 3 litters the Dog will be officially retired, and at this time ownership of the Dog will transfer to the Guardian to become their family pet for the rest of his/her life. Expenses related to health testing for breeding purposes, veterinary care whilst in pup, whelping and up to when the litter is 8 weeks old are met by HollyRoseFen. The dog will come to HollyRoseFen for mating and to give birth to their puppies and will return home to the Guardian when they are weaned. The Guardian family can visit their dog at any mutually convenient times.

    For a female, the dog will belong to the Beeder until completion of the 3rd litter, this means the birth of 4 or more live puppies or the Breeder and Guardian mutually agree to release the dog from the breeding programme. For a male dog, the dog remains the property of the Breeder for between 6-10 years.

  • The Breeder and Guardian both agree to take all reasonable steps to ensure that the

    transfer of ownership is legally effective and that the dog's ownership details are updated

    in relation to his/her microchip number at the Guardian's cost. Immediately prior to the

    transfer of ownership or as soon as reasonably practicable afterwards (only when it is safe

    for the Dog), the Dog will be spayed/neutered. The procedure will take place at a

    reputable veterinary establishment agreed by both parties acting reasonably and the

    Breeder shall pay the reasonable costs of the procedure.

    The Guardian has NO ownership or interest in any of the puppies produced or fathered by the Dog. The Guardian has NO rights to semen produced by the Dog.

  • The Guardian family agrees that they will:

    Care for the Dog in a responsible manner and ensure that he/she is well looked after physically and emotionally. Keep the Dog in a safe secure garden with lead walking (until the Dog is trained and has good recall Toilet train the dog by nine (9) months if age if not before. Properly crate train the dog as per the Breeder's instructions. Provide daily exercise and not allow the Dog to become overweight. This is important to protect the Dog's joints and help with a smooth pregnancy and whelp. Provide basic obedience training, including the commands 'come', 'sit', 'leave' and 'down', crate and door manners, good loose lead walking, recall and no jumping up. Taking out pet insurance with Pet Plan (or an insurer or underwriter pre-approved by the Breeder) at a minimum of £7000 per year per condition, life policy (and including third party liability insurance) at the Guardian's expense. Deliver the dog to the Breeder on request (on a minimum of 24 hours notice) for breeding, health testing or any other reasonable purpose. The Breeder will give ample (up to 2 weeks') notice where reasonably possible. Notify the Breeder as soon as possible of all vet visits and sending copies of notes from all vet visits within 7 days of the vet visit, provided that, in the event of serious illness or accident (including but not limited to), severe diarrhoea/vomiting, loss of appetite or weight loss the Guardian must notify the Breeder immediately. If the Dog is male, ensure that he is kept away from in-heat bitches to prevent accidental matings. If the Dog is female, ensure that she is kept away from intact males during her heat cycle (for up to 4 weeks If you move to a different geographical area, the obligations in this agreement will still apply, including, without limitation, the obligation to bring the Dog to the Breeder as and when requested atg the Guardian's expense. If this is not feasible, or if you move to an area outside the UK and the Breeder so requires (in her absolute discretion), the Dog must be returned to the Breeder and this agreement

  • In the event that the Dog does not pass all health tests, ie, hips/DNA testing and any other tests reasonably required by the Breeder (acting reasonably) and will not therefore be used in the HollyRoseFen/Webbs Paws breeding programme, the Guardian will NOT be required to pay the Breeder the purchase price for the Dog, but will be expected to keep the Dog as their pet. If the Dog dies whilst ownership of the Dog is still with the Breeder, the Guardian will pay the Breeder the death payment (ie, the amount equivalent to the purchase price of the Dog), for which the Guardian is obliged under the terms of the Dog's life insurance policy and the ongoing obligations in this agreement will cease. There are inherent risks with any pregnancy/birth and if the Dog dies whilst in the Breeder's possession and care (and whilst ownership of the Dog is still with the Breeder), the Breeder shall provide the Guardian with a replacement Guardian puppy from the next available and suitable litter of HollyRoseFen/Webbs Paws puppies and the parties shall enter into a new agreement. Be willing to adhere to our preferred Millies wolfheart diet unless there is a valid reason, following discussion with the Breeder, not to do so. Be willing to attend puppy training/socialisation classes To take her for regular vet checks and keep up with routine flea and worm treatment, annual vaccinations etc. Maintain good grooming Not leave the dog alone for long periods of time and you must be able to socialise the dog with other animals, children and new experiences regularly. This is very important Understand a female dogs canine cycle and be happy to deal with regular seasons Maintain regular contact with HollyRoseFen with up to date photographs, timing of seasons, any changes or concerns with health and be available to work with us to complete all necessary health tests and attend all dates for her romantic 'dates' with one of our stud dogs. Once in pup, you must be willing to feed her and give prenatal medication as per our instructions, keep us up to date on how she is doing and bring her to us approximately 1 week before she is due to give birth. The Guardian family, in good faith, believes that they will be able and intend to meet the Puppy's Future Health and Welfare Needs.

  • That no member of the Guardian household has been cautioned for or convicted of

    any breach of animal welfare law such as neglect, cruelty or abandonment. They will not breach the terms of any Kennel Club endorsement.

    If the Guardian is in material or persistent breach of this agreement, this agreement

    will terminate and the Guardian must immediately return the Dog to the Breeder.

    If the Guardian needs to give up possession and/or ownership of the Dog for any

    reason during the Dog's life, the Dog shall be returned to the Breeder.

    If the Guardian has the Dog spayed or neutered without the Breeder's prior written consent or otherwise in accordance with this agreement, the Guardian will pay

    damages to the Breeder, the sum of £15,000. The Breeder reasonably believes that

    this sum is the minimum estimate of the actual damages that would be incurred by

    the Breeder in those circumstances. Any legal costs incurred shall be paid by the

    If the Guardian allows the Dog to be bred, either intentionally or accidentally,

    without the written consent of the Breeder, the Guardian will pay the Breeder

    damages equivalent to the open market value of all the puppies in the resulting litter

    (estimated to be between £2,000 and £2,500) per puppy. Any legal costs incurred

    Ifthe Guardian fails to notify the Breeder within 24 hours by phone call or email of a

    female coming into heat on her 2nd season, the Guardian will be required to pay for

    and taker the Dog for regular ovulation testing until the test shows ovulation.

    Unless otherwise stated in this agreement, all costs associated with the Dog are to

    3. The Breeder's obligations in this agreement:

    Choose a HollyRoseFen or Webbs Paws golden retriever puppy, 'pick of the litter', for the Guardian family at no expense to them. Pay all veterinary/laboratory costs, pregnancy scanning etc, pertaining to reproduction. For the avoidance of doubt, the Guardian is responsible for ALL non-breeding expenses including but not limited to grooming, freeding, worming, flea treatment, vaccinations, emergency vet treatment, transport and bortarding when required.

  • Provide information and support on detection and caring for a dog in oestrus (heat) and pregnancy. Provide any reasonable veterinary treatment related to pregnancy. Keep the Guardian up to date on the Dog's progress and wellbeing whilst in the Breeder's care either for matings or to have her puppies. Allow the Guardian to visit the Dog after she has given birth and once the Dog's puppies are over 3 weeks old and provided it doesn't upset or in any way adversely affect the Dog or the puppies. All visits must be on reasonable notice at agreed times and must not exceed any duration reasonably set by the Breeder in the interests of the Dog and her puppies. This agreement shall be Governed by and construed in accordance with the law of England and Wales.
