I understand the Architectural Control Committee will act on this request within thirty (30) days of receipt of this request, or in the time required under the covenants and contact me in writing regarding their decision. I understand and agree that no work on this request shall commence until written approval of the Architectural Control Committee, Board, Association Manager or Agent for such has been received by me. I represent and warrant that the requested changes strictly conform to the community design guidelines found in the recorded Declaration of Protective Covenants and that these changes shall be made in strict conformance with the design guidelines and the Declaration of Protective Covenants. I understand I am responsible for complying with all state, city and county regulations, Declaration of Protective Covenants and have received permits, if necessary, for such work.
Neither the Summer Ridge Homeowners Association Inc., the Summer Ridge Homeowners Association Inc. Board of Directors, Mega Agent Rental Management LLC, the Summer Ridge Homeowners Association Inc. Architectural Control Committee nor their respective members, and any of their successors, assigns, agents, representatives or employees of any of the foregoing, shall be liable in any way for: (i) any failure of structures or improvements to comply with requirements found in the Declaration of Protective Covenants for Summer Ridge, regardless of whether a certificate of compliance has been issued; (ii) any defects in any plans and specifications submitted, revised or approved in accordance with the provisions found in the Declaration of Protective Covenants for Summer Ridge; (iii) any structural other defects in any work done according to such plans and specifications; (iv) any judgment or decision, action or inaction, rendered in order to attempt to carry out the terms set forth in the Declaration of Protective Covenants for Summer Ridge or in carrying out or failing to carry out the responsibilities of the members or agents of the Summer Ridge Homeowners Association Inc. Architectural Control Committee; and (v) any claim that enforcement of the Declaration of Protective Covenants for Summer Ridge constitutes an interference with contractual relations or violates any other law, rule or regulation. All persons submitting any such plans and specifications for Architectural Control Committee approval, and all persons relying thereon, agree not to sue or claim damages of any nature against the Summer Ridge Homeowners Association Inc., the Summer Ridge Homeowners Association Inc. Board of Directors, Mega Agent Rental Management LLC, the Summer Ridge Homeowners Association Inc. Architectural Control Committee, their respective members, and any of their successors, assigns, agents, representatives or employees of any of the foregoing, for any cause of action arising directly or indirectly out of the matters related to a request for Architectural Review and Approval, as is being requested herein, and/or for any decision made by the Summer Ridge Homeowners Association Inc. Architectural Control Committee, the Summer Ridge Homeowners Association Inc. Board of Directors, Mega Agent Rental Management LLC or such other person enumerated in the Declaration of Protective Covenants for Summer Ridge to carry out the terms of the Declaration of Protective Covenants for Summer Ridge, and further agree to and do hereby release Summer Ridge Homeowners Association Inc., the Summer Ridge Homeowners Association Inc. Board of Directors, Mega Agent Rental Management LLC, the Summer Ridge Homeowners Association Inc. Architectural Control Committee, their respective members, and any of their successors, assigns, agents, representatives or employees of any of the foregoing from any and every such cause and further, each Lot Owner making a request for architectural control committee approval as is contemplated herein agrees to indemnify and hold the Summer Ridge Homeowners Association Inc. Architectural Control Committee, the Summer Ridge Homeowners Association Inc., the Summer Ridge Homeowners Association Inc. Board of Directors, Mega Agent Rental Management LLC, their respective members, and any of their successors, assigns, agents, representatives or employees of any of the foregoing, harmless from each and every claim, cost or expense, including, but not limited to, court costs and attorney's fees incurred by the arising directly or indirectly from actions or inactions taken in connection with this request for Architectural Review & Approval and the enforcement of the Declaration of Protective Covenants for Summer Ridge.
