1. What is the Purpose of the Consult?
This NSA Consult is intended to provide you with an opportunity to consult with an attorney regarding the No Surprises Act.
The purpose is not to render a specific definitive legal opinion regarding your specific situation. It may be impossible to fully assess within the time frame allotted for the consultation, for Daniel to fully determine the best course of action for you and your practice.
Instead, this is an opportunity to have your questions answered and receive some guidance and instruction on the NSA.
2. Will Daniel Review or Edit Documents For Me During the NSA Consult?
Regretfully, Daniel cannot review or edit documents during the NSA Consultation. You are free to ask questions in general about documents you may have. However, due to ethical and legal concerns, a thorough review or editing of documents will not be permitted during the NSA Consult.
If you seek a one-time review or assistance with reviewing your documents, you may hire Mayer Law to do so on a limited-scope basis, which we can discuss during the Consult. Work on your documents can be accomplished after completing formal paperwork retaining Mayer Law is completed.
3. Is There a Fee for the NSA Consult?
We know your time is very valuable, and you likely have a very busy schedule, and the time you are meeting with Daniel for the NSA Consultation may be taking place between appointments with your clients. Similarly, Daniel is scheduling time specifically to meet with you for your Consultation, which is not provided to others who may want to meet with Dan.
Therefore, we assess a $425.00 non-refundable fee for the NSA Consultation to cover the time being provided to you for the Consultation.
The Fee shall be placed in Mayer Law's Trust Account and held there until the NSA Consult is completed. At that time, one of two things will happen:
1). Mayer Law will charge the Fee if:
- This is a one-time meeting for consultation on the NSA;
- If you cancel the Consultation within less than 24 hours notice;
- You fail to show up for the Consultation and do not reschedule it.
2). Mayer Law will hold the fee for use toward future legal fees.
However, if you decide to engage Mayer Law to assist further with implementing policies and forms for the NSA, or to otherwise retain Mayer Law as the outside counsel for your practice, we will hold the $425.00 in our Trust Account and credit the Fee toward any future legal fees assessed for legal services. The NSA Consultation will be free for you in that case.
4. How Long is the NSA Consultation?
We typically set aside 55 minutes for the average initial (or only) NSA Consultation.
5. Is the NSA Consultation Held in Person or Virtually?
Due to Covid-19, all consultations will be held using Microsoft Teams or Zoom for the foreseeable future. If you need other arrangements, please let us know in this Intake Form, and we can see what can be done to accommodate you.
6. What Happens After Your NSA Consultation?
After the NSA Consultation, if you decide to retain Mayer Law for further assistance with the NSA or for representation of your practice generally, we can help you set that up.
Although we strive to be the go-to attorneys for healthcare and mental health practitioners in Maryland, we know we may not be the right fit for everyone. We promise---no hard feelings if you decline to move forward with engaging Mayer Law.
If we feel there may be a different attorney who could help you better, and if we can make a referral, we will be happy to do so. Our goal is for every practice and practitioner who meets with us to get help if possible---whether with us or by someone else.
