MODEL RELEASE: I have read and agree to the following statement: I commission Virginia Photos and Films, Christal Marshall, the photographer, to photograph myself and/or my spouse and/or underage children. I hereby grant and understand that Virginia Photos and Films, Christal Marshall may use my images (but not limited too) social media/advertisement etc., and there will be no compensation to the above.*

 

You will be featured if you wish on our IG to market our private studio www.instagram.com/virginiaphotosandfilms and our Facebook Private Group "virginia photos and films private VIP page"

 

 

For branding and headshots, you will also be featured in our business branding account www.instagram.com/virginiamarketingandmedia 

 

PORTRAIT SESSION AGREEMENT & POLICIES: I understand that my session is not confirmed until the retainer is paid. Weather cancellations will be made at the photographers discretions. Tardiness of my session will not delay my session. My session will remain within the scheduled time frame. If I need to reschedule I will give contact prior to 48 hours notice of said reserved session date, otherwise I forfeit transfer of my retainer for a new session date. I will do best to reschedule my session within 2 weeks of original session date. I cannot always guarantee an available date two weeks out but will try my best to accommodate photographers schedule.

By signing (draw your signature) below I certify that I am at least 18 years of age. I have read this portrait agreement/waiver/contract and fully understand the contents thereof. I agree that I have the legal authority to grant these permissions and accept all responsibility for such.

This Personal Injury Waiver (the "Waiver") is made by the undersigned for the purpose of utilizing the facilities and premises managed by Virginia Photos and FIlms (Virginia Marketing and Media LLC, Christal Marshall ) 508 Hillwell Road Chesapeake, VA and in the acknowledgment that in the utilization of the premises and facilities of the Company, occupies risk of personal injury that may arise or happen at any time. In consideration of the Company allowing the undersigned to make use of the venue and its facilities and equipment for the relevant purpose by which the Company allows, the undersigned agrees to assume the foreseeable and unforeseeable risk of personal injuries related to the activity, and agrees to release, discharge, and hold harmless the Company, its owner(s) and employees free from any and all liabilities, claims, cause of action, damages, or losses, which may be incurred by the undersigned in using said premises and its equipment and/or facilities, and which may arise from any reason whatsoever, specifically including, but not limited to, any negligence on the part of the owners, its employees, or losses arising from theft or for any other reason whatsoever.

It is Client’s responsibility to keep several copies of any digital files/ in more than one location, and back the images up on another format such as a hard drive. Once the images are in the hands of the client, it is the client’s responsibility to save the images. Backing up your images is very important.

If you are posting any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram etc.) OR if you share or use any digital files from either Facebook or my website, you may not alter the image in any way (no words or filters added) and you must give credit to @virginiaphotosandfilms or @virginiamarketingandmedia

LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, and the portrait session must take place on the scheduled date, Photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 

CHANGES TO THIS AGREEMENT: There may be additional charges if changes are made to this agreement. Client may increase the period of Photographer’s service on the portrait date, provided Photographer is available during the time requested. Added expenses resulting from such change, including additional service cost, digital capture costs, and change-related retainers will be added on to the final balance and will be paid in full by Client prior to delivery of the proof book. Client may not decrease the period of Photographer’s service on the portrait date. If the period of Photographer’s service is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, Photographer shall still receive the total retainers outlined in this Contract.
