I, {parentFull} hereby acknowledge that I, the parent/legal guardian of the Participant(s), freely and voluntarily wish to participate in “ACTIVITY” the Carvana Arizona Tennis Classic ("Carvana ATC") during the time period February to March 20, 2022. The “ACTIVITY” specifically being Volunteer General or Ball Crew “ACTIVITIES” for the Carvana ATC.
 
I understand that participation in the “ACTIVITY” is completely voluntary; that I am under no obligation to take part in the “ACTIVITY”; that the “ACTIVITY” is provided through Carvana ATC to enhance Participant(s) personal experience; and that NO INSURANCE COVERAGE MAY EXIST THROUGH CARVANA ATC TO COVER ANY CLAIMS OR DAMAGES WHICH MAY ARISE OUT OF PARTICIPANT(s) participation in the “ACTIVITY”. 
 
I shall comply with the stated and customary terms, rules, and conditions for participation in any “ACTIVITY” at Carvana ATC.  In addition, if I observe any hazard during my and or Participant(s) participation, I will immediately bring it to the nearest Carvana ATC representative's attention.
 
I agree and understand that I am solely responsible for picking up Participant(s) after Participant's “ACTIVITY”.  
 
GENERAL VOLUNTEER
In consideration of being allowed to enter onto the premises area at the Carvana ATC and/or participate in any “ACTIVITY” (including, but not limited to, STANDING ORSITTING AT COURT ENTRANCES; STANDING OR SITTING AT EVENT ENTRANCES; STANDING OR SITTING IN TICKET BOOTH; STANDING, SITTING OR DIRECTING VEHICLESAND FANS IN PARKING AREAS; ASSISTING WITH SUPPLIES; ASSISTING IN SEATING; ASSISTING WITH LUNCH OR DINNER SERVICE; ASSISTING WITH NOISE OR CROWDCONTROL; ASSISTING WITH TRASH CONTROL; ASSISTING WITH CHECKING/CONFIRMINSPECTATORS’ TICKETS; ASSISTING WITH THE BALL KIDS/CREW; ASSISTING WITH THEOFFICIALS; ASSISTING THE EVENT STAFF; WALKING TO AND FROM THE VOLUNTEERREPORTING CENTER/PARKING; WALKING TO AND FROM THE DESIGNATED EATING AREA; WAITING FOR ASSIGNED DUTY; WAITING AFTER ASSIGNED DUTY; OTHER GENERAL DUTIES; AND RELATED PARTICIPANT "ACTIVITIES") at the Carvana ATC, the undersigned, on his or her own behalf, and/or on behalf of the Participant(s) identified below, acknowledges, appreciates, and agrees to the following conditions:
 
I am aware that participation in the Carvana ATC as a Volunteer, which may include: the use of the CARVANA ATC GROUNDS/PHOENIX COUNTRY CLUB GROUNDS STANDING OR SITTING AT COURT ENTRANCES; STANDING OR SITTING AT EVENT ENTRANCES; STANDING OR SITTING IN TICKET BOOTH; STANDING, SITTING OR DIRECTING VEHICLES AND FANS IN PARKING AREAS; ASSISTING WITH SUPPLIES; ASSISTANCE IN SEATING; ASSISTING WITH LUNCH OR DINNER SERVICE; ASSISTING WITH NOISE OR CROWD CONTROL; ASSISTING WITH TRASH CONTROL; ASSISTING WITH CHECKING/CONFRIMING FANS’ TICKETS; ASSISTING WITH THE BALL KIDS/CREW; ASSISTING WITH THE OFFICIALS; ASSISTING THE EVENT STAFF; WALKING TO AND FROM THE VOLUNTEER REPORTING CENTER; WALKING TO AND FROM THE DESIGNATED EATING AREA; WAITING FOR ASSIGNED DUTY; WAITING AFTER ASSIGNED DUTY; OTHER GENERAL DUTIES; and other related “ACTIVITIES”, creates a risk of injury to Participant, loss to Participant, or property damage, and I, on behalf of myself and the Participant(s), knowingly and freely assume all risks, including but not limited to, injury, loss or damage(s) due to: any of the above mentioned “ACTIVITIES” while running, walking, sitting, waiting, sitting, or standing; being treated for an injury; weather conditions; food allergies; hit by thrown or struck tennis balls or racquets by others; actions by spectators, players, ball kids/crew, other volunteers or others in attendance; and both known and unknown actions, even if arising from the negligence of others, including the Released Parties (as defined below); and,
 
 
BALL CREW VOLUNTEER
I am aware that participation at Carvana ATC for BALL CREW “ACTIVITIES” which may include but are not limited to: the use of the CARVANA ATC/Phoenix Country Club GROUNDS; BALL RETRIEVAL DURING MATCHES; STANDING WHILE A MATCH IS IN PLAY; THROWING TENNIS BALLS; CATCHING TENNIS BALLS; RUNNING OR WALKING ON THE TENNIS COURTS; RUNNING OR WALKING ONTO THE TENNIS COURTS; OTHER GENERAL NON-BALL CREW AND/OR BALL CREW  TYPE DUTIES AS ASSIGNED; WALKING TO AND FROM THE VOLUNTEER REPORTING CENTER; EATING OR DRINKING IN THE DESIGNATED AREA; WAITING FOR ASSIGNED DUTY; WAITING AFTER ASSIGNED DUTY; and other related “ACTIVITIES”, creates a risk of injury to Participant(s), loss to Participant(s), or property damage, and I, on behalf of myself and the Participant(s), knowingly and freely assume all risks, including but not limited to, injury, loss or damage(s) due to: running, walking, waiting, throwing, catching, sitting, or standing; being treated for an injury; weather conditions; food allergies; hit by thrown or struck tennis balls or racquets by others; actions by spectators, players, ball crews, other volunteers or others in attendance; and both known and unknown actions, even if arising from the negligence of others, including the Released Parties (as defined below); and,
 
I, for myself and the Participant(s) and our respective heirs, assigns, administrators, personal representatives, and next of kin, hereby release and hold harmless: Carvana ATC; Carvana Co,; the Phoenix Country Club; the ATP; the City of Phoenix; medical administrators and or practitioners at “ACTIVITY”; participating players; Sponsors of Carvana ATC; and all the aforementioned principals, volunteers, their affiliates, officers, members, agents, employees, contractors, other participants, and sponsoring agencies (collectively, "Released Parties"); from and against any and all claims, including negligence, injuries, liabilities or damages arising out of or related to participation in any and all Carvana ATC Non-Ball Crew Volunteer “ACTIVITIES” AND OR Ball Crew “ACTIVITIES”.
 
I accept and understand that due to the global pandemic involving COVID-19, by attending this event I am placing myself and the Participant(s) at serious risk of contracting COVID-19, which may lead to serious injury and death. I accept and certify that I do not have any COVID-19-related symptoms, and if I do, I will immediately notify Carvana ATC organizers immediately, and remove myself from the presence of other volunteers. 
 
MEDICAL CONSENT
I represent that Participant(s) is in good health and has no physical conditions that would affect Participant(s)'s the ability and have not been advised otherwise by a medical practitioner.  If such good health and condition were to change prior to the “ACTIVITY” or at any time during the “ACTIVITY”, I agree to promptly inform the Carvana ATC staff and agree to withdraw Participant(s) from the “ACTIVITIES”.  If the Participant(s) has food allergies, I will be fully responsible for providing the Participant(s) with food and drink during the Carvana ATC Event.  If Participant(s) requires medication, I will be fully accountable to provide Participant(s) with the administration of such medicines.  The Carvana ATC Staff have my permission to medically treat in connection with any injury that may arise during the “ACTIVITY”; The Carvana ATC staff has my permission for Participant(s) to receive medical treatment in connection with any injury that may arise during the “ACTIVITY”, and emergency medical treatment for Participant(s) when I cannot be reached or if a delay in reaching me would be dangerous for Participant(s). I understand this may include transport to a local hospital for medical treatment. 
 
I understand that I assume all financial responsibility for any treatment or injury sustained by Participant(s) for medical treatment resulting from Participant(s)'s “ACTIVITIES”. I confirm that I have medical insurance for Participant(s) and that I agree that if Participant(s) becomes ill and or is injured while at Carvana ATC that I will use my personal medical insurance only and will not seek reimbursement from the Released Parties and or the Released Parties' insurance to cover any medical costs for any injury, including loss, and or death and will not seek reimbursement from the Released Parties and or the Released Parties' insurance to cover any medical costs for any injury, including loss, and or death.
 
IMAGE CONSENT
I hereby grant the following rights and permissions to Carvana ATC its successors or assigns, the absolute right and permission to take, use, reuse, publish, and republish images, prints, portraits, or pictures in which the Participant(s) may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations from time to time, in conjunction with Participant(s)'s own or a fictitious name, or reproductions of such images, in color or otherwise, made through any medium, and in any and all media now or hereafter known, including the internet, social media, for art, marketing, solicitations, trade, or any other purpose whatsoever in connection with Carvana ATC. I also consent to the use of any published matter in conjunction with such photographs related to Carvana ATC. I waive any right that Participant(s) or I may have to inspect or approve any finished product or products or the advertising copy or printed matter that may be used in connection with such photographs or the use to which it may be applied.  I further waive any right Participant(s), or I may have to compensation in connection with such images.

I EXPRESSLY AGREE AND INTEND THAT MY PARTICIPATION IN THE “ACTIVITY” SHALL BE UNDERTAKEN BY ME AND THE PARTICIPANT(S) AT OUR OWN RISK AND THAT NEITHER CARVANA ATC, ITS TRUSTEES, OFFICERS, EMPLOYEES, STUDENTS, AGENTS, VOLUNTEERS NOR ASSIGNS SHALL BE LIABLE FOR ANY INJURIES, DAMAGES, CLAIMS, DEMANDS, ACTIONS OR CAUSES OF ACTION WHATSOEVER WHICH MAY ARISE OUT OF OR IN CONNECTION WITH OUR PARTICIPATION IN THE “ACTIVITY”, WHETHER FROM ACTS OF ACTIVE OR PASSIVE NEGLIGENCE ON MY AND THE PARTICIPANT(S) PART AND/OR ON THE PART OF THE “ACTIVITY” OR CARVANA ATC, ITS TRUSTEES, OFFICERS, EMPLOYEES, STUDENTS, AGENTS, VOLUNTEERS, OR ASSIGNS, AND I DO HEREBY AGREE TO FOREVER RELEASE, DISCHARGE, INDEMNIFY, HOLD HARMLESS AND WILL DEFEND CARVANA ATC, ITS TRUSTEES, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS AND/OR ASSIGNS FOR ANY SUCH INJURIES, DAMAGES, CLAIMS, DEMANDS, ACTIONS OR CAUSES OF ACTION.
 
The terms of this Release of Liability are to be governed by and construed under the laws of the State of Arizona. In the event any term or provision of this Release of Liability is found to be unenforceable or void, in the whole or in part, the term or provision concerned shall be construed as valid and enforceable to the maximum extent permitted by law, and the balance of this Release of Liability shall remain in full force and effect. I agree that the exclusive venue for any dispute arising between Carvana ATC and I involving this Release of Liability in any way shall be in Maricopa County, Phoenix.

By signing this Release of Liability form, I acknowledge that I have read and understood the provisions set forth in this Release and voluntarily consent to the terms set forth.
