  • Permit Requirements

    1. Proposed location of the roll-off container on the public street must have been approved by the Prospect Park Police Department.
    2. Applicant shall have notified the Prospect Park Fire Department of the approved proposed container location.
    3. Roll-off container must have the required flashing lights, which must be operating except during daylight hours, and when necessary appropriate barricades must be placed while the container is on the street.
    4. Contractor agrees to indemnify and save harmless the Borough of Prospect Park against any and all claims arising from the placement or use of the roll-off container in the Borough of Prospect Park.

    § 64-1. Permission required for use.

    Anyone contemplating placing a roll-off container on a Borough street shall first obtain written permission from the Prospect Park Police Department and the Prospect Park Fire Department prior to application being given to the Borough clerk. Permission is not required for the temporary use of a borough street during the transfer or replacement of a container on private property.

    § 64-2. Lights and barricades.

    The roll-off container shall be well lighted with flasher lights during hours of darkness. Barricades will be used if necessary.

    § 64-3. Hours of delivery and pickup.

    Containers can only be delivered or picked up between 7:00 a.m. and 5:00 p.m. Monday through Saturday.

    § 64-4. Owner liable for pavement damage.

    The owner of the roll-off container shall be liable for any pavement damage during its placement or removal.

    § 64-5. Effect of issuance.

    Issuance of the permit authorizes a contractor only to deliver a single empty container or pick up the full container, but not to transfer or replace such containers at the approved location.

    § 64-6. Fee for permit; duration.

    The fee for the permit shall be twenty five dollars ($25.00) non returnable, and the permit shall be valid for a seven (7) day period, beginning from the date of application approval.

    § 64-7. Indemnification of borough.

    The owner of the roll-off container and lessee of a roll-off container shall indemnify and save harmless the Borough of Prospect Park against any and all claims arising from the placement or use of the roll off container in the Borough of Prospect Park.

    § 64-8. Violations and penalties. [Amended 11-13-95 by Ord. No. 6- 1995]

    Any person who violates any of the provisions of this chapter shall, upon conviction thereof, be liable to the provisions stated in Chapter 1, Section 1-15, and General penalty provisions.
