Membership Agreement

Welcome to 101 Strength! Sign up for a 7-day trial for $35.00(+gst). If you decide to sign up the cost goes towards your membership. We try to keep our contracts as open (no hidden fees) and flexible as possible, after all, we are a small community and here to help eachother out! 

A one time key fob fee of $50.25 is issued to all gym memberships and any class memberships that would like 24 hour access. 

 

 

 

MEMBERSHIP AGREEMENT

1. If Member is under 18 years of age a parent/guardian must complete consent. 

2. 101 Strength Limited may change membership dues under this agreement by posting notice of such change in the 101 Strength Limited facility at least 30 days in advance of such change.

3. Member agrees to keep and obey all rules and regulations now in force or in the future prescribed by 101 Strength Limited, for the use of the training facilities, premises, and equipment therein, and the 101 Strength Limited reserves the right to revoke this membership for cause if member fails to keep and obey any of such rules and regulations, or for reasons of nuisance, disturbance or other members or staff, moral turpitude or fraud. Without limiting Member's obligation to obey the rules and regulations of 101 Strength Limited presently in force or in the future prescribed, Member agrees that they will obey the following rules by:

a. At all times being considerate of other member's rights and privileges;
b. Paying membership dues on time, bi-weekly - or paying a late fee of $20. If late fee is not paid key fob will be deactivated after 7 days;
c. Unloading all bars and machines when through using them and replacing all weight plates on their proper racks;
d. Always following directions on the proper use of the training equipment and asking for directions when necessary;
e. Always disposing of trash and recycling in the proper places; 
f. Always treating members and staff with fullest respect and courtesy at all times;
g. Always accepting fullest responsibility for any damage done to equipment or facility due to misuse.
h. Always wiping equipment after use.
i. Never using the trap bar on the wooden deadlift platform or the turf.
j. Key fob use is for Members Only. Never allow non-members into 101 Strength Limited, unless a special promotion or permission has been granted by Stephanie Collins at 604-414-8002, a drop in waiver signed and payment arranged.
k. Knowing that security cameras are recording at all times, for the Members, Staff and 101 Strength Limited's safety.                                                        l. Knowing that you are hereby giving 101 Strength Limited permission to take and use photos for promotional purposes. These photos may be printed in but not limited to newspapers, magazines, websites, commercials and other forms of advertising. You agree that these photos are the property of 101 Strength Limited and may be used at any time for promotional purposes. We will ask for your permission first before printing any individual photos. You also agree that any quotes given in surveys will be used for promotional purposes only.           

4. Without limiting 101 Strength Limited’s ability to terminate this membership for cause, 101 Strength Limited may terminate this membership for any reason at the end of any given month. If 101 Strength Limited elects to so terminate, 101 Strength Limited will refund a pro rated portion of any dues applicable to future month(s).

5. MEMBER agrees that they shall not engage in any type of commercial or business activity while using the facilities. MEMBER shall not act as a trainer for any other MEMBER's or guests and any acts which constitute such business activities are strictly forbidden. If MEMBER engages in such commercial or business activities MEMBER’s membership shall be subject to immediate cancellation and the balance of the contract declared due and payable in full immediately.

6. There is a charge of $48 for a key fob upon starting membership, which is non-refundable at the end of membership. If key fob needs to be replaced because of loss or stolen. Please report immediately if loss. A replacement fee of $8.50 will be charged to member for loss/stolen fob.

7. Members can request Contract Freeze for minimum 30 days -90 days maximum, due to school, long vacations, financial stress, injury/illness, or other valid reason permited by Stephanie Collins. No refunds will be granted if withdrawl occurs before notice.  

8. It is expressly understood and agree that this contract is not assignable or transferrable by Member and no rights or privileges granted by this membership can be transferred or assigned by Member.

9. It is further agreed that all exercises including the use of weights, number of repetitions, and use of any and all machinery, equipment, and apparatus designed for exercising and the use of 101 Strength Limited’s premises and facilities shall be at the Member's sole risk. Not withstanding any consultation on exercise programs which may be provided by 101 Strength Limited employees or agents, it is hereby understood that the selection of exercise programs, methods and types of equipment shall be Member's entire responsibility, and 101 Strength Limited shall not be liable to Member or Member's family for any claims, demands, injuries, damages, or actions arising due to injury to Member's person or property arising out of or dismembership, or death for any reason at the end of any given month. If 101 Strength Limited in connection with the use by Member of the services and facilities of 101 Strength Limited or the premises where the same is located. If Member brings any personal property onto the premises of 101 Strength Limited or onto 101 Strength Limited’s parking area, Member takes such action at Member's sole risk. It is hereby understood that 101 Strength Limited is not responsible in any way for damage to or loss of any personal property which Member brings onto the premises of the 101 Strength Limited or onto 101 Strength Limited’s parking area, including but not limited to, losses due to theft, damage, or car accident. Member hereby holds 101 Strength Limited, its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by Member, on Member's behalf, by Member's family, and Member's executors, administrators, and personal representatives for any such injuries or claims aforesaid and Member for himself and on behalf or his family, executors, administrators, and personal representatives does hereby forever release and discharge 101 Strength Limited, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.

(1) NOTICE TO PURCHASER: DO NOT SIGN THIS CONTRACT UNTIL YOU READ IT OR IF IT CONTAINS BLANK SPACES.

MEMBER ACKNOWLEDGES RECEIPT OF A FULLY COMPLETED COPY OF THIS AGREEMENT EXECUTED BY BOTH 101 STRENGTH LIMITED AND MEMBER AND ACKNOWLEDGES THE AGREEMENT TERMS.

 

Cancelation Policy

CONSUMER RIGHT OF CANCELLATION: This Agreement is a contract to which the Act applies. Accordingly:

(1) The MEMBER may cancel this Agreement for any reason by giving notice of cancellation to 101 STRENGTH LIMITED not later than 7 days after the date that the MEMBER starts membership trial,

(2) The MEMBER may cancel this Agreement by giving notice of cancellation and the reason for the cancellation to 101 STRENGTH LIMITED at any time if there has been a material change (a) in the MEMBER’s circumstances or (b) in the services provided by 101 STRENGTH LIMITED (For the purposes of the foregoing paragraph 2(a), a material change in the MEMBER’s circumstances includes, without limitation, (a) the MEMBER’s death, (b) a physical, medical or mental disability, substantiated in writing by a medical practitioner or nurse practitioner, showing that the MEMBER’s continued participation is unreasonable because of the MEMBER’s condition or is likely to endanger the MEMBER’s health or (c) the MEMBER’s relocation for the remainder of the duration of this Agreement, or the remainder of the time stated in this Agreement. so that the distance between the MEMBER and 101 STRENGTH LIMITED is more than 30 km greater than when the MEMBER and 101 STRENGTH LIMITED entered into this Agreement, if 101 STRENGTH LIMITED does not provide reasonably comparable alternative facilities for the MEMBER’s use not more than 30 km from the MEMBER’s new location. For the purposes of the foregoing paragraph 2(b), a material change in the services provided by 101 STRENGTH LIMITED occurs (a) when, for reasons that are wholly or partly the fault of 101 STRENGTH LIMITED, the services are not completed, or at any time 101 STRENGTH LIMITED appears to be unable to reasonably complete the services within the period of time stated by 101 STRENGTH LIMITED, (b) when the services are no longer available, or are no longer substantially available as provided in the Agreement, because of 101 STRENGTH LIMITED discontinuance of operation or substantial change in operation or (c) when 101 STRENGTH LIMITED relocates so that the distance between 101 STRENGTH LIMITED and the MEMBER is more than 30 km greater than when the OPERATOR and the MEMBER entered into this Agreement, and the OPERATOR does not provide reasonably comparable alternative facilities for the MEMBER’s use not more than 30 km from the MEMBER’s location.); and (3) Following renewal of the initial term of this Agreement on a month-to-month basis, if applicable, the MEMBER will have the right to cancel this Agreement (a) at any time, (b) upon giving 30 days’ written notice of cancellation to 101 STRENGTH LIMITED (c) without giving reasons for the cancellation and (d) without cost. If the MEMBER elects to cancel this Agreement pursuant to paragraphs (1) or (2) above, 101 STRENGTH LIMITED will, within 15 days after the notice of cancellation has been given, provide the MEMBER with a refund in accordance with the Act.

ADDITIONAL CANCELLATION POLICIES: In addition to the MEMBER’s rights of cancellation set forth above: (1) if a move is less than 30 km from the MEMBER’S original location, but not less than 12 km, a fee of $50 + applicable taxes will be assessed (2) the MEMBER may cancel this Agreement for any other reason and at any time upon written 30 days notice to 101 STRENGTH LIMITED and by paying a cancellation fee of 2 bi weekly payments; and (3) 101 STRENGTH LIMITED may cancel this Agreement at any time, for any reason, upon giving the MEMBER 30 days’ written notice (except that 101 STRENGTH LIMITED may terminate this Agreement immediately, without notice, in the event of the MEMBER’s gross misconduct, including breach of any of the material terms or conditions of this Agreement or material 101 STRENGTH LIMITED policies). Should the 101 STRENGTH LIMITED terminate this Agreement for any reason other than the MEMBER’s gross misconduct, including breach of any of the material terms or conditions of this Agreement or material 101 STRENGTH LIMITED policies, a pro-rated portion of any prepaid dues or processing fees will be refunded to the MEMBER. Should 101 STRENGTH LIMITED terminate this Agreement due to the MEMBER’s gross misconduct, including breach of any of the material terms or conditions of this Agreement or material 101 STRENGTH LIMITED policies, then the MEMBER will remain responsible for the financial obligations of this Agreement.

NOTICE OF CANCELLATION: For the purposes of this Agreement and in particular the foregoing provisions titled “CONSUMER RIGHT OF CANCELLATION” and “ADDITIONAL CANCELLATION POLICIES”, where “notice of cancellation” or “written notice” may be given by the MEMBER or 101 STRENGTH LIMITED, such party may give such notice by any method that permits a person to produce evidence that the MEMBER or 101 STRENGTH LIMITED, as applicable, cancelled the Agreement on a specific date, including (1) delivering the notice in person and (2) sending the notice by registered mail to #101-7373 Duncan Street, Powell River, B.C. V8A 1W6. For certainty, if the MEMBER gives notice of cancellation in accordance with the foregoing by any method other than in person then the notice of cancellation will be deemed to have been given at the time it is sent.

AUTO RENEWAL PROGRAM
Provided MEMBER is not in default of this Agreement and subject to the terms and conditions hereof, and subject to 101 STRENGTH LIMITED policy the membership will automatically renew at the rate indicated above as of the anniversary date. Renewal terms may be cancelled provided written notice is delivered to 101 STRENGTH LIMITED, including (1) delivering the notice in person and (2) sending the notice by registered mail to #101-7373 Duncan Street, Powell River, B.C. V8A 1W6. Automatic Renewal rates are guaranteed provided eligibility requirements continue to be met. On the 18th month of consecutive membership, the member will receive the best rate available at the time of sign up.

MEMBERSHIP FREEZE

You may freeze time on your membership for a medical reason/or any other reason Stephanie Collins finds valid. Freezes can be from 30 to 90 days at a time. We may ask for documentation to verify your situation. Freezing time on your membership does not stop your membership payments. You are still liable for your original payment schedule. Once you resume any usage of 101 Strength Limited, the freeze will terminate. Time of any freeze will be credited to the end of your membership’s original term. 

I recognize that participating at 101 Strength Limited may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in 101 Strength Limited. I acknowledge that my participating in 101 Strength Limited is purely voluntary and is in no way mandated by 101 Strength Limited. In consideration of my participation in 101 Strength Limited, I hereby release 101 Strength Limited and its agents from any claims, demands, and causes of action as a result of my voluntary participation in 101 Strength Limited. I fully understand that I may injure myself as a result of my subsequent participation in 101 Strength Limited and I hereby release 101 Strength Limited and its agents from any liability now or in the future for conditions that I may obtain. These conditions may include, but are not limited to, heart attacks, strokes, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, injuries to knees or other joints of the body, injuries to back, injuries to a foot, heat prostration, or any other illness or soreness that I may incur, including death.

I HAVE READ AND UNDERSTAND THE ABOVE STATED POLICIES AND  PROCEDURES ABOUT 101 STRENGTH LIMITED, AND I AGREE TO ABIDE BY THEM.

AS A PARENT OR GUARDIAN OF A MINOR, I HEREBY AGREE TO BE FULLY RESPONSIBLE FOR ANY AND ALL ACTIONS, DAMAGES, INJURIES, LOSS TO PROPERTY OR PERSON, PERFORMED BY MINOR WITH OR WITHOUT MY SUPERVISION IN 101 STRENGTH LIMITED. I FURTHER AGREE THAT ANY INFRACTIONS OF 101 STRENGTH LIMITED'S POLICIES ON THE MINOR'S PART MAY CONSTITUTE LOSS OF MINOR'S AND/OR MY MEMBERSHIP PRIVILEGES.

I HEREBY AGREE TO ALL TERMS OF THIS CONTRACT, INCLUDING FEES, REASONABLE COLLECTION FEES, COURT COSTS, ATTORNEY FEES WITH ANY UNPAID BALANCES ACCORDING TO THIS CONTRACT.
