Terms and Conditions for Qualification Enrolment
These Terms and Conditions form the agreement between Malearn Limited (“we”, “us”, “our”) and the learner (“you”, “your”) enrolling on a qualification or training course. By enrolling, you accept the following:
1. Enrolment & Eligibility
· You must provide accurate and complete information at enrolment.
· Proof of identity (e.g., passport, driving licence, or birth certificate) may be required to confirm your details for awarding body registration.
· Acceptance onto a qualification is at our discretion and subject to meeting entry requirements.
2. Fees & Payments
· Course fees are payable in full at enrolment, unless an instalment plan has been agreed in writing.
· Instalment plans must be paid on the agreed dates; failure to pay may result in suspension or withdrawal.
· Fees are non-transferable.
· Awarding body registration fees are included unless otherwise stated.
3. Refunds & Cancellations
· Learners have the right to cancel within 14 days of enrolment and receive a full refund, provided they have not been registered with the awarding body or accessed course materials.
· Once awarding body registration has been processed (e.g. 31 August) or the learner has attended the first session (e.g. 6 September), no refund will be given.
· Fees are non-transferable to another learner or course, except at Malearn’s discretion.
· If Malearn cancels a course, a full refund or transfer to another date will be offered.
4. Learner Responsibilities
· You agree to attend scheduled sessions, complete assignments, and participate in assessments as required.
· You are responsible for maintaining professional behaviour and respecting staff, other learners, and facilities.
· You must inform us promptly of any changes to your contact details, medical needs, or support requirements.
5. Malearn Responsibilities
· We will deliver high-quality training, assessment, and support in line with awarding body requirements.
· We will register you with the awarding body (where applicable) and provide assessment opportunities.
· We will provide reasonable adjustments where required under the Equality Act 2010.
6. Attendance & Progression
· Consistent attendance is required for successful completion.
· Missed sessions must be reported in advance where possible.
· Progress reviews will be carried out; lack of engagement may lead to withdrawal.
7. Assessment & Certification
· All assessments must be completed within the specified timeframe.
· Extensions may be granted in exceptional circumstances with supporting evidence.
· Certificates will only be issued upon full completion of the course and settlement of all fees.
8. Data Protection
· Your personal data will be processed in line with the Data Protection Act 2018 and GDPR.
· We may share information with awarding bodies, regulators, and funding partners as required.
· Records are kept securely and only for as long as necessary.
9. Complaints & Appeals
· If you are dissatisfied with any aspect of your course, you should first raise it with your tutor/assessor.
· Formal complaints can be submitted via our Complaints Policy.
· Assessment appeals will follow the Malearn Appeals Procedure.
10. Termination of Enrolment
· We reserve the right to withdraw you from the course if:
· - Fees are unpaid.
· - You breach these Terms & Conditions or our policies (e.g., safeguarding, code of conduct).
· - You fail to engage with learning and assessment.
11. Governing Law
· These Terms and Conditions are governed by the laws of England and Wales.

By signing the enrolment form (or completing electronic enrolment), you confirm that you have read, understood, and agree to these Terms and Conditions.
