    PART ONE: INTRODUCTION
  • (A). For the purpose of this document, [participant], is hereby identified as the individual / s whom are filling out the iSUP Saugeen Excursion Participant Agreement Form and who are intending to participate in iSUP excursions, lessons, fitness, sessions and/or activities hosted by iSUP Saugeen. 

  • (B). I, [participant], understand that assumption of risk and release of liability via a unilateral hold harmless clause is required to participate in any iSUP Excursion with iSUP Saugeen. For the purpose of this document “iSUP Saugeen” refers to 13725855 Canada inc. operating as iSUP Saugeen. 

  • (F). I, [participant], understand that in order to protect the health and safety of all participants, iSUP Saugeen reserves the right to decline any individual who, during the screening process, for whatever reason, exhibits a lack of competency and capability when participating with safe boating practices. 

  • (G). I, [participant], understand that life jackets are mandatory when being on or in close proximity to any body of water. 

  • (H). I, [participant], understand that iSUP Saugeen reserves the right to decline any participant who, for whatever reason can not be or is not willing to be fitted into a life jacket that is appropriate and safe.

  • (I). I, [participant], understand that iSUP Saugeen reserves the right to dismiss any individual whose participation, for whatever reason exhibits a risk to themselves or other participants.

  • (J). I, [participant], understand that iSUP Saugeen reserves the right to dismiss any individual whose participation, for whatever reason interferes with other participants reasonable enjoyment of the event.

  • (K). I, [participant], understand that iSUP Saugeen reserves the right to dismiss any participants whose participation, for whatever reason exhibits a risk to the waterway, wildlife, and surrounding habitats.

  • (L). I [participant], agree to be 100% compliant with the small vessel regulations. iSUP Saugeen activities are classified as a guided excursion by Transport Canada; meaning activities are a non-competitive outdoor recreational activity or excursion led by a person in charge of the activity or excursion during which the participants use a human-powered vessel. Safety equipment is required by law. 

  • PART TWO: POTENTIAL RISKS AND RELEASE FROM LIABILITY

     

  •  Statement of Risk:

    At iSUP Saugeen, your health, safety, and enjoyment are our primary concerns. We want you to have fun but we also want you to be safe! It is important to inform participants in advance that there are significant elements of risk that exist in any event where you are exposed to the outdoors. These risks may include, but are not limited to, loss or damage to personal effects, personal injury, death or disappearance.

  • (B). I, [participant], understand that swimming ability, boating experience, overall competency and comfort level are all relevant to safety.

  • (C). Acknowledgement of Risk:

    I, [participant], acknowledge that watersports and marine activities include, but are not limited to the following risks: cold water shock, changing tides, changing water depths, wild life, undertows, currents, waves and wave action from watercraft wakes; Possible collision with other watercraft, swimmers, man-made objects, natural objects and floating objects; Wind shear, wind direction changes, bad weather, heat exhaustion, exposure to the elements, and temperature changes; I understand that my sense of balance, ability to understand and follow instructions and my ability to adequately prepare for outdoor events are relevant to my own safety; Capsizing, sinking, impact with water surfaces, potential injury caused by rescue or rebourding techniques and other hazards that may result in serious injury, hypothermia, hyperthermia or drowning; Slipping or falling when getting in or out of watercraft; Injuries sustained while traveling to and from the activity; The presence of unpredictable behaviour of insects and marine life; Equipment failure and operator error; Heat and sun-related injuries or illnesses such as sunburn, sunstroke, and dehydration; Fatigue, chills and dizziness which may reduce reaction time and increase the risk of accident. I further acknowledge that iSUP excursions may include the potential risk of serious injury or death, and I understand that the above mentioned risks do not constitute a complete list: unknown, unanticipated, and unforeseeable risks exist.

  • (D). I, [participant] understand that the iSUP excursions are outdoor activities where I am responsible for determining my ability and needs. I understand that it is my responsibility to bring any supplies I may need for my enjoyment, comfort and health during these events. ie. appropriate gear/clothing that takes into consideration weather and water conditions, beverages, snacks, towels, change of clothes, cellpone, camera, sunscreen, hat, sunglasses, exc.

  • (E). I, [participant] understand that waterways in Ontario are sill frigid cold in the Spring and even into the early Summer. I [participant] are aware of and assume the risks relevant to cold water and cold water shock.

  • (F). I, [participant] understand that iSUP Saugeen reserves the right to decline participation to individuals who, for whatever reason, are not dressed appropriately or whose gear/clothing of choice poses a risk to themselves or others.

  • (G). Release of Liability:

    I, [participant], understand that by signing this document I hereby agree to enter a unilateral hold harmless clause between myself and iSUP Saugeen and Amy Caperchione. As a result, I, [participant], understand that iSUP Saugeen and Amy Caperchione is to be released from any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released parties due to injury, loss, disappearance, or death.

  • (H). I, [participant] knowingly and willingly accept all the potential risks of participating and agree to release and or indemnify iSUP Saugeen and Amy Caperchione from any unforeseen circumstances that I may be involved that may lead to any injury, loss or damage to personal effects, death, or disappearance.

  • (I). I, [participant], understand that upon signing this document Amy Caperchione and iSUP Saugeen shall have no liability of any kind for any and all damages and injuries that may occur to me and other persons or properties as a result of my participation in any activity relevant to iSUP Saugeen excursions. 

  • PART THREE: TERMS OF PARTICIPATION

     
    (A). iSUP Saugeen polices reflect the Transport Canada Rental Boat Safety checklist to ensure competency and secure safety standards. In addition, iSUP Saugeen also uses the Transport Canada Safe Boating Guide as a reference to secure industry specific safety standards and updated regulations.

  •  I, [participant] agree that the use of a life jackets or PFD and other mandatory safety equipment is not negotiable. As stated in the department of transport Canada small vessel regulations for guided excursions; life jackets and other safety equipment is required by law.

  • (B). In terms of the iSUP Saugeen excursions life jackets and safety equipment are supplied. All life jackets are approved by the department of Transport Canada. iSUP Saugeen ensures that lifejackets are tested for in-water performance after each use. I [participant] agree that, use of the jacket is implying that you consent to the details outlined on the jackets themselves; (the life jacket details can be found in the drop down menu of our website http://isupsaugen.ca go to “online Catalogue” scroll down to Stearns & Fluid & Body Glove and click the “lifejacket details” link).  

  • (C). I, [participant], agree that, “misuse and negligence” is here by being defined as any action or event that fails to adhere to, or disregards the terms of use and safe boating practises outlined within this policy and the Department of Transport Canada. Damage occurring under Ordinary use is considered to be classified as accidental incidents and can be remedied as such.

  • (D). I, [participant], understand that there is endangered wildlife and species at risk living in habitats all around Canada’s waterways. I agree to respect and protect Canada’s waterways, wildlife and surrounding environments.

  • (E). I, [participant], agree to partake in use of the iSUP rental equipment in a way that takes reasonable care and consideration for the safety / security of myself, other persons, rental equipment, and the environment.

  • (F). I, [participant], understand that the maximum inflation pressure for iSUP Saugeen rental equipment is 15psi. I agree that failure to monitor inflation is a form of neglect & misuse. Over-inflation leads to damage. In addition, I [participant], also agree that over-inflation is also a form of neglect and misuse.

  • (G). Misuse of the iSUP creates unpredictable risks that are potentially capable of inflicting serious personal injury, disappearance, or death, as well as potential loss or damage to personal property. Knowing there terms I, [participant], agree to assume all financial liability and will also assume all and any financial costs associated with my actions.  I agree to these terms.

  • (H). iSUP Saugeen has a Zero Tolerance policy for unsafe boating practice and this includes but is not limited to; unsupervised minors, boating unprepared, misuse of rental equipment, boating without WEARING a life jacket, exceeding weight capacity, littering, destruction of habitats, inflicting deliberate damage to property, boating under the influence of drugs and / or alcohol, and any and all actions that disregard or neglect the policies here listed by iSUP Saugeen and The Department of Transport Canada’s small vessel regulations.   I, [participant], agree that I am fully responsible for any and all incidents that may arise from disregarding or neglecting marine safety standards, the iSUP Saugeen policies, and / or Canadian laws and bylaws.

  • (I). I, [participant], agree to release iSUP Saugeen and Amy Caperchione from any and all liability that may be a result of my unforeseen negligence and agree to release iSUP Saugeen and Amy Caperchione from any legal or financial repercussions that may be a result of any of the above stated incidents.

  • (J). IN THE EVENT OF DAMAGED, LOST, OR STOLEN EQUIPMENT I, [participant], agree that, if I cause damage to any of the equipment as a result of my negligence or misuse i hereby agree to fully and completely reimburse Amy Caperchione and iSUP Saugeen upon damage occurring for any damage to rental equipment that has occurred as a result of my misuse or negligence.

  • (K). iSUP Saugeen has a Zero Tolerance for violence, harassment or any degrading / offensive comments and behaviour. As a result, I, [participant], understand that iSUP Saugeen reserves the right to decline service to any individuals who disregards these terms.

  • (L). I, [participant] understand that iSUP Saugeen reserves the right to decline rental or service to any individual who is a minor without signed parental consent.

  • PART FOUR: OPTIONAL CONSENT

    (A). I, [participant], understand that, by signing this section that I am giving consent to iSUP Saugeen to share images from my session on social media and company website; Instagram @isup.saugeen and Facebook at iSUP Saugeen and iSUPsaugeen.ca for marketing purposes without compensation. I understand I have the option to decline signing part 4a.

  • (B). I, [participant], understand that by signing this section I am giving my consent for iSUP Saugeen and Amy Caperchione to contact me about customer rewards programs, invoices, reservations, or anything relevant to iSUP Saugeen. I understand I have the option to decline signing part 4b.

  • (C). I [participant], understand that Amy Caperchione and or iSUP Saugeen Personnel are qualified to administer AED, CPR and First Aid to adult, children, and infant casualties. In the event where I am unconscious, injured, in a state of shock, or unable to breathe I hereby give Amy Caperchione consent to administer First Aid, CPR, and or AED to completion and give her permission to follow up accordingly with emergency responders and first aider responsibilities. I understand I have the option to decline signing part 4c.

  • PART FIVE: AGE REQUIREMENTS, MINORS, AND RELEASE OF LIABILITY.


    (A). As of January 2022, The Department of Transport Canada classifies SUP & iSUP as a human-powered watercraft / human-powered pleasure craft & has no minimum age regulation for use. Although there is no minimum age regulation at this time; this information is subject to change. Transport Canada is always updating regulations so check their website regularly. In Ontario Canada anyone under the age of 18 is classified as a minor. I, [participant], understand that iSUP is not recommended for ages 10 and under. 

  • (B). In terms of the iSUP Saugeen activies I, [participant], agree that I am responsible for monitoring any minors who I bring to the events and or whom are in use of the equipment on or near the water and agree that I am responsible for supervising said minor/s for the duration of the excursion.

  • (D). I, [participant], understand that experience, ability and swimming skill are all relevant aspects of iSUP safety and agree to uphold my responsibility of ensuring that any minor participating with equipment is competent, able, and using the applicable safety equipment at all times when using the iSUP equipment.

  • (E). I, [participant], agree that I am responsible for any unforeseen damage to rental equipment, that is caused by a minors misuse or negligence.

  • (F). I, [participant] hereby agree to release Amy Caperchione and iSUP Saugeen from all liability that may be a result of any unforeseen actions taken by the relevant minor.

  • (G). I, [participant], hereby agree that I am responsible for any financial or legal repercussions that may be a result of unforeseen actions taken by, or involving a minor who is in use of iSUP Saugeen equipment.

  • (H). I, [participant], agree that a PFD or life jacket is NOT a substitute for adult supervision and agree to supervise any minor who is in use of the equipment or at all times when boating or being on or near the water.

  • (I). I, [participant] understand that any minor who, for whatever reason can not be fitted into an appropriate life jacket are not permitted to participate. 

  • (J). I [participant], understand that Amy Caperchione and or iSUP Saugeen Personnel are qualified to administer AED, CPR and First Aid to adult, children, and infant casualties. In the event where the undersigned minor becomes unconscious, injured, in a state of shock, or unable to breathe I hereby give Amy Caperchione and or iSUP Saugeen personnel consent to administer First Aid, CPR, and or AED to the undersigned minor to completion and give permission to follow up accordingly with emergency responders and first aider responsibilities. I understand I have the option to decline signing part Part5, J.

  • DATES SUBJECT TO CHANGE

    In order to limit potential risk, the iSUP Saugeen Excursions will only be launching in level 1 or 2 rapids; the events are completely reliant on the weather and water conditions; the flow of the river, water level, and current state of the event locations will determine if we launch.
