Summer Camp Terms and Conditions
Cancellation, Refund, and Credit Policy: Cancellations must be made by email to info@inspirebehavior.com or by phone call at 510-296-5519, specifying the session date to cancel and the name of your child/ward. Inspire Behavioral Learning, LLC ("the Company") summer camp purchase fees are refundable for cancellations made through May 31st, 11:59 PM PDT. All cancellations made after that time are nonrefundable. If you cancel your child’s participation in any Company camp session after May 31st, 11:59 PM PDT but at least 24 hours before the session start date, you will receive 100% credit to use on any Company camp or tutoring session for the same calendar year. If you have registered, and your preferred camp location closes, another location will be offered to you pending space availability, or a refund will be made. If Company needs to close a camp or stable group because of a COVID-19 exposure, state or county mandated closure, or for any other reason, families will have the option to (1) transfer to a camp session later in the year; (2) receive a prorated credit based on the remaining days in their session; or (3) except for closure due to force majeure events, receive a prorated refund based on the remaining days in their session. A no-show is defined as your child/ward not attending camp, without a cancellation made by the start time of a registered camp date. No-shows are nonrefundable. No credit or refund in full or in part will be issued for a no-show. A camp expulsion is defined as your child/ward being removed from camp and prohibited from camp attendance. Camp expulsions are nonrefundable. No credit or refund in full or in part will be issued for a camp expulsion. Processing fees charged by PayPal or Venmo are nonrefundable.
Force Majeure ("Greater Force"): camp session times may be canceled or altered due to force majeure events, including but not limited to: (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, infestations), park closure during Red Flag Warning, epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of camp registration; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. Due to force majeure events being unpredictable and out of the Company's control, no refunds will be provided for cancellation or alteration of camp session times; however, families will have the option to (1) transfer to a camp session later in the year or (2) receive a prorated credit based on the remaining days in their session.
Health and Safety Policies: I agree to cancel my child's or ward's participation in camps while my child/ward shows symptoms of or is diagnosed with COVID-19 or any other contagious illness. I acknowledge that the same cancellation, refund, and credit policy above applies to cancellations in the event of illness.
Prerequisites for Camp Registration and Attendance: in order to attend the Company's camps, my child/ward and my child's/ward's parents/guardians must meet all of the following prerequisites: (1) Hiking Experience: my child/ward has previous experience hiking on their own two feet on varied terrain for at least three miles spaced out over the day; (2) Appropriate Clothing, Items, and Gear: my child will come to camp with appropriate clothing and gear for the weather and outdoor conditions, water, and enough food for lunch and two snacks; (3) Respect for Diversity: my child/ward and my child's/ward's parents/guardians respect diversity in the Company's camps by refraining from bigoted or discriminatory behavior against protected classes, including but not limited to refraining from ableism, racism, sexism, ageism, and any other kind or form of bigoted or discriminatory behavior against, towards, or in the presence of campers, Company staff, or park visitors; (4) Safety and Respectful Behavior: my child/ward and my child's/ward's parents/guardians engage in safe and respectful behavior; respect personal space boundaries and property; refrain from aggressive behavior or harassment against, towards, or in the presence of campers, Company staff, and park visitors in physical, gestural, oral, written, visual, or any form and for any reason, including but not limited to refraining from violent, destructive, threatening, abusive, demeaning, belittling, disruptive, antagonistic, vulgar, profane, lewd, indecent, or obscene conduct; my child/ward and my child's/ward's parents/guardians follow all seven leave no trace principles at camp, including but not limited to traveling on durable surfaces, disposing of waste properly, leaving what you find, respecting wildlife, and being considerate of others; my child/ward will follow instructions and rules to stay with the camp group and within eyesight of camp staff during camp sessions; and (5) my child/ward and my child's/ward's parents/guardians refrain from asking, instructing, or inciting any person to violate camp prerequisites and rules at camp. I acknowledge that by registering my child/ward in the Company's camps, I certify that my child/ward meets all prerequisites for registration and attendance. I further acknowledge that my child/ward will be expelled from any or all registered camps without refund at the Company's sole discretion in the event of my child's/ward's or any one of my child's/ward's parents’/guardians’ failure to meet any one of the prerequisites for registration and attendance.
AUTHORIZATIONS, ASSUMPTION OF RISK, LIABILITY WAIVER, AND INDEMNIFICATION
Attestation: I hereby attest that I am the adult parent or guardian of the above named child, a minor child under the age of eighteen (18) years. I attest that I am over eighteen (18) years of age and I warrant that I have legal authority to execute this agreement on behalf of my child or ward. I attest that my child or ward is physically fit and prepared for Inspire Behavioral Learning, LLC ("the Company") events and all related activities in its camps. I grant full permission for the Company, its officers and directors, partners, employees, agents, interns, and volunteers (“Releasees”) for the following authorizations.
Medical Authorization: The Company takes every precaution to ensure the authorization granted on this form will be used only when necessary. The Company will make every attempt to first contact the parent/guardian to make medical care decisions unless the situation calls for immediate professional medical care. I hereby give permission for my child or ward to take part in all activities led by the Company staff. In case an emergency happens at any point between sign in and sign out of the program, I hereby authorize any of the staff, employees, agents and representatives of the Company to provide for, approve, and authorize for my child or ward, any health care at any hospital, emergency room, doctor's office or other institution, employ any physicians, dentists, nurses or other person whose services may be needed for such health care, review and if necessary disclose the contents of any medical records, execute any consent form required by medical, dental or other health authorities incident to the provision of medical, surgical, or dental care to the child. Health care shall include, but not be limited to the administration of anesthesia, x-ray, examination, performance of operations, diagnostic and other procedures. I hereby further authorize emergency transportation by either the Company personnel or if necessary by ambulance or other emergency vehicle. If there is no medical emergency, the Company staff will first use reasonable efforts to contact the parent(s) and/or guardian(s) before administering or authorizing any treatment. I understand that the Company shall have no responsibility to pay for medical treatment and related costs if my minor child or ward is injured while receiving services from the Company.
Photo/Video Release: I hereby authorize the Company and its affiliates, successors and assigns, to display, publicly perform, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, otherwise use and permit others to use, reproduce, and/or publish any photographs, video, and/or audio that may pertain to my child or ward, including my child or ward's image, likeness and/or voice without further compensation or permission. I understand that this material and/or related quotations may be used in various publications, public affairs releases, recruitment materials, promotions, accounts, broadcast public service advertising (PSAs) or for other related endeavors. This material may also appear on the Company's or a project sponsor's Internet Web Page. This authorization is continuous and may only be withdrawn by my specific rescission of this authorization. Consequently, the Company or a project sponsor may publish materials, photograph, and/or make reference to me in any manner that the Company or project sponsor deems appropriate in order to promote/publicize service opportunities. I hereby waive my right of publicity in connection with such uses.
ASSUMPTION OF RISK: Physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The Company may engage my child or ward in physical activities such as walking, hiking, climbing, running, aerobic activities, and sporting activities with exposure to varying weather outdoors and uneven outdoor terrain. Some of these activities involve strenuous exertions of strength using various muscle groups, some involve quick movements involving speed and change of direction, and others involve sustained physical activity which places stress on the cardiovascular system. The specific risks vary from one activity to another, but the risks include property loss or damage, illness, heatstroke, and minor injuries such as scratches, bruises, and sprains to major injuries such as eye injury or loss of sight, joint or back injuries, concussions, and dismemberment to catastrophic injuries including paralysis and death. I hereby assert that my child or ward’s participation is voluntary and that I know, fully understand, and assume such risks that are inherent in the activities made possible by the Company.
LIABILITY WAIVER: In consideration of permission for my child or ward to participate in the Company's physical activities and camps, I for myself, my heirs, personal representatives or assigns, do hereby covenant not to sue, and RELEASE, WAIVE, AND DISCHARGE from liability the Company, its trustees, officers and directors, agents, servants, employees, interns, and volunteers from any and all claims including the negligence of the Company resulting in personal injury, accidents or illnesses including death, and property loss arising from, but not limited to, participation in activities, classes, camps, and use of equipment.
INDEMNIFICATION: I agree to INDEMNIFY, RELEASE AND HOLD HARMLESS the Company, its trustees, officers and directors, agents, servants, employees, interns, and volunteers from and against any and all present or future claims, causes of action, suits, procedures, costs, expenses, loss including attorney’s fees, damages, or liability for injury to person or property which my minor child may suffer or for which said minor child may be liable to any other person, related to said minor child’s participation in the Company’s services, resulting from any cause whatsoever and regardless of fault. This includes any claim of the minor and any claim arising from the negligence of the Releasees.
ACKNOWLEDGEMENT OF UNDERSTANDING: I have read this Assumption of Risk, Liability Waiver, and Indemnification and fully understand their terms, and I understand that I am giving up substantial rights, including my right to sue. I, the undersigned, further expressly agree that the foregoing assumption of risks and liability waiver are intended to be as broad and inclusive as is permitted by the laws of the State of California and that if any portion thereof is held invalid, I agree that the balance shall, notwithstanding, continue in full legal force and effect. I acknowledge that I am signing this agreement freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. Knowing the risks described above, I agree, personally and on behalf of my minor child or ward named above, to assume all the risks and responsibilities surrounding the minor child’s receiving services from the Company. I understand and agree that no oral or written representations can or will alter the contents of this document. I agree that this agreement shall be governed by the laws of the State of California. I have read and agree to the foregoing terms and conditions of this document. I am hereby agreeing to all stipulations as stated above.
