The South Shore Yacht Club, Inc, of 800 Bridge St. North Weymouth, Massachusetts 02191 as the legal occupant/owner of the facilities at said site and the mooring as set forth in the Club Mooring Plan (hereinafter referred to as the Club) and

agree for myself and my family members, guests and invitees (hereinafter collectively referred to as Member) hereby agree to the following terms and conditions set forth below:

1. AGREEMENT TO FOLLOW DIRECTIONS. Member agrees to observe and obey all rules, regulations and warnings, regarding the use of the mooring and or dockage assigned to Member and the use of the Club and the facilities and further agree to follow any oral instructions or directions given by any SSYC Flag Officer or authorized representative. 
2. ASSUMPTION OF THE RISK AND RELEASE. The Member recognizes that there are certain inherent risks associated with the above described activity of boating which the Member assumes and accepts including personal injury suffered by the Member or others. The Member further agrees to indemnify and hold harmless the Club for any injury, loss or damage arising out the use of the Club whether caused by the fault of the Member or other third parties. 
3. INDEMNIFICATION. The Member agrees to indemnify, hold harmless and defend the Club against all claims, causes of action, damages and /or judgments., which may in any way arise from the Members use of the Club.
4. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Massachusetts law. 
5. NO DURESS. Member agrees and acknowledges that he/she is under no pressure or duress to sign this Agreement and that the Member has been given a reasonable opportunity to review the terms and conditions in this agreement before signing it. Member further agrees and acknowledge that he/she is free to have his/her own legal counsel review this Agreement if so desired. 
6. DURATION.  This agreement shall take effect immediately and shall remain in effect throughout the Member’s membership with the Club.
7. ENFORCEABILITY. The invalidity or unenforceability of any provision of this agreement whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity of enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this agreement. 
8. RELEASE OF LIABILITY AND IDEMNIFICATION;  ACTIVITIES. The undersigned (hereinafter referred to as “Participant”), his/her heirs, assigns and guests, as a Participant in SSYC activities (hereinafter referred to as “Activities”) which include but are not limited to social events, sailing races, serving as race committee, fishing tournaments, work parties, social functions and use of private boats and crews thereon, shall waive, relinquish and release any and all claims or legal actions the Participant may have now and forever against the SSYC, its officers, trustees, activity organizers, or members (hereinafter referred to as “SSYC”).  Further, the Participant covenants and agrees to indemnify and hold harmless the SSYC from any and all claims or losses arising from Participant’s involvement in said Activities.  This release of liability and indemnification shall be effective from year to year and is a self-renewing agreement.

I have read this document and understand that by signing this release I voluntarily surrender certain legal rights.
