1. That I am participating in exercise, personal training, or similar activities (hereinafter "Program") offered by Fonda Interactive Training (F.I.T, during which I will receive training and instruction related to physical fitness, health, and related matters. I recognize and understand that these activities will involve physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Program. I represent and warrant that I am physically fit enough to participate, and have no medical condition that would prevent my full participation in the Program.
3. In consideration of being permitted to participate in the Program, I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the Program.
4. In further consideration of being permitted to participate in the Program, I knowingly, voluntarily and expressly waive any claim I may have against Fonda Interactive Training (F.I.T, its owners, shareholders, members, directors, officers, employees, contractors, vendors, and their heirs and assigns, for injury or damages I may sustain as a result of participating in the Program.
5. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Fonda Interactive Training (F.I.T for any injury or death caused by their negligence or other acts.
6. This Agreement is to be governed by the laws of the State of North Carolina, and the venue for any dispute arising hereunder shall be New Hanover County, North Carolina. Should any clause or provision of this Agreement be found illegal, invalid or unenforceable under present or future laws, the remainder of this Agreement shall not be affected thereby. I have read the above release and waiver of liability and fully understand its contents and voluntarily agree to the terms and conditions stated above.
