2. LEGAL REGULATION APPLICABLE TO THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS

These General Conditions are subject to whatever results from the application of the Royal Legislative Decree (R.D.L). 1/2007 of November 16th, which approves the revised text of the General Law for the Defence of Consumers and Users, Law 7/1998 of April 13th, on General Conditions of Contracting, and the Civil Code. The present General Conditions, signed by the contracting parties, will be incorporated into all contracts of the KING’S INFANT SCHOOL, S.L. Programme, the object of which are the programmes contained in the information sheets and are binding on the parties, together with the particular conditions agreed in the contract and those which may be established in each programme.

 

3. REGISTRATION, PRICE AND PAYMENT

In order to register for the chosen programme, you must complete and return the registration form. To confirm your child’s place we must receive a deposit to the value of €55. The amount paid on account will be deducted from the total price of the Programme. Payment should be made to the following account: Current Account ES0921003816530200039462 – La Caixa. Please indicate the name and surname of the participant in the concept.

No programme registration will be processed unless accompanied by proof of payment. The balance of the price of the contracted Programme must be paid 10 days before the start of that programme. Any failure to pay, both in time and method, will be considered as a waiver of the pupil to attend the course. Registrations made less than 10 days prior to the Programme start date must be paid in full at the time of registration. Registrations are personal and non-transferable.

 

4. CANCELLATION, NO PRESENTATION AND/OR ABANDONMENT OF THE PROGRAMME BY THE CUSTOMER

In the event that the customer decides to cancel the contracted Programme, they must notify KING’S INFANT SCHOOL, S.L in writing. Notwithstanding the foregoing, the customer must pay KING’S INFANT SCHOOL, S.L the amount corresponding to any damages caused, including all types of expenses incurred by KING’S INFANT SCHOOL, S.L, up to the current date. By way of example, but not limited to: payments to third parties involved in the programme: schools, museums*, monitors, teachers, telephone calls, amongst others. In order to inform the customer of the amount of retentions or charges to be made by withdrawal they shall amount to:

• 25% of the programme price, if the cancellation occurs between 44 and 30 days from the course start date
• 50% of the programme price, if the cancellation occurs between 29 and 10 days from the course start date.
• 75% of the programme price, if the cancellation occurs within 9 days prior to the course start date.
• 100% in case of a no-show at start of the programme.

The customer shall not be entitled to any refund if they, their parents or their legal guardians voluntarily leave the Programme once said Programme has commenced.       *(“Explore Madrid” programme only)

The administration fees indicated in section three (3) of these general conditions must be paid to KING’S INFANT SCHOOL, S.L. in any case and, likewise, will not be refunded in any case, except if the cancellation insurance is taken out. Notwithstanding, if the customer withdraws from the contract during a period of 7 days from its execution, KING’S INFANT SCHOOL S.L. will return them the amounts paid without withholding expenses. The customer shall not be entitled to any refund if they, their parents or their legal guardians voluntarily leave the Programme once said Programme has commenced.

 

5. COVID Peace of mind Policy

In addition to being confident that our camps meet strict government standards for safety and increased hygiene, we also offer you the security of being able to cancel your camp booking if COVID19 prevents travel*.

With our COVID Peace of Mind Policy you can book with confidence and we can all look forward to a safe camp full of adventure.

 

*We will transfer your registration to another camp or offer a full refund of the camp fees in these circumstances: Camp registrations do not reach the minimum number required. † Proof of positive test or quarantine may be required.

                                                       

 6. PRACTICES AND MANDATORY STANDARDS DURING THE PROGRESS OF THE PROGRAMME

The participant agrees to respect and abide by the course discipline and behaviour rules, both during their stay in the facilities where they receive their lessons, and outside of them. In particular, in relation to opening times of the centre, the obligation of class attendance, meals, rules of coexistence and behaviour with teachers, classmates, and staff employed by King’s Infant School.

 

7. MEDICAL, PHARMACOLOGICAL AND/OR SURGICAL TREATMENT

The participant shall inform KING’S INFANT SCHOOL, S.L. if they are undergoing any medical and/or pharmacological treatment during the period covered by the chosen programme. It is understood that, at the time of beginning the programme, the participant is in correct physical and mental health to participate in the programme and that the medical information accompanying the programme dossier is true and complete. Otherwise, the company KING’S INFANT SCHOOL, S.L. is exempt from any type of liability arising from the falseness of the information.

 

8. INSURANCE

Participants who enroll in the programmes of KING’S INFANT SCHOOL, S.L. are covered by a fully comprehensive insurance according to the conditions of the insurance policy taken out by KING’S INFANT SCHOOL, S.L. and provided by the company ERGO.  KING’S INFANT SCHOOL, S.L. acts as a mere intermediary between the insurance company and the customers who contract any of our programmes.

 

9. DATA PROTECTION

LATAM EDUCATION HOLDINGS, S.L., with VAT number B87232641 and registered address at Avda. Pío XII, 92, 28036 Madrid, Spain acting as the data controller in compliance with the Regulation (EU) 2016/679 (GDPR) and the L.O. 3/2018, of December 5, on data protection and guarantee of digital rights (LOPDGDD), informs that the personal information collected through this Application Form is compiled with the purpose of the provision, management and billing of King’s Infant School camp activities. The data will be kept for the time necessary to fulfill the expressed purposes and legal obligations. Once the aforementioned period has elapsed, the data will be permanently deleted using the appropriate security measures. The data will not be communicated to third parties, except by legal obligation or for the execution of the service. You can exercise your rights of withdrawal of consent, access, rectification, object, erasure, limitation and portability of your data at any time by sending a written request and indicating in the subject "DATA PROTECTION", attaching your identification document to: dpo@kingsgroup.org.  You also have the right to file a complaint with the Spanish Data Protection Authority (www.aepd.es) if you consider that the data processing does not comply with current regulations. Minors.  The aforementioned data protection regulations establish limitations on the processing of the personal data of a “minor”. Therefore, KING’S INFANT SCHOOL, S.L provides that all data processing referred to a minor must have the authorisation of their parents or legal guardian, which will be duly accredited and in accordance with the applicable regulations. In this regard, KINGS’S INFANT SCHOOL, S.L will take all appropriate measure to proceed with the effective verification of the child’s age.

 

10.PERSONAL DATA PROTECTION AND IMAGE PROCESSING

10.1 Aim of the programme. KING’S INFANT SCHOOL, S.L., as the data controller, with registered address at Avenida Pío Xll, 92,  28036, Madrid, Spain, in compliance with the Regulation (EU) 2016/679 (General Data Protection Regulation), informs the signatories of the registration form that their own personal data and, where applicable, that of the respective represented persons, that are requested through the form, as well as those that may be provided subsequently, including those relating to special categories if any, are necessary for compliance with the stipulations of these Terms and Conditions, as well as for the development, control and management of the training activity in which the participant has registered. The signatories guarantee the veracity of the data provided at all times and undertake to communicate promptly to KING’S INFANT SCHOOL S.L any variation thereof.

The legal basis for the processing of personal data is the execution of these Terms and Conditions, as well as the fulfilment of legal obligations corresponding to KING’S INFANT SCHOOL S.L and the consent given by the signatories. If the signatories do not consent to the processing of their data, the participant will not be able to enjoy the training activity. In addition, in the event that the signatories check the boxes enabled for the purpose, they expressly authorise (i) KING’S INFANT SCHOOL S.L so that it can transfer personal data to other King’s Group companies, and (ii) that both companies process the personal data so that either of them can send commercial communications by any means, including telephone, e-mail or equivalent means of communication, about products, services and promotions in the field of educational and cultural services. Notwithstanding the foregoing, the signatories may withdraw their express consent for any of the additional purposes envisaged and, in particular, for the receipt of commercial communications, at any time, in writing via email addressed to dpo@kingsgroup.org.

10.2 Data retention. The data provided will be kept with the appropriate technical and organizational measures that guarantee the appropriate level of security and for the time that is necessary, in order to guarantee compliance with the legal obligations that correspond to KING’S INFANT SCHOOL S.L during the necessary prescription periods depending on the applicable legislation. After the deadlines indicated, the data will be duly removed.

10.3 Data of third parties. In the event that personal data of third parties are provided by the signatories, they shall guarantee that they have informed such third parties and have obtained the necessary consent for their processing by KING’S INFANT SCHOOL S.L with the purposes detailed in this clause. KING’S INFANT SCHOOL S.L reserves the right to require the signatories, whose documentation provided includes the processing of third-party data, proving that they have met the aforementioned information and consent requirements.

10.4 Data communication. The signatories authorise KING’S INFANT SCHOOL S.L to transfer personal data through communication to entities that belong to the business group of which KING’S INFANT SCHOOL S.L. is a member at any time. Likewise, the collaborating organizations that perform services related to the content of the training activity and that help KING’S INFANT SCHOOL S.L in this regard may have access to the participant’s data, in order to process and control the good development and execution of the training activity.

10.5 International data transfer. The information that the signatories provide to KING’S INFANT SCHOOL S.L for the execution of this contract can be transferred internationally to other KING’S GROUP centres and to the INSPIRED Group in which it is integrated as well as to third parties for their processing in accordance with the requirements established by the legislation applicable in each country and / or region and to the applicable international agreements where the different entities of the aforementioned groups operate. In this regard, KING’S INFANT SCHOOL S.L acting as data controller or data processor, depending on the position, will protect the rights of signatories in international data transfers to third countries, observing at all times the Group’s security standards and legal requirements. On the other hand, KING’S INFANT SCHOOL S.L will apply the Binding Corporate Rules (or “BCR”) that offer adequate protection guarantees to make transfers between the Group companies and that would be applicable in the place where the regulations contemplate it.

King’s Infant School also informs the signatories that their data will not be transferred to any third parties except when required in the framework of compliance with legal obligations by the administrations or competent official bodies that require it, as well as where appropriate, to data processors that will require it for the execution of this contract.

10.6 Security measures. KING’S INFANT SCHOOL S.L has implemented the necessary technical and organizational security measures that guarantee the security of your personal data and prevent its alteration, loss, unauthorised processing and / or access, taking into account the state of the technology, the nature of the stored data and the risks to which they are exposed, already come from human action or from the physical or natural environment.

10.7 Rights. The signatories may, under the terms established in the regulations on data protection in force at any time, and in accordance with the regulations, revoke at any time the authorisation granted for the processing and transfer of personal data, as well as exercise the rights of access, rectification, erasure, object, right to request the limitation of the processing of personal data, the right to portability and the right to file a claim with a supervisory authority. To do this, they may send a request to KING’S INFANT SCHOOL S.L in writing with a proof of their identity at Avenida Pío Xll, 92, 28036, Madrid, Spain, or by email to info@kingsgroup.org.

10.8 Image. In order to disseminate the training activities that KING’S INFANT SCHOOL S.L carries out, the signatories and the participant are informed that, during their enjoyment, photographs and / or video recordings of the participant may be made, being the intention of KING’S INFANT SCHOOL S.L to publish those images and / or video recordings in media, conventional and / or electronic, to publicize their activities always in strict compliance with Organic Law 1/1982, of May 5, on Civil Protection of the Right to Honor, Personal and Familiar Privacy and the Image Rights and the applicable regulations regarding data protection.

Therefore, in this application form, the consent of the participant or, where appropriate, their legal representatives will be requested so that KING’S INFANT SCHOOL S.L is allowed to use and / or disseminate the participant’s image for a limited time and in accordance with the purposes set forth in this section for promotional purposes and in KING’S INFANT SCHOOL S.L exclusive media such as press material, newsletters, web pages, social networks and / or other similar media on the Internet (all of them owned and used exclusively by King’s Infant School) and its use and & or dissemination is prohibited by other means or third parties not authorised and outside KING’S INFANT SCHOOL S.L In any case, the participant or their legal representatives may withdraw their consent at any time and free of charge in accordance with the provisions of current legislation.

10.9 Minors. The European Regulation and national data protection laws establish limitations on the processing of the personal data of a “minor”. Therefore, KING'S INFANT SCHOOL S.L provides that all data processing of a minor must have the authorization of their parent or guardian, which will be duly accredited and in accordance with the applicable regulations.

In this regard, KING’S INFANT SCHOOL S.L will take all appropriate measures to proceed with the effective verification of the child’s age.

 

11. RESOLUTION OF CONFLICTS

Any conflict related to the programmes will be resolved by the competent jurisdictional bodies according to the applicable legislation.

 

12. VALIDITY

The validity of these general conditions will be from January the First, 2022 to December the 31st, 2022 both inclusive.

2. REGULACIÓN JURÍDICA APLICABLE AL CONTRATO Y ACEPTACIÓN DE LAS CONDICIONES GENERALES

Las presentes Condiciones Generales están sujetas a cuanto resulte de aplicación del R.D.L. 1/2007 de 16 de Noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de Consumidores y Usuarios, la Ley 7/1998, de 13 de Abril, sobre las Condiciones Generales de Contratación, y el Código Civil. Las presentes Condiciones Generales se incorporarán, firmadas por las partes contratantes, a todos los contratos del Programa de KING’S INFANT SCHOOL S.L., cuyo objeto sean los Programas contenidos en las Fichas Informativas y obligan a las partes, junto con las condiciones particulares que se pacten en el contrato, y las que se pudiesen establecer en cada programa.

 

3. INSCRIPCIÓN, PRECIO Y FORMA DE PAGO

Para inscribirse en el programa elegido, se debe completar el formulario de inscripción, de KING’S INFANT SCHOOL S.L., junto con la reserva de plaza correspondiente.Toda solicitud de inscripción en cualquiera de nuestros programas deberá ir acompañada del abono de los siguientes gastos de gestión que ascienden a: 55 euros. La cantidad entregada a cuenta se descontará del precio total del Programa. El abono de las cantidades indicadas en el punto anterior deberá realizarse en la siguiente cuenta (indicando siempre el nombre y apellidos del participante):

No se tramitará ninguna inscripción en un programa que no vaya acompañada del justificante de haber realizado el pago indicado. El resto del precio del Programa contratado deberá ser abonado 10 días antes del inicio del programa. La falta de ingreso, en tiempo y forma, será considerada como renuncia del alumno a realizar el curso. En las inscripciones realizadas con menos de 10 días de antelación a la fecha de inicio del Programa, deberá ser abonado el importe total del programa elegido en el momento de realizar la inscripción. Las inscripciones son personales e intransferibles.

 

4. CANCELACIÓN, NO PRESENTACIÓN Y/O ABANDONO DEL PROGRAMA POR PARTE DEL CONSUMIDOR

En el caso de que el consumidor decidiera cancelar el Programa contratado, debe notificarlo por escrito a KING’S INFANT SCHOOL S.L., No obstante, el consumidor deberá abonar a KING’S INFANT SCHOOL S.L., la cantidad correspondiente a los daños que se hayan ocasionado entre los que se encuentran los gastos de todo tipo en el que haya incurrido KING’S INFANT SCHOOL S.L., hasta la fecha. A título enunciativo, pero no limitativo: pagos a terceros intervinientes en el programa: escuelas, residencias, monitores, profesorado, llamadas telefónicas, entre otros. Con el fin de informar al consumidor del importe de las retenciones o cobros que se efectuarán por desistimiento ascenderán a:

• 25% del precio del programa, si la anulación se produce entre 44 y 30 días de la fecha del inicio del curso.
• 50% del precio del programa, si la anulación se produce entre 29 y 10 días de la fecha de comienzo del curso.
• 75% del precio del programa, si la anulación se produce dentro de los 9 días anteriores al inicio del programa.
• 100% en caso de no presentación en la salida.

 Los gastos de gestión indicados en el apartado nº 3 de estas condiciones generales deben ser abonados a KING’S INFANT SCHOOL S.L., en todo caso y, del mismo modo, no serán objeto de devolución en ningún supuesto, excepto si se contrata el seguro de cancelación. No obstante, si el consumidor desiste del contrato durante un plazo de 7 días hábiles desde la celebración de este, KING’S INFANT SCHOOL S.L., le devolverá las sumas abonadas sin retención de gastos. El consumidor no tendrá derecho a reembolso alguno cuando, una vez haya iniciado el Programa, lo abandone por voluntad propia, de sus padres o de sus representantes legales.

 

5. COVID 19

En KING’S INFANT SCHOOL S.L, nos comprometemos a garantizar la seguridad y la comodidad de todos, desde nuestros campistas y personal hasta las comunidades y países que acogen nuestros campamentos. Este verano, puede reservar un campamento de verano de KING’S COLLEGE S.L con la seguridad de que hemos trabajado con las autoridades locales y hemos aplicado políticas y procedimientos para garantizar que nuestros campamentos proporcionen el entorno más seguro para su hijo. Además de tener la certeza de que nuestros campamentos cumplen con las estrictas normas gubernamentales en materia de seguridad e higiene, también le ofrecemos la seguridad de poder cancelar su reserva de campamento si el COVID19 le impide la asistencia*.

Con nuestra política de tranquilidad COVID puede reservar con confianza y todos podemos esperar un campamento seguro y lleno de aventuras.

*Transferiremos su inscripción a otro campamento de 2022/3 u ofreceremos un reembolso completo de las cuotas del campamento en estas circunstancias: El alumno no puede asistir al campamento por haber contraído el Covid19†; El alumno no puede viajar al campamento de verano por las restricciones de viaje o la cuarentena causada por el Covid19†; Las inscripciones al campamento de verano no alcanzan el número mínimo requerido. † Es posible que se requiera una prueba de prueba positiva o de cuarentena.

 

6. USOS Y NORMAS DE OBLIGADO CUMPLIMIENTO DURANTE EL DESARROLLO DEL PROGRAMA

El participante se compromete a respetar y cumplir las normas de disciplina y comportamiento del curso, tanto durante su permanencia en las instalaciones donde se reciban las clases, como fuera de las mismas. En particular, en lo referente a horarios del centro, obligación de asistencia a clase, comidas, normas de convivencia y conducta con los profesores, compañeros y personal contratado por KING’S INFANT SCHOOL S.L.

 

7. TRATAMIENTO MÉDICO, FARMACOLÓGICO Y/O QUIRÚRGICO

El participante deberá poner en conocimiento de KING’S INFANT SCHOOL S.L., si está sometido a algún tratamiento médico y/o farmacológico durante el periodo que abarca el programa elegido. Se entiende que, al tiempo de comenzar el programa, el participante goza de salud física y mental para participar en el programa y que la información médica que acompaña al dossier del programa es verdadera y completa. En caso contrario, la empresa KING’S INFANT SCHOOL S.L., se exime de cualquier tipo de responsabilidad derivada de la falsedad de estas informaciones.

 

8. SEGUROS

Los participantes que contraten los programas de KING’S INFANT SCHOOL S.L., gozan de la cobertura de un seguro multiasistencia, según las condiciones de la póliza de seguro suscrita por KING’S INFANT SCHOOL S.L., con la empresa aseguradora ERGO. KING’S INFANT SCHOOL S.L., actúa como mera intermediaria entre la compañía aseguradora y los consumidores que contratan alguno de nuestros programas. Los consumidores pueden llevar otra póliza de su elección.

 

9. PROTECCIÓN DE DATOS

LATAM EDUCATION HOLDINGS, S.L., con CIF B87232641 y domicilio social en Avda. Pío XII, 92, 28036 Madrid, España actuando como responsable del tratamiento en cumplimiento del Reglamento (UE) 2016/679 (GDPR) y de la L.O. 3/2018, de 5 de diciembre, de protección de datos y garantía de los derechos digitales (LOPDGDD), informa que los datos personales recogidos a través de este Formulario de Solicitud son recopilados con la finalidad de la prestación, gestión y facturación de las actividades de los campamentos de King’s Infant School. Los datos se conservarán durante el tiempo necesario para cumplir con las finalidades expresadas y las obligaciones legales. Una vez transcurrido dicho plazo, los datos serán eliminados definitivamente con las medidas de seguridad adecuadas. Los datos no serán comunicados a terceros, salvo por obligación legal o para la ejecución del servicio. Puede ejercer sus derechos de retirada del consentimiento, acceso, rectificación, oposición, supresión, limitación y portabilidad de sus datos en cualquier momento enviando una solicitud por escrito e indicando en el asunto "PROTECCIÓN DE DATOS", adjuntando su documento de identificación a: dpo@kingsgroup.org.  También tiene derecho a presentar una reclamación ante la Autoridad Española de Protección de Datos (www.aepd.es) si considera que el tratamiento de datos no se ajusta a la normativa vigente. Menores de edad.  La citada normativa de protección de datos establece limitaciones al tratamiento de los datos personales de un "menor". Por ello, KING'S INFANT SCHOOL, S.L establece que todo tratamiento de datos referido a un menor de edad deberá contar con la autorización de sus padres o tutores legales, que será debidamente acreditada y conforme a la normativa aplicable. En este sentido, KING'S INFANT SCHOOL, S.L adoptará todas las medidas oportunas para proceder a la comprobación efectiva de la edad del menor.

 

10. PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL Y TRATAMIENTO DE IMÁGENES

10.1 Finalidad del tratamiento. En cumplimiento de lo dispuesto en el artículo 13 del Reglamento (UE) General de Protección de Datos 2016/679 del Parlamento Europeo y del Consejo, KING’S INFANT SCHOOL S.L., con NIF B/82737552 y con domicilio en Avenida Pío Xll, 92, 28736, Madrid, Spain, es el responsable del tratamiento e informa a los firmantes del formulario de inscripción de que los datos personales propios y, en su caso, de los respectivos representados que se solicitan a través del formulario, así como aquellos que puedan facilitarse posteriormente, incluso los relativos a categorías especiales, en caso de haberlos, son necesarios para el cumplimiento de lo estipulado en las presentes Condiciones Generales, así como para el desarrollo, control y gestión de la actividad formativa en la que se ha inscrito el participante. Los firmantes garantizan la veracidad de los datos que faciliten en cada momento y se comprometen a comunicar puntualmente a KING’S INFANT SCHOOL S.L., cualquier variación sobre los mismos.

La base legal para el tratamiento de los datos personales es la ejecución de las presentes Condiciones Generales, así como el cumplimiento de las obligaciones legales que corresponden a KING’S INFANT SCHOOL S.L., y el consentimiento otorgado por los firmantes. Si los firmantes no consintieran el tratamiento de sus datos, el participante no podría disfrutar de la actividad formativa.

Además, en caso de que los firmantes marquen las casillas habilitadas al efecto en el formulario de inscripción, autorizan expresamente (i) a KING’S INFANT SCHOOL S.L., para que pueda ceder los datos personales a otros centros que forman parte de KING’S GROUP, sociedad matriz del grupo, para los mismos fines legítimos indicados en este apartado y (ii) a que ambas sociedades traten los datos personales con el fin de que cualquiera de ellas puedan enviar comunicaciones comerciales por cualquier medio, incluido el teléfono, correo electrónico o medio de comunicación equivalente, sobre los productos, servicios y promociones en el ámbito de los servicios educativos y culturales. No obstante lo anterior, los firmantes podrán revocar su consentimiento expreso, para cualquiera de las finalidades adicionales previstas y, en particular, para la recepción de comunicaciones comerciales, en cualquier momento, por escrito mediante correo electrónico dirigido a dpo@kingsgroup.org.

10.2 Conservación de datos. Los datos proporcionados serán conservados con las debidas medidas técnicas y organizativas que garanticen el nivel de seguridad adecuado y por el tiempo que resulte necesario, a efectos de garantizar el cumplimiento de las obligaciones legales que le corresponden a KING’S INFANT SCHOOL S.L., durante los plazos de prescripción necesarios en función de la legislación aplicable. Una vez transcurridos los plazos indicados, los datos serán debidamente eliminados.

10.3 Datos de terceros. En el caso de que se faciliten datos personales de terceros, los firmantes garantizan haber informado a tales terceros y haber obtenido de los mismos el consentimiento necesario para su tratamiento por parte de KING’S INFANT SCHOOL S.L., con las finalidades detalladas en la presente cláusula. KING’S INFANT SCHOOL S.L., se reserva el derecho a requerir a los firmantes, cuya documentación aportada incluya el tratamiento de datos de terceros, que acrediten haber cumplido con los requisitos de información y consentimiento anteriormente mencionados.

10.4 Comunicación de datos. Los firmantes autorizan a KING’S INFANT SCHOOL S.L., la cesión de los datos personales mediante comunicación, a las entidades que pertenezcan al grupo empresarial del que KING’S INFANT SCHOOL S.L., forme parte en cada momento. Asimismo, las organizaciones colaboradoras que realizan servicios relacionados con el contenido de la actividad formativa y que ayudan a KING’S INFANT SCHOOL S.L., en este sentido podrán tener acceso a los datos del participante, con el fin de tramitar y controlar el buen desarrollo y ejecución de la actividad formativa.

10.5 Transferencia internacional de datos. La información que los firmantes facilitan a KING’S INFANT SCHOOL S.L., para la ejecución del presente contrato puede ser transferida internacionalmente a otros centros de KING’S GROUP y al Grupo INSPIRED en el que éste está integrado así como a terceros para su tratamiento de acuerdo con los requisitos que establezca la legislación aplicable en cada país y/o región y a los acuerdos internacionales aplicables donde operen las distintas entidades de los citados grupos.

A este respecto, KING’S INFANT SCHOOL S.L., como responsable de tratamiento y /o encargado de tratamiento, según la posición que ocupe, protegerá los derechos de los firmantes en las transferencias internacionales de datos a terceros países observando en todo momento los estándares de seguridad del grupo y los requerimientos legales en la materia. Por otro lado, KING’S INFANT SCHOOL S.L., aplicará las Normas Corporativas Vinculantes (o “Binding Corporate Rules o BCR”) que ofrezcan garantías de protección adecuadas para realizar transferencias entre las empresas del grupo y que serían de aplicación en el lugar donde la normativa lo contemple.

KING’S INFANT SCHOOL S.L., también informa a los firmantes que sus datos no se cederán a terceros salvo cuando sea requerido en el marco del cumplimiento de las obligaciones legales por las administraciones u organismos oficiales competentes que lo requieran, así como en su caso, a los encargados del tratamiento necesarios para la ejecución de este contrato.

10.6 Medidas de seguridad. KING’S INFANT SCHOOL S.L., le informa que tiene implantadas las medidas de seguridad de índole técnica y organizativas necesarias que garanticen la seguridad de sus datos de carácter personal y eviten su alteración, pérdida, tratamiento y/o acceso no autorizado, habida cuenta del estado de la tecnología, la naturaleza de los datos almacenados y los riesgos a que están expuestos, ya provengan de la acción humana o del medio físico o natural.

10.7 Derechos. Los firmantes podrán, en los términos establecidos en la normativa sobre protección de datos vigente en cada momento, y de acuerdo con la normativa, revocar en cualquier momento la autorización concedida para el tratamiento y la cesión de los datos personales, así como ejercer los derechos de acceso, rectificación, la supresión, oposición, derecho a solicitar la limitación del tratamiento de sus datos personales, el derecho a la portabilidad y el derecho a presentar una reclamación ante una autoridad de control. Para ello se podrán dirigir a KING’S INFANT SCHOOL S.L., por escrito con justificante de su identidad a Avenida Pío Xll, 92, 28036, Madrid, Spain, o mediante correo electrónico dirigido a info@kingsgroup.org.

10.8 Imagen. Con el fin de difundir las actividades formativas que KING’S  INFANT SCHOOL S.L., lleva a cabo, se informa a los firmantes y al participante de que, durante el disfrute de las mismas, podrán realizarse fotografías y/o grabaciones del participante, siendo intención de KING’S INFANT SCHOOL S.L., publicar dichas imágenes y/o grabaciones en medios de comunicación, convencionales y/o electrónicos, para dar publicidad a sus actividades siempre en estricto cumplimiento de la Ley Orgánica 1/1982, de 5 de mayo, de protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen y la normativa aplicable en materia de protección de datos.

Por ello, en el correspondiente formulario de inscripción, se solicitará el consentimiento del participante o, en su caso, de sus representantes legales, para que KING’S INFANT SCHOOL S.L., utilice y/o difunda la imagen del participante por tiempo limitado y de conformidad con las finalidades previstas en este apartado con fines promocionales y en medios de difusión exclusivos de KING’S INFANT SCHOOL S.L., tales como material de prensa, newsletters, páginas web, redes sociales y/u otros medios similares en Internet (todos ellos de propiedad y uso exclusivo de KING’S INFANT SCHOOL, S.L.) quedando prohibida su utilización por otros medios o terceros no autorizados y ajenos a KING’S INFANT SCHOOL, S.L.. En cualquier caso, el participante o sus representantes legales podrá revocar su consentimiento en cualquier momento y de forma gratuita de conformidad con lo previsto en la legislación vigente.

 10.9 Menores de edad. El Reglamento Europeo y las legislaciones nacionales de protección de datos establecen limitaciones al tratamiento de los datos personales de un “menor”. Por ello, KING’S INFANT SCHOOL S.L., dispone que todo tratamiento de datos de un menor de edad deberá contar con la autorización de su padre o tutor, que quedará debidamente acreditada y de conformidad con la normativa aplicable.

En este sentido, KING’S INFANT SCHOOL S.L., adoptará todas las medidas convenientes para proceder a la comprobación efectiva de la edad del menor.

 

11. RESOLUCIÓN DE CONFLICTOS

Cualquier conflicto relativo a los programas será resuelto por los Órganos Jurisdiccionales competentes según la legislación aplicable.

 

12. VIGENCIA

La vigencia de estas condiciones generales será del 1 de enero 2022 al 31 de diciembre 2022.
