TRINI SMS SERVICE CONTRACT

Agreement: I hearby agree that the information provided is true and that Trini SMS only collect Personal Information where the information is necessary for Trini SMS to perform one or more of its functions or activities. In this context, "collect" means gather, acquire or obtain by any means, information in circumstances where the individual is identifiable or identified. I hereby understand that Trini SMS is a service provided by SAANVI'S IMPORTS LIMITED. Registered address: LOT 2G OUDESH DRIVE, MUNROE ROAD, CUNUPIA.

Trini SMS collects Personal Information primarily to supply customers with the services we offer. Trini SMS also collects and uses Personal Information
for secondary purposes including billing and account management.

Trini SMS will not collect Sensitive Information from individuals except with consent and only where it is necessary for Trini SMS to collect such information for an activity or function. Trini SMS may Disclose Personal Information to law enforcement agencies, government agencies, courts or external advisers where permitted or required by law. Trini SMS has the right to suspend or terminate your account and refuse any and all current or future use of the Service.

Privacy Policy: Trini SMS will not monitor, edit, or disclose any personal information about you or your use of the Service, including its contents, without your prior permission.

Password and Security: You agree to ensure that your password and account details are kept secure and confidential at all times and that every effort is made to avoid disclosure to any other person.

Termination of Membership: If you wish to terminate your contract at any time with Trini SMS, all funds owing to Trini SMS must be paid and a termination fee of $400TT will be charged if contract has not expired. If any system failure occurs and client wishes to terminate service with us, no termination fees would apply but credits will be lost.

Hosting Costs (Single account)
The table below shows the costs associated with the hosting of your TRINI SMS account. You can choose the hosting option that suits your needs. If your business has multiple locations, ask about our bulk prices. The cost below is for a single user login and in TTD. Cost per sms is separate and charged in USD to your credit card.

(Minimum Credit purchase required is 20 USD). If you don’t have a credit card and need a Top Up – Trini SMS requires an email with a purchase order or confirmation to process your request. Pay first system in effect for SMS Top Up.

NOW, THEREFORE, the parties agree as follows:

ARTICLE 1: APPOINTMENT
1.01 You hereby appoints Trini SMS to provide to you the service required so that you can send SMS promotional content to your opt-in client database.

1.02 You hereby agree that Trini SMS is not held responsible for drafting promotions that are to be sent to your customers and also the content. It is your responsibility to send SMS messages to your customers. Trini SMS is not responsible for non delivery of SMS messages.It's the mobile operators’ responsibility to deliver the SMS message. Trini SMS only forward your messages to the operator.

ARTICLE 2: Trini SMS OBLIGATIONS
2.01 During the term of this Agreement, Trini SMS agrees to:
(A) Provide you the client with training on using our SMS web interface.
(B) Provide you with technical support according to your chosen hosting plan.
(C) We are responsible for informing you of any SMS rate increase.

ARTICLE 3: Payment to Trini SMS
(A) You agree to make full payment for hosting at the beginning of each month.
(B) If additional SMS credits is needed for non credit card users, an Invoice will be       presented.
(C) Payment must be made via bank deposit or online bank transfer.
(D) Payment can also be made via bank deposit at Republic Bank Limited account to the account listed below:

(E) No Post dated payments over 7 working days.
(F) Payment for SMS hosting must be made no later than 14 days or account will be suspended.

 

ARTICLE 4: Renewal
(A) This contract renews automatically, you may terminate the expiring Hosting Plan by written request, at least ninety (60) days prior to the expiration date. If Saanvi's Imports Limited does not receive such termination notice by the expiration date, the expiring contract will be automatically renewed for either a one year term or the same duration as selected in this signed contract.
