Koru Equine Therapy Consent and Release Agreement

Owner/Caretaker Consent to Care. Owner/Caretaker understands and agrees that Courtney Anderson is using techniques taught by Holistic Animal Bodywork and is a certified equine massage therapy practitioner. These techniques may not be recognized by state veterinary licensing or regulatory authorities. Owner/Caretaker consents to allowing Courtney Anderson and Koru Equine Therapy to provide equine massage therapy and other related techniques on the animal(s) identified above. Owner/Caretaker has fully informed Courtney Anderson of any and all conventional veterinary care, treatment, diseases, disabilities and pathologic conditions the animal is suffering from.

Assumption of Risk. Owner/Caretaker assumes all risks associated with care and treatment. Those risks include the risk of injury or death of the animal, the risk that bodywork may not be an effective treatment, and the risk of personal injuries or destruction of property caused by the animal. Owner/Caretaker has considered those risks, is relying on his/her own judgment, and has voluntarily agreed to assume those dangers and risks. Owner/Caretaker understands that no representations, warranties or guarantees are made as to the results or outcome of any treatment provided by Courtney Anderson and Koru Equine Therapy.

Waiver of Claims. Owner/Caretaker, individually, and for his/her co-Owner/Caretakers of the animal, spouse, heirs, successors, and assigns, hereby waives and fully releases any claims against Courtney Anderson and Koru Equine Therapy arising out of or related to the care provided for the Owner/Caretaker’s animal, that he/she may have or ever had, now or in the future, including but not limited to (1) any claims arising from any injuries to persons or property caused to or by the animal, (2) any claims that may occur while Owner/Caretaker or Owner/Caretaker’s animal are on the premises of any facility for the purpose of participating in treatment, and (3) any claims arising from any negligence or gross negligence of Courtney Anderson arising from or relating to treatment of the animal.

Indemnity. Owner/Caretaker agrees to hold harmless and indemnify Courtney Anderson and Koru Equine Therapy from and against any and all claims, demands, actions or lawsuits for property damage, personal injury, or death, including costs of suit and attorney’s fees, arising out of or related to any treatment or other services provided to the animal, regardless of whether such damages, injury or death are caused by Owner/Caretaker’s negligence or by the negligence of Courtney Anderson or Koru Equine Therapy.

Representations of Owner/Caretaker. Owner/Caretaker represents and warrants (1) that he/she is the Owner/Caretaker of the animal identified above, or the caretaker for the animal, and is authorized to execute this Agreement, (2) that he/she is executing this Agreement of his/her own free will, and that he/she is not under any duress or undue influence to execute this Agreement, (3) that he/she has carefully read this Agreement, and (4) that he/she is fully and completely informed about and clearly understands the terms of this Agreement.
