Yo, el abajo firmante, en consideración de nuestro permiso de participar en el BA Cup Paris (la “Experiencia Deportiva”) y su programa de viaje organizado por la Fundación Gol: International Soccer Cultural Exchange Foundation (el “Organizador”) en Paris, Francía, incluyendo pero no limitado a la participación y asistencia en la experiencia deportiva, transporte terrestre, alojamiento, alimentación, y varias actividades deportivas y recreativas (en su conjunto, el “Viaje”), por la presente:
I, the undersigned, in consideration of being permitted to participate in BA Cup Paris (the “Sports Experience”) travel program organized by Fundación Gol: International Soccer Cultural Exchange Foundation (the “Organizer”) in Paris, France, including but not limited to sports experience attendance and participation, ground transportation, hotel accommodations, meals, and various sporting and recreational activities (collectively, the “Trip”), hereby:
1. Reconozco y acepto ser legalmente obligado por los términos y condiciones del Acuerdo de Servicios del Viaje BA Cup Paris, el cual una copia fue entregada y revisé sus términos y condiciones. Certifico que autoricé el Representante de los Participantes a ejecutar el Acuerdo por mi parte y acepto, como resultado, que él/ella esté actuando como mi agente.
Acknowledge the terms and conditions of and agree to be bound by the Travel Services Agreement for BA Cup Paris (“Travel Services Agreement”), a copy of which has been previously provided to me and I have reviewed the terms thereof. I certify that I have authorized the Participants’ Representative to enter into the Travel Services Agreement on my behalf and agree that he/she is acting as my agent in doing so.
2. Entiendo y reconozco que el Viaje incluye ACTIVIDADES PELIGROSAS, incluyendo, pero no limitado a la participación en el deporte de fútbol y/o actividades recreativas como parques de diversiones, y que estoy participando voluntariamente en ellas con el conocimiento del peligro involucrado. Entiendo específicamente y reconozco que el FUTBOL es un deporte físico y de contacto que tiene el riesgo de LESION. Además, reconozco que participar en actividades deportivas y recreativas durante el Viaje, y viajando entre ellas, tiene el RIESGO de daño o lesión a mi cuerpo o mi propiedad, incluyendo el riesgo de discapacidad permanente y muerte, o cualquier otra consecuencia imprevista como las cuales que puedan resultar por una falta de una asistencia inmediata en una situación de emergencia. Por lo presente, acepto ASUMIR CUALQUIER Y TODO EL RIESGO DE LESION O MUERTE que pueda ser un resultado de mi participación en el Viaje, y asumo responsabilidad total por cualquier y todas las lesiones, daños (económicos y no-económicos), y perdidas de cualquier tipo que puedan ocurrir durante el Viaje.
Understand and acknowledge that the Trip involves DANGEROUS ACTIVITIES, including but not limited to participation in the sport of soccer and/or recreational activities such as amusement park rides, and that I am voluntarily participating in these activities with knowledge of the danger involved. I specifically understand and acknowledge that SOCCER is a physical, contact sport that involves the risk of INJURY. I further acknowledge that participating in sporting and recreational activities during the Trip, and travelling to and from such activities, involves the RISK of damage or injury to my body or my property, including the risk of permanent disability and death, or other unforeseen consequences including those which may be due to the unavailability of immediate emergency medical care. I hereby agree to ASSUME ANY AND ALL RISK OF INJURY OR DEATH which might be associated with or result from my participation in the Trip, and to assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type which may occur to me during the Trip.
3. Entiendo y reconozco que el Organizador, ni el Torneo, tienen un seguro médico y/o un seguro de lesiones personales que cubre mi participación en el Viaje. Por lo tanto, certifico que tengo un seguro médico y/o seguro de lesiones personales que esta activo y actualizado para cubrir mi participación en el Viaje. Reconozco y acepto que, bajo cualquier condición, soy responsable por cualquier y todas las expensas médicas de mi participación en el Viaje, incluyendo, pero no limitado a todas las actividades deportivas y recreativas y al viaje ida/vuelta entre ellas. Además, certifico que estoy en aptas condiciones para participar en todas las actividades deportivas y recreativas planeadas durante la estadía, y que presenté un permiso médico activo al Organizador, y no tengo enfermedades, o lesiones preexistentes o defectos físicos que serían agravados con mi participación. Informaré a mi entrenador y al Organizador si hay un cambio a mi estatus de salud.
Understand and acknowledge that neither the Organizer nor the Tournament carries medical and/or personal injury insurance that covers my participation in the Trip. Therefore, I hereby certify that I have a current, active, medical and/or personal injury insurance policy in force, which covers my participation in the Trip. I acknowledge and agree that, under any condition, I am responsible for any and all medical expenses arising from my participation in the Trip, including but not limited to all sporting and recreational activities and travel to and from such activities. I further certify that I am in proper physical condition to participate in all sporting and recreational activities planned during the Trip, have submitted to Organizer a current medical consent form, and have no illness, disease or existing injury or physical defect that would be aggravated by my participation. I will inform my coach and the Organizer if this status changes.
4. Acepto cumplir con todos las reglas y requisitos impuestos por el Organizador y el Torneo con respecto a mi participación en el Viaje. Además, acepto comportarme en una manera controlada y razonable todo el tiempo, y abstenerme de usar propiedades, equipamiento, o instalaciones en una manera inconsistente con su diseño y uso. Entiendo y reconozco que los participantes puedan ser despedidos de participar en el Torneo y/o el Viaje, sin un reembolso de dinero, por conducta inapropiada o violenta o antideportiva dentro y fuera del campo. Acepto pagar por cualquier y todos los daños a personas, propiedad, o indemnizaciones causados por mi obstinadamente, negligencia, o por otro motivo.
Agree to comply with all rules imposed by the Organizer and the Tournament regarding participation in the Trip. I further agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any property, equipment, or facilities in a manner inconsistent with their intended design and purpose. I understand and acknowledge that participants may be dismissed from participation in the Tournament and/or the Trip, with loss of payment, for improper or violent conduct or unsportsmanlike behavior on or off the field of play. I hereby agree to pay for any and all damages to any persons, property, or indemnities caused by me willfully, negligently, or otherwise.
5. RENUNCIO, DISPENSO, Y DESCARGO CUALQUIER Y TODOS LAS DECLARACIONES, RESPONSABILIDADES, Y CAUSAS DE ACCION y acepto DEFENDER, INDEMNIFICAR, Y EXONERAR el Organizador, sus directores, empleados, afiliados, agentes, sucesores, y cesionarios de cualquier o todos las DECLARACIONES, DEMANDAS, PERDIDAS, EXPENSAS (INCLUYENDO GASTOS LEGALES), DAÑOS, RESPONSABILIDADES, Y/O CAUSAS DE ACCION DE CUALQUIER TIPO, presentes o futuros, conocidos o desconocidos, anticipados o imprevistos, resultando o conectado en cualquier manera con mi participación en el Viaje.
RELEASE, WAIVE, AND DISCHARGE ANY AND ALL CLAIMS, LIABILITIES, AND CAUSES OF ACTION and agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Organizer, its directors, officers, employees, affiliates, agents, successors, and assigns FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, EXPENSES (INCLUDING ATTORNEY’S FEES), DAMAGES, LIABILITIES, AND/OR CAUSES OF ACTION OF ANY NATURE, present or future, whether known or unknown, anticipated or unanticipated, arising out of or connected in any way with my participation in the Trip.
Leí completamente este Acuerdo de Exención de Responsabilidad, Renuncia, e Indemnización y entiendo completamente todos sus términos. Entiendo que este es un RECONOCIMIENTO Y ACUERDO DE LA EXENCION DE RESPONSABILIDAD, RENUNCIA, E INDEMNIZACION que es jurídicamente vinculante el cual prohíbe a mi o a otra persona por mi parte de recuperar daños en una demanda en el caso que me lesione o me muera. Reconozco que firmando este Acuerdo me rindo derechos considerables, y testifico que lo firmé libremente y voluntariamente sin incentivo, promesa, o garantía. Este Acuerdo también es coercitivo para mis sucesores, cesionarios, herederos, ejecutores, representantes, y administradores. Este Acuerdo puede ser firmado y enviado electrónicamente. Las firmas digitales autenticarán este contrato y tienen la misma fuerza y efecto como una firma manual.
I have completely read this Acknowledgment and Waiver of Liability, Release, and Indemnity Agreement and fully understand all of its terms. I understand that this is a legally binding ACKNOWLEDGMENT AND ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT which bars me or any person on my behalf from recovering damages in any lawsuit in the event of my injury or death. I acknowledge that I have given up substantial rights by signing this Agreement, and attest that I have signed it freely and voluntarily without any inducement, assurance, or guarantee. This agreement shall be binding on my successors, assigns, heirs, executers, representatives, and administrators. This agreement may be signed and transmitted electronically. Such electronic signatures are intended to authenticate this writing and to have the same force and effect as manual signatures.
