• WAIVER and RELEASE OF LIABILITY
     
    This waiver can be used for one or multiple NYYC regattas, as listed below, in which you plan to participate in 2022.
     
    Please select only the regatta(s) for which you have a confirmed entry/invitation. If you add (or subtract) a regatta after submitting this form, please contact the NYYC Sailing Office and they will be glad to update your form. You do not need to submit an additional form. Thank you!

  • WAIVER and RELEASE OF LIABILITY
     
    In consideration of being allowed to participate in any way in New York Yacht Club Sonar events ("Sonar Regattas"), related events and activities, the undersigned acknowledges, appreciates, and agrees that:
       
    1) The risk of injury from the activities involved in Sonar Regattas are significant, including the potential for damage, injury, permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
     
    2) I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by participation in any regatta, event or Sonar charter, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, negligence, gross negligence, willfulness or intentional acts of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
       
    3) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
       
    4) I willingly agree to comply with the stated and customary terms and conditions for participation. I am familiar with and understand Racing Rules of Sailing rule 3, Acceptance of the Rules, and, in particular, rule 4, Decision to Race. I agree to uphold both the letter and spirit of the Racing Rules of Sailing with fair play and honesty, and show responsible conduct toward all race officers, umpires, judges, regatta volunteers, staff, fellow competitors and crew members. I will respect the property of the New York Yacht Club, its members, guests and fellow competitors.
       
    5) I, for myself and on behalf of my heirs, executors, administrators, successors, assigns and next of kin, HEREBY RELEASE AND HOLD HARMLESS the New York Yacht Club Regatta Association, Inc., New York Yacht Club, any sponsors and affiliated companies, each of their officers, directors, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, including the Organizing Authority, Race Committee, Protest Committee, volunteers, or any other affiliated organization or official, (collectively as "Releasees") WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
     
    6) I verify that I can swim 20 yards and tread water for 3 minutes.
      
    I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
  • MEDIA RELEASE

    Competitors and crew members grant, at no cost, the New York Yacht Club Regatta Association, Inc., and New York Yacht Club, the absolute right and permission to use their name, voice, image, likeness, biographical material in any media World-wide (being television, print and internet media), including video footage, for the sole purposes of advertising, promoting, reporting and disseminating information regarding team racing at NYYC.

    If under the age of 18 : I, the understood parent or lawful guardian of the above named person, do hereby grant my permission and consent for my child to participate in the above listed event(s) and agree to the Liability & Media Waiver on my child's behalf.
     
  • DAMAGE DEPOSIT - SKIPPERS ONLY
     
    All skippers will be required to provide a $500 damage deposit prior to the start of racing by providing credit card information or NYYC member number at registration. The deposit is a per-incident maximum. If a skipper has more than one incident, he or she is then liable for up to $500 for each subsequent incident. Skippers should be aware that while the Team Race Representative or Waterfront Staff will attempt to identify all damage at the post-regatta inspection, often this is not possible due to the nature of the damage. The skipper is responsible for all damage, even if it is discovered only after the post-regatta report is completed and signed. In the event that there is material damage not covered by insurance and no one acknowledges responsibility (e.g., crews are rotated among the boats and no one reports the damage), the cost of repairs will be charged to all the designated skippers on a pro rated basis.
        
    As skipper of a boat, I am responsible for the following:
       
    a. Any contact incident resulting in damage to a Sonar or any other boat(s), equipment, or property.
        
    b. Inspecting each Sonar I sail along with the designated Team Racing or Waterfront Staff both prior to racing and after racing. I will sign the regatta damage report that will identify all visible damage; however, as skipper I will also be responsible for all material damage even if it is not discovered until after the inspection.
        
    c. Delivering the boat to the location specified by the Team Racing or Waterfront staff and, if so requested, providing at least two persons to assist in hauling the boat and placing it on the trailer.
