This contract affects every aspect of your responsibilities so read it carefully. Understand each paragraph and ask your Coordinator or Manager any questions you may have, then sign below. By signing you agree you fully understand and accept all term and conditions below.
1.) I understand am not an employee but rather an independent contractor that sets my own hours and will not be paid by the hour. As an independent contractor I am responsible for my own insurance, workmans comp, federal and state taxes, and promise to file all federal, state, and local income taxes as an independent contractor. I agree to complete an IRS W9 form, provide a copy of my license or state ID, and copy of my social security card before payment will be made. This information will be kept on file for the purpose of filing an end of year 1099 form with the IRS only with your Coordinator or Manager.
2.) I understand that the funds for each petition are paid by an independent petition management company to my Coordinator or Manager. It is at the discretion of my Coordinator or Manager when and how my payment is made. in the event signatures wilt no longer be accepted or paid by the petition management company, my Coordinator or Manager will have no liability to pay on signatures I have gathered.
3.) I understand and agree to the following rules concerning the collection of signatures.
a.) All information on the petition must be filled out completely and legibly, in the VOTERS OWN HANDWRITING, and in BLACK BALLPOINT pens only.
b.) Petition declaration must be filled out completely and legibly in my own handwriting also in BLACK BALLPOINT pen only.
c.) understand if I fail to complete the petition declaration correctly will be charged back for the entire sheet.
d.) No Post Office Boxes (PO Boxes) will be accepted on my petitions or declarations.
e.) I will abide by any applicable local, state, and federal requirements and regulations.
f.) I MUST be present while information and signatures are obtained.
4.) I understand that by signing my Petition Declarations I am swearing under penalty of perjury thaf I have witnessed the signatures and information gathered and that they are correct and valid, according to rules in paragraph 3, to the best of my knowledge.
5.) I understand that the signatures collect will be purged and checked before I am paid, and that I will be paid according to the following guidelines:
a.) My signatures will be purged for missing and incorrect information, incorrect counties, and illegibility
b.) The names and addresses of the persons who signed my petition(s) will be checked Against the most current list of registered voters available to my Coordinator or or Manager in the state I am working in.
c.) I will be paid for 100% of my valid legible signatures if, based on a random check a minimum of 75% of my signatures are from VALID registered voters. If only 45%-74% of my signatures are from valid registered voters, I will only be paid for that percentage of my turn in (I.E if only 60% of my signatures are valid , then I will only be paid that percentage of my turn in. If only 44% or less of my signatures are from valid registered voters, then I will not be paid for that turn in and my contract may be terminated at my Coordinator or Managers discretion.)
d.) I understand that I will be charged back for any signatures that have been paid by above percentages when the final process and validation, done by the petition management company, that are declared invalid for reasons that were not foreseen upon initial processing or validation by my Coordinator or Manager. I understand that I may have funds withheld when a petition is withdrawn from circulation to for chargeback purposes on that particular petition.
6.) I understand that a petition is a legal document and that it is a FELONY to forge a signature (I.E. signature, printed name, or address) any forgery will be discovered during the signature validation process and will automatically be turned over to the proper authorities for prosecution. If any forgeries are found, even one I will not be paid for any of my signatures and may also be civilly liable as well as criminally prosecuted to the fullest extent of the law.
7.) If am not paid in full for my signatures because pf non registered voters or forgery, may request a copy of the report that states the reason for the signatures not being paid in full, or a copy of the signatures in the case of forgeries if they are readily available for copying from my Coordinator or Manager.
8.) Under no circumstance will I purposely deceive or misrepresent the content and purpose any petition to the public.
9.) I understand that a petition will end when the required number of signatures have been obtained. If at all possible I will be given 24-hour notice of the ending date via communication with my Coordinator, Manager, or social media where all information regarding the petition business is posted. It is my responsibility to keep up with the status of any petition drive I am on. I understand that after a petition has ended no Signatures will be accepted under any circumstances after the final turn in.
10.) I agree to abide by all instructions, both oral and written, given to me by my Coordinator or Manager regarding the state rules and campaign rules. I agree to take responsibility to understand the state and local rules that I am to abide by regarding signature gathering and/or voter registration cards. I understand that if I fail to comply with state rules and regulations or campaign rules am subject to immediate termination of this agreement and any further acceptance of my signatures by my Coordinator or Manager.
11.) I understand that my Coordinator or Manager is under no obligation to accept my signatures for any reason, at any time and my contract may be terminated at any time for any rule violation or any other reason at the Coordinator or Managers discretion. Any unpaid signatures will be processed as the process allows and will be paid within 30 days of termination.
I understand that the amount per signature and this agreement will vary during the course of this campaign.
