The Participant acknowledges the inherent risks which are involved in riding and working around horses. These risks may include, but are not limited to, damage of personal property, illness, bodily injury, trauma, or death resulting from a fall or while riding or being in close proximity of horses.
The Participant further understands that both horse and rider can be injured in the normal course of events while riding, training, or competing, and therefore agrees to indemnify and hold harmless Stable and its employees, and further release them from any liability or responsibility for any accident, injury, damage, or death to the Participant or any property or horse the Participant owns, or to any family member or spectator accompanying the Participant while on the premises of Stable.
LIABILITY RELEASE
For purposes of this Agreement, Rosewood Equine, LLC, operated by Lora and Evan Hedrich, and Frogton Pond Horse Farm, owned by Sara Byers and Ellien Laramee-Byers, located at 165 Candlewood Hill Road, Francestown, NH, together with their respective owners, officers, agents, employees, members, insurers, and affiliated organizations, shall be collectively referred to as “THE STABLE.”
In consideration of THE STABLE allowing my participation in equine-related activities under the terms set forth herein, I, the undersigned RIDER, and the parent or legal guardian thereof if a minor, agree to hold harmless and release THE STABLE from legal liability arising from THE STABLE’S ordinary negligence.
I further agree that, except in the event of THE STABLE’S gross or willful negligence, I shall bring no claims, demands, actions, causes of action, or litigation against THE STABLE for any economic or non-economic losses due to bodily injury, death, or property damage sustained by me and/or my minor child or legal ward in connection with the premises and operations of THE STABLE, including but not limited to riding, handling, caring for, or otherwise being in proximity to horses owned by or in the care, custody, or control of THE STABLE.
New Hampshire - ATTENTION! Under New Hampshire law, a participant in equine activities assumes the risk of any injury, harm, damage, or death and any legal responsibility that may occur to participant resulting from the inherent risks associated with equine activities. Pursuant to R.S.A. 508:19, equine professionals are not liable for damages resulting from the inherent risks of equine activities.
