ASSUMPTION OF RISK AND RELEASE

The undersigned agrees to provide this Assumption of Risk and Release in consideration for the undersigned’s voluntary participation in the National Girls and Women in Sports Day Event (“the Program”), at Aramark STAR Pavilion located at 1816 N. 15th Street, Philadelphia, PA, on February 7, 2024, undertaken by Temple University-Of The Commonwealth System of Higher Education (“Temple”).

The undersigned understands that participation in the Program involves athletic activities including, but not limited to, running, jumping, physical contact with other participants, loss/theft/damage to personal belongings, risk of slips/trips/falls, and negligent acts of the undersigned or others that may result in injury or even death.

Intending to be legally bound to the fullest extent permitted by law hereby, the undersigned, for the undersigned and on behalf of their assigns, legal representation, executors, administrators, representatives, heirs, and members of their family, hereby expressly agrees to:

1. Forever release, discharge and agree not to sue Temple and all its successors, assigns, affiliates, officers, trustees, employees, directors, administrators, and agents from all manner of actions and causes of action, suits, debts, accounts, judgments, damages, claims and demands whatsoever in law or equity, and attorney’s fees including all claims arising out of any incidents involving personal injury in any way by reason of participation in the Program;

2. Assume any and all risks arising from the undersigned’s participation in the voluntary Program named above, including without limitation, the risks of death, bodily injury, or property damage, the unavailability of emergency medical care or the negligent or the deliberate act(s) of another person;

3. Confirm the undersigned knows of no medical condition(s) that would preclude participation in the Program;

4. Indemnify, defend, and hold Temple harmless from any and all claims, causes of action, damages, judgments, losses, costs or expenses that arise out of or relate to the negligent or intentional act or omission of the undersigned; and

5. Allow Temple to Record my likeness and voice on video, audio, photographic, digital, electronic or any other medium now existing or later invented; and Use my name in connection with these recordings; and Use, reproduce, exhibit or distribute in any medium and via any method (including, without limitation, photos, print publications, video, CD/DVD-ROM, e-mail, Internet/WWW, social networking sites) these recordings for any purpose that the university deems appropriate, including promotional or advertising efforts.

The undersigned expressly acknowledges that the undersigned has read and understands this Assumption of Risk and Release and signs it freely and voluntarily.
