PURCHASE AGREEMENT & BILL OF SALE 2025/2026

  • DEPOSITS: Please note that deposits will not be returned if a puppy is not available for the sex/color Puppy Buyer has requested. However, the deposit will be transferred to another litter in the event a puppy is not available for the sex/color the Puppy Buyer has requested. The puppy Buyer will be allowed to move to the end of the deposit list of available puppies of the opposite sex/color or move to the next list for an upcoming or planned breeding.

If you choose to push your deposit back, you will no longer be locked into the original price format. If the price increases, you will have to pay whatever the price is at the time you choose to get a puppy. If you change your mind about the purchase, you can use the deposit later, but it will not be refunded.

    Puppy Ownership Clause

Ownership of the dog does not transfer from the breeder until the puppy has been paid for in full and has been collected by the purchaser.

The individual who signs this contract is considered the sole legal owner of the dog. No co-ownership arrangements are permitted. Even in the case of marriage or partnership, only the person whose name appears on this contract will be recognized by the breeder as the legal owner.

In the event of a separation, if the non-signing party wishes to keep the dog, a new contract must be executed at the time of the separation. Failure to do so will be considered a breach of this contract.

    Deposit Transfer Policy (Puppy Wait‑Lists):

    One Complimentary Transfer:
Your initial reservation fee includes one no‑questions‑asked move to any of our open puppy wait‑lists. Let us know before the litter you are currently on reaches eight weeks of age.

    Additional Moves:
A second (or subsequent) transfer may be requested only at the time of birth of the new litter you wish to join. Please notify us within 48 hours of the whelping announcement. The transfer is subject to space availability on that litter’s list.

    Forfeiture of Deposit:
If you request a 3rd (or later) move after puppies in your current litter are over 2 weeks old. The original deposit is considered spent, and a new reservation fee will be required to hold a place on any future list. Both deposits will go toward the price but we will require further commitment from you.

This policy is in place to prevent excessive or last-minute list shuffling for trivial or impulsive reasons, which causes stress for both us and other committed families. Thank you for understanding and respecting the process.

PUPPY SELECTION: The date that your deposit is received will determine the order of availability. The order of deposit does not determine a pick order. It does not matter if you are the 1st deposit or the 8th deposit because we do not establish picking orders on a first-come, first-served basis. Nosam Kennels will carefully match you up with a puppy based on our discussions, the information you submitted in your application, and after evaluating each puppy in the litter. We feel that this method provides the best chance of success in matching each client with the best possible dog for them. We select puppies for clients because we want you to be happy with your dog! We will send frequent photos/videos throughout development. Nosam reserves the right to first pick on all litters. Puppies will be matched to families after their final vet visit, the day before they get sent home.

    NOSAM KENNELS RECOMMENDATIONS:

We encourage our puppy buyers to test their puppy in NAVHDA or AKC HUNT TESTS. If help is needed to prepare a puppy for one of these tests, please inquire via email. This is not required but highly recommended to allow us to evaluate our puppies' natural instincts to produce better dogs & prove our lines

Even pets can compete in these tests with very minimal training. Our success is dependent on owners putting in the effort to prove their puppies.

    • Expose the puppy to a hunting environment in preparation for NAVHDA's Natural
    Ability Test

    • Test the puppy in NAVHDA's Natural Ability Test before the puppy reaches
Sixteen (16) months of age or AKC Junior Hunter Test by 24 months.

Testing Incentives: Nosam will reimburse entry fees for dogs with passing test results.

    Title: Incentive & Reimbursement Policy

At Nosam Kennels, we are passionate about preserving and promoting the natural ability, structure, and trainability of the breeds we raise. As such, we strongly encourage our puppy buyers to participate in hunt tests, NAVHDA events, and other titling opportunities that showcase and prove the dog's potential in the field or structured performance work.

To support and reward your efforts, Nosam Kennels offers reimbursement incentives for select titles earned:

NAVHDA Natural Ability (NA) Title – Reimbursement of entry fee upon successful completion with a Prize I , II, III score.

AKC Junior Hunter (JH) – Reimbursement available after title is completed and proof is provided.

Additional Titles (such as SH, MH, or NAVHDA Utility) – May qualify for further incentives on a case-by-case basis.

    Requirements for Reimbursement:

Proof of title (certificate or official results) must be submitted.
Reimbursement requests must be made within 60 days of title completion.

This program is designed to encourage responsible ownership and help showcase the quality of Nosam-bred dogs. We believe in our dogs, and we’re proud to support those who invest the time and effort into proving them.

     Health Recommendations:

    • The use of chemical flea and tick products is not recommended due to containing neurotoxins which can present in the form of seizures/epilepsy. The use of these products results in seizures that are not genetic and are not covered by our guarantee. The use of these products is the owner's decision, but Nosam does not recommend them.

    • The use of NON-CORE vaccines such as Corona, Leptospirosis, Bordetella, Lyme, etc, is not recommended unless these diseases are prevalent in the area, and should never be administered along with the Core vaccines but rather separately, and at a time when the puppies' immune system is mature. A percentage of puppies may manifest an autoimmune reaction following vaccination. Although many puppies can be vaccinated with no adverse reactions, there is no way at present to determine which puppies may react. Therefore, we do not recommend these vaccines, and they are up to the owner's discretion; however, we cannot cover immune-related diseases that may present from using these vaccines if you choose to use them.

    • We recommend that owners titer test their dogs yearly for immunity instead of choosing to over-vaccinate. The choice is ultimately up to owners & their vet.

    • We recommend keeping puppies on Nuvet supplements. Use Code 21995 to order.

    RESPONSIBILITIES OF PUPPY BUYER
    Puppy Buyer agrees to:

    • Pick the puppy up at 8 weeks on the date set by Nosam. Usually Sat & Sun around the 8-week mark. We do not "hold" puppies past the week 8 mark.

    • Come to puppy, send home with a registered name picked out, including the prefix
    “NOSAM'S"

    • Provide the puppy with a hunting home or equivalent purpose that is suitable for
their energy levels and stimulation needs.

    • Having a yard can be a great asset, but dogs—especially active breeds—still need regular exercise, mental stimulation, and social interaction beyond backyard time. Dogs need regular opportunities to leave the home for exercise, socialization, and mental stimulation.

    • Buyer agrees that the dog must be enrolled in and attend at least 3 formal training classes conducted outside of the home within the first 12 months of the dog's life. This class must be led by a professional trainer or held at a reputable facility. Proof of enrollment and completion may be requested. This requirement is designed to promote socialization, obedience, and the formation of a strong human-canine bond.

    This is not optional.

    1. At least one (1) puppy socialization class (for dogs under 6 months of age).

    2. At least one (1) basic or intermediate obedience class led by a professional trainer or held at a reputable training facility.

    3. One (1) additional class of the adopter’s choice, such as obedience, manners, enrichment, or a specialty class (e.g., recall, loose leash walking, etc.).

Any dog that takes at least 1 puppy class and completes at least a 4-week board and train for obedience or hunt training will be considered to have met the requirement without the additional courses.

    • Keep the puppy in the house as part of the family

    • Maintain the puppy in good health as recommended by a veterinarian. Puppy
Buyer shall provide all proper immunizations, regular vaccine boosters, fecal exams, heartworm tests, and recommended routine therapy

    • Will not spay or neuter the puppy until it is a minimum of 16 months old.

    • Set up a post-sale vet visit

•Activate your health insurance before you pick up your puppy. We offer Trupanion with puppies. Call within 24 hours of getting your pet to activate. All puppies should go home with health insurance activated in order to keep the health guarantee.

NAMES: Our litters will be pre-registered with our kennel name: NOSAM. All of our litters will be prefilled with a name according to the letter of the litter or Litter theme. All puppies must have a unique registration name; you may call them whatever you wish. Nosam's will be at the start of the name.

For example: Nosam's Just Because You Can.

PUPPY PICK-UP: We prefer you pick up your puppy at our home in Kentucky. Puppies leave for new homes at 8 Weeks of age. We cannot hold puppies for extended periods; it is critical for their social development that the litter departs within a reasonable timeframe. If the litter's go-home date doesn't align with your schedule, you may transfer your deposit to the next litter as long as you let us know before the litter has reached 6 weeks of age, so that we have time to find another suitable home.

The collection of your puppy must be booked promptly on the dates provided by the breeder. Pick-ups will be set around the time puppies turn 8 weeks of age.

Everyone on the list will be notified and provided with 2 date options to select from for pickup, and puppy buyers will be expected to pick up or have arrangements for a shipper to collect their puppy on the set date. Nosam will provide the pick-up date for the litter by the time puppies reach 1 week of age, so the buyer has 7 weeks to prepare for picking up their puppy.

Your down payment pays for the hold of a puppy, time spent occupying a spot, and any professional services shared directly with you by Nosam Kennels. Failure to book your puppy's pick-up or collect your puppy by 8 weeks will result in forfeiture of your deposit.

If an arrangement is made for a later pickup, there will be a $100 daily fee to board your puppy. This fee must be paid before the puppy is picked up, along with the full puppy payment. Later pick-up dates are not guaranteed, and Nosam has the right to refuse a later pick-up if their schedule doesn't align.

Nosam is not responsible for the shipping/delivery of your dog, and all costs will be the buyer's expense. If you choose to have your puppy delivered, then payment must be received in full (7 days) before the puppy is set to leave.

Buyers understand they are on camera when entering the property. Buyers understand they will not Hold Nosam Kennels or affiliates liable from and against any and all claims, demands, causes of action, and damages, including attorneys’ fees, resulting from any accident, incident, or occurrence arising out of, incidental to, or in any way resulting while entering premises and all improvements thereon, including tripping, stumbling, falling, slipping, etc.

  •

    Health Guarantee

•To the best of the breeder’s knowledge, the puppy is sound, healthy, and free from disease or disability as far as has been discerned. The puppy has been given their first set of vaccinations, has been dewormed, and has had a health check by a licensed veterinarian.

Buyers will be prepared and educated on the stresses of introducing a new puppy to their family and should have active pet health insurance when adding a puppy to their family to cover any issues that may arise.

A preventative meeting with your vet is recommended so that you have the supplies necessary should they be needed. Nosam Kennels is not responsible for any conditions brought on by the stress of shipping, new home relocation, or adaptation of the puppy into a new family environment

    Veterinary Examination Requirement:
The Purchaser is required to have the puppy examined by a licensed veterinarian within three (3) calendar days of the date of transfer for a general health evaluation. This requirement applies regardless of when the Purchaser joined the waitlist or reservation list.

Failure to complete this veterinary examination within the required timeframe will automatically void the health guarantee portion of this contract, while all other terms and conditions of the contract shall remain in full force and effect.

Written proof of the veterinary examination must be submitted to Nosam Kennels within three (3) days of the exam.

Puppy Buyer can return the puppy at Puppy Buyer’s expense for a full refund if it develops an illness within three days of being picked up. The Puppy Buyer must notify Nosam Kennels immediately following diagnosis. Documentation must be provided by Puppy Buyer’s veterinarian and will be reviewed by Nosam Kennel’s veterinarian for concurrence. The Puppy Buyer must set up the return of the puppy within 24 hours of notifying Nosam Kennels of the puppy’s illness, with all registration paperwork and health records at the Puppy Buyer’s expense.

Any condition that is minor, correctable, or caused by early spay/neuter is not covered. Conditions that could go away or are considered to be conditions that a puppy will likely grow out of are not covered. The conditions not covered include but are not limited to umbilical hernia, undescended testicles, overshot or undershot bites (these flaws will be pointed out at selection and the buyer will have an opportunity to pass for the next litter), UTIs, cuts, injuries, any external parasites, internal parasites, poisoning, reproductive problems, accidents, vaccine or medicine-related reactions, skin disorders such as mange or allergies, or any other minor condition are not covered.

Nosam Kennels does not accept responsibility for contagious diseases diagnosed after three days from the date of pick up. If, during examination by Puppy Buyer’s veterinarian, a genetic issue is found and documented in writing by the examining veterinarian, the puppy may also be returned at Puppy Buyer’s expense for a full refund. If the genetic issue can be repaired and the Puppy Buyer wishes to
If so, expenses will be the sole responsibility of the Puppy Buyer.

If a puppy should die before the extent of this guarantee, a necropsy must be performed within 24 hours of the puppy’s passing to determine the cause. Findings must be forwarded to Nosam Kennels from the vet directly.

REMEMBER, YOU ARE BUYING A PUPPY, NOT A GUARANTEE. THE BEST GUARANTEE
FOR A HEALTHY PUPPY IS ONE WHOSE PEDIGREE OF ANCESTORS CAN BE PROVEN
TO BE HEALTHY AND SOUND THEMSELVES.

Anomalies can always happen that result in health issues: spontaneous mutations, illnesses that can be caused by mutations on multiple genes, or physical trauma that can change the bone structure of a developing puppy. Nosam has health-tested parent dogs to lower the risk of those anomalies.  The risk of a genetic disease is most likely inherent in all living creatures to some extent.

•Types of Hip/elbow dysplasia not covered are nutritional and environmental dysplasia.OFA or Penn Hip organizations must declare the dog with crippling hip dysplasia for the dog to be replaced. If the buyer does not provide such proof that every step was taken to assure the good health of the puppy, no refund or replacement puppy will be given. Should the dog develop crippling hip dysplasia and be x-rayed and OFA Rated moderate to severe or Penn Hip showing CHD, (with verification of the hip condition signed by a veterinarian provided)Nosam Kennels will replace the dog as soon as one becomes available. Please note that the risk of development of hip dysplasia doubles, in dogs who are spayed/neutered early and we do not cover joint issues in dogs who were spayed/neutered prematurely.

•Should any circumstances arise that affect the quality of life of the puppy Nosam Kennels should be informed so they may participate in determining the future of the puppy

•Seller does not assume responsibility for any other veterinary bills or expenses incurred by the purchaser on behalf of the dog after the dog has left our kennel.

•The Buyer agrees to maintain preventative health care of the puppy, including, but not limited to, inoculations, internal as well as external parasites, and heartworm preventative medications.

    RETURN OF DOG

If, for any reason, the Puppy Buyer can no longer care for the puppy, Nosam Kennels shall be given the first opportunity to resume ownership; however, if Nosam Kennels resumes ownership, the puppy will be returned with all of its registration paperwork and health records, where we will provide proper placement. Under no circumstances should a puppy be sold, transferred, traded, or surrendered to an animal control facility, shelter, rescue, laboratory, or a cash refund given for the return. Doing so, Puppy Buyer will be responsible for a fee of $5000 plus any legal or recovery costs associated with the return of the puppy to Nosam Kennels. The buyer is responsible for all transport/fees/costs associated with returning the dog to Nosam Kennels and arranging said transport. Any costs to retrain, vet, and board the dog until a new placement is found will be the owner's expense and due upon the return of the dog.

    Future Care Planning Requirement

In the event of my death or if I am no longer able to care for my dog for any reason, I acknowledge and agree that the dog must be returned to the breeder. All family members and caregivers should be made aware in writing that the dog is not to be rehomed, surrendered to a shelter, or left in uncertain care. Before purchasing a puppy, all families must make written arrangements for the care of the dog in the event of their death or serious incapacity. These plans should be communicated in WRITING to all relevant family members and designated caretakers with the information (dog's DOB/Breed/Microchip info & breeder contact).

In the event no such plan is in place, the dog must be returned to the breeder.

  • Registration

NON-BREEDING: Not every dog in a litter should be bred. Breeding is a big financial burden and can put the dog at risk. Therefore Nosam has chosen to restrict the breeding of their puppies to educate Puppy Buyers as well as protect and maintain the integrity of the breed.

Buyer understands that we do not sell puppies with breeding rights or furnish puppies to homes for breeding. To protect our lines, we retain the right to place all puppies on non-breeding contracts. Buyer agrees and understands that the dog will be registered on an AKC or NAVHDA non-breeding Limited Registration will not be reversed unless the specifications to do so are met.

Buyer understands the dog will NOT be permitted to produce ANY litter during its lifetime and should be spayed/neutered by 2 years of age. Proof of spay/neuter should be sent to Nosam by 24 months of age. Any other arrangements may only be made with the Seller’s written consent. Any puppies produced will be the property of Nosam Kennels.

Puppies are sold on limited registration and must meet the requirements for this to be released at the breeder's discretion.

If a dog sold on limited registration is bred we will not consent to registration with ANY register including AKC (American Kennel Club) for the resulting litter(s). Limited Registration means that the dog cannot produce registered offspring unless the breeder revokes the limited status. Nosam Kennels will happily revoke the limited status and provide full breeding registration after you meet our criteria.

    Dog Sports/Showing:

Pet puppies on Limited AKC can still fully participate in sports like dock diving, agility, Hunt tests and other performance events—so Limited registration doesn’t hold you back there. However, conformation showing isn’t allowed on Limited AKC, which is what we sell all puppies with.

If you wish to show your puppy in AKC conformation, you’ll need FULL AKC registration, which requires a different contract. This standard contract is for Limited AKC and doesn't allow for conformation or breeding. This contract includes a commitment to earn an AKC Championship title with the dog and Co-ownership with Nosam Kennels. If you wish to show in Conformation you need to ask us for a copy of our Show Contract.

    Breeding:

The requirements for releasing full breeding registration are to meet one of the Hunting Ability requirements and all the health requirements.

Not all dogs should be bred, as breeders, Nosam Kennels understands this. There
are risks involved when breeding dogs, including the health and mortality of the female and puppies. Therefore, Nosam Kennels has chosen to limit the registration of their puppies to educate Puppy Buyers as well as protect and maintain the integrity of the breed.
If the Puppy Buyer wishes to breed their puppy, the Puppy Buyer agrees to health testing, testing, and titling, as well as physical examination/evaluation and temperament testing/evaluation
before Nosam Kennels will lift limited registrations. The decision will be made
together on whether the dog in question should be bred. Ultimately, we hold our Puppy Buyers to the same standards we hold ourselves when determining if a dog should be bred and that it would be an improvement to the breed.
