Waiver and Release

In consideration of Enrollment in Alpine BJJ Academy, the Student, or Minor Student and his or her legal guardian,
(individually or collectively “the student” agrees as follows:

 

1. Participation in this program and use of the facilities (collectively “the Activities”) involves the risk of injury to the student or
to the student’s guests, whether the student or someone else cause it. Specific risks range from minor injuries to major
injuries, such as catastrophic injuries including death. Participation in the Activities is a DANGEROUS ACTIVITY. In
consideration of Student’s participation in the Activities offered by Alpine BJJ Academy, the Student understands and
VOLUNTARITY ACCEPTS THIS RISK and agrees that Alpine BJJ Academy, its officers, directors, employees, volunteers,
agents, and independent contractors will not be liable for any injury, including without limitation, personal, bodily, or mental
injury, permanent disability, economic loss or any damage to the Student, the Student’s spouse, guests, unborn child, or
relatives resulting from the negligence and/or fault of Alpine BJJ Academy or anyone on Alpine BJJ Academy’s behalf or
anyone using Alpine BJJ Academy’s facilities whether related to the Activities or not.
2. Student agrees to RELEASE, WAIVE, AND FOREVER DISCHARE Alpine BJJ Academy, its officers, directors,
employees, volunteers, agents, and independent contractors from any and all claims (other than gross negligence), loss,
demands, damages, expenses, lawsuits, causes of action, and judgments, whether foreseen or unforeseen, known or unknown,
present or future, resulting from, arising out of, or in any way connected with the Student’s participation in the Activities,
including, but not limited to, any claims for personal injuries, death, permanent disability, and/or damage to or loss of
personal property, whether cause in whole or in part by the ordinary negligence and/or fault of Alpine BJJ Academy.
3. Student also agrees to forever INDEMNIFY, defend and hold Alpine BJJ Academy harmless against any liability, damages,
defense costs, including attorney’s fees, or from any other costs incurred in connection with claims for bodily injury,
wrongful death or property damage caused by Student’s negligence or other wrongful acts or omissions.
4. Student further agrees to forever HOLD HARMLESS, DEFEND, AND INDEMNIFY Alpine BJJ Academy from all liability,
damages, defense costs, including attorney’s fees, or from any other costs incurred in connection with claims for bodily
injury, wrongful death or property damage brought by the Student, Student’s guests, or minors, even if Alpine BJJ Academy
was negligent. Further, the Student understands and acknowledges that Alpine BJJ Academy does not manufacture martial
arts, fitness or other equipment at its facilities, but purchases its equipment. The student understands and acknowledges that
Alpine BJJ Academy provides recreational services and may not be held liable for defective products.
5. The student authorizes Alpine BJJ Academy to provide the student with medical treatment if the student is injured, to accept
financial responsibility for any costs related to that treatment, and to RELEASE, WAIVE AND FOREVER DISCHARGE
Alpine BJJ Academy from any claims in any way connected with such medical assistance or treatment.
6. The student confirms that the student is in good physical condition, and that the student has no existing disease, injury,
mental or emotional problems that would affect the student’s participation in the Activities or affect the participation of other
students.

By signing below, the student acknowledges that they have carefully READ AND UNDERSTOOD the foregoing WAIVER AND RELEASE and knows of the nature of the Activities at Alpine BJJ Academy. The student agrees voluntarily to all the Terms and Conditions of this waiver and release form and acknowledges that they received a copy of the waiver and release form. The student understands that by signing this waiver and release that the student is giving up substantial rights,
including the right to sue. The student acknowledges that this is the final waiver and release regarding the issues raised herein and cannot be modified except in a writing signed by both parties. The student or guardian agrees that training, competition and event photos may be used by Alpine BJJ for website content, marketing any other use directly related to Alpine BJJ
