WAIVER, INDEMNIFICATION, AND RELEASE FROM LIABILITY
In consideration of being permitted use of the facilities and equipment of Fastest Lap LLC, the undersigned, on behalf of myself and the following minors under my care, supervision, or control, represents, Acknowledges and Agrees as follows:
I understand, acknowledge, and agree that I am executing this Agreement as consideration for the use of motion racing simulators and/or ambulatory virtual reality equipment, which apparatuses carry inherent risks and dangers, including, but not limited to, serious physical or emotional injury, motion sickness, epileptic seizures, sprains, strains, pinches, burns, dislocations, fractures, concussion, paralysis, or death. I acknowledge these risks and voluntarily assume the same and any unforeseen hazard when we make use of the equipment and facilities of Fastest Lap LLC. Pursuant to manufacturer specifications, the weight capacity of this equipment is 275lbs; therefore, I acknowledge and agree that by our use of the equipment of Fastest Lap LLC I am representing that we are able to do so within the manufacturer’s specifications. I further acknowledge and agree that neither Fastest Lap LLC nor any of its agents, employees, or assigns are liable for injuries resulting from another individual’s use of the facilities or equipment or for the failure of Fastest Lap LLC to monitor or supervise mine or another’s use of the facilities or equipment.
I acknowledge and understand that this Agreement is intended to forever release, indemnify, hold harmless, and protect Fastest Lap LLC, irrevocably and unconditionally, from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorney fees, damages, judgments and liabilities, of whatever kind or nature, whether in law or in equity, relating to or arising from our use of the facilities and equipment of Fastest Lap LLC.
I acknowledge, understand, and agree that this Agreement extends indefinitely and will have full force and legal effect each and every time I or someone under my care, supervision, or control uses the facilities or equipment of Fastest Lap LLC.
I further acknowledge that I have read the foregoing, understand its terms and meaning, and have made diligent inquiry concerning any questions about this document that I may have had. I hereby expressly agree that this Waiver, Indemnification, and Release from Liability is intended to be as broad and inclusive as permitted by the laws of the State of Indiana, and that if any portion hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
