                        • SERVICE AGREEMENT

This service agreement is made between Higgins Yacht Yard ("HYY") and the boat owner(s), captain(s), and/or agent(s) (collectively, "OWNER"). By signing and/or submitting this agreement, OWNER understands and agrees to the following:
                          1. OWNER authorizes HYY to perform services on and, if necessary, operate the vessel described above, and agrees to pay for all services, including labor, parts, and materials included immediately upon receipt of invoice. HYY reserves the right to bill for work in progress, which shall be due immediately upon receipt.
                          2. OWNER is responsible to provide HYY with full and valid credit card information and a copy of the vessel's current insurance certificate prior to any work beginning and prior to the vessel coming onto the property of HYY.
                          3. Vessels will not be released or launched until all outstanding invoices are paid in full. During this time, HYY has the right to add storage rates to invoices.
                          4. Should invoice(s) not be paid within 30 days from receipt, OWNER authorizes HYY to charge the full balance of the invoice to the credit card on file. Should credit card payment not process sucessfully, interest and additional storage rates will be applied to the invoice.
                          5. In the event that HYY employs counsel to collect payment or amounts due, to enforce the terms of this agreement, or to foreclose a lien, OWNER agrees to pay HYY all costs of collection and/or enforcement.
                          6. HYY is not liable for any losses or damages to real or personal property by any cause while the vessel and/or trailer is at the property of HYY.
                          7. HYY is not liable for any damages to vessel(s), docks, and/or property, during or after deliveries of any vessel. OWNER assumes responsibility to ensure the vessel has safe and secure dockage after it has been delivered.
                          8. HYY shall not be responsible for any damage caused by lifting and/or moving the vessel due to any structural weakness of the vessel. OWNER shall be responsible for indicating the proper placement of lifting straps to avoid damage. Should OWNER not indicate the placement of lifting straps, HYY personnel will determine placement, and will be held harmless should any damage occur.
                          9. Outside contractors are not permitted to work on vessels nor be on the property of HYY without prior authorization from HYY administration. A current certificate of liability is required from all outside contractors. HYY reserves the right to charge daily fees for outside contractors, which OWNER shall be held responsible for.
                          10. HYY is not responsible in any way for the work of any outside contractor, and the owner will indemnify and hold HYY and its employees harmless from any loss, cost, suit, or claim arising from any outside contractor's work on the property of HYY.
                          11. Any pricing charged per foot or per square foot shall be measured by the vessel's LOA (length overall) and maximum beam. This includes any and all connected equipment.
                          12. All quotes given are estimates and the total of final invoices may differ. HYY will contact OWNER regarding any charges in excess of 10% of the estimate.
                          13. HYY reserves the right to substitute parts or materials, using those currently available. Parts removed from any vessel may be discarded unless OWNER specifically requests that they be kept in writing.
                          14. Boat stands shall not be moved, unchained, repositioned, or otherwise disturbed by anyone other than HYY personnel. Stands may be moved or repositioned at OWNER expense at $50.00 per stand.
                          15. For safety reasons, OWNER shall not be aboard the vessel while it is in the travel lift slings.
                          16. Should OWNER board the vessel while HYY staff are in the process of working, all work shall cease until OWNER diembarks vessel. Hourly rates will continue to be charged until work can continue by HYY staff.
                          17. Mast climbing, mast removal, and/or raising of sails while any vessel is in the yard or on the property of HYY is prohibited.
                          18. Due to the large numbers of vessels being hauled and/or launched, and delays that may occur due to weather, owners should not plan to be present during hauling and/or launching.
                          19. Vessels will not be hauled nor shall work begin without a completed, signed, and submitted service agreement. HYY reserves the right to, if needed, move your vessel and charge a re-blocking fee at OWNER expense.
                          20. For liability purposes, HYY does not loan and/or rent tools, ladders, extension cords, or any other equipment.
                          21. All disposal or hazardous material must be in accordance with local, state, and federal regulations.
                          22. Boat covers shall not be fastened to jack stands in any way. HYY reserves the right to retie any covers found in such a way at OWNER expense.
                          23. Dry stored vessels shall not be left plugged into shore power while unattended. All batteries must be either disconnected, or master switches turned off.
                          24. No heaters nor portable battery chargers are allowed on any unattended vessels.
