Reservation Waiver

Pleasure Island Rentals provides safety equipment with all rentals at no additional fee. I am familiar with the operation of the equipment and am capable of operating the equipment fully.

In consideration of being allowed to participate in any way in the Pleasure Island Rentals recreational equipment rental program and its related events and activities I understand the terms below. I acknowledge, appreciate, and agree that:

1. The risk of injury from activities involved in this program is significant, including the potential for permanenet paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does eixt; and
2. I KNOWLINGLY AND FREELY ASSUM ALL SUCH RISKS, both known and unknown EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for the use of the rented equipment while participating. If however I observe any unusual significant hazard during my presence or participation, I will bring such to the attention of the nearest official immediately; and,
4. I, for myself and on the behalf of my heirs, assigns, personal representatives and the next of kin HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS PLEASURE ISLAND RENTALS, their officers, officials, agents and/or employees, and, if applicable, DEATH, or loss or damage to person or property, arising from any usage of the property by me or during the time the property is rented by me to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILTY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND IT'S TERMS, UNDERSTAND THAT I HAVE GEVEN UP SUBSTANTIAL RIGHTS BY AGREEING, AND AGREE FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT.

FOR PARENTS/GAURDIANS OF PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT TIME OF REGISTRATION) This is to certify that I, as parent/guardian with legal responsibly for this participant, do consent and agree to his/her release as provided above of the all that Releases, and for myself, my heirs, assigns, and next of kin, release and agree to indemnify and hold harmless the Releasees, and for myself, my heirs, assigns and next of kin, release and agree to participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES to the fullest extent permitted by law.

I agree to compensate Pleasure Island Rentals for all damages, loss or theft of or to the rental unit during the rental period. I authorize Pleasure Island Rentals to assess the amount of any damage, cleaning fee, or loss to/of the rental items that I am renting above. I accept responsibility for returning the unit(s) to Pleasure Island Rentals at the end of the rental period.

Note: Renter has the option of purchasing the damaged equipment for the full market price listed above less the amount accrued rental charge. Purchasing the damaged equipment is up to the discretion of the Pleasure Island Rentals staff members.

I HEREBY ACKNOWLEDGE: I am of at least 18 years of age and that proof of age and identity were provided to Pleasure Island Rentals at the time of the Rental. By checking the box, I as the renter hereby affirm that the condition of the rental items given to me are in perfect working order at the time of my rental. Any damage, deemed by Pleaser Island Rentals management, to said rental items will be deemed “new” and be the sole responsibility of myself to pay for damages unless previously stated damages. I also acknowledge that I have read and fully understand this Physical Damage Agreement. The renter will hold Pleasure Island Rentals harmless from any loss, including attorney fees and court costs that might suffer as a result of the operation and usage of the rental equipment.
