Terms and Conditions

As cruisy and chill as I am as a person, business requires rules and boundries. So please read the following contract but always keep in mind, I will always do whats best for you on your special day and capture it as best as i can!
PLEASE READ AND ACCEPT THE TERMS OF THE FOLLOWING STATEMENTS
Videography Agreement*

The following constitutes the Videography Agreement (the “Agreement”) of Daniel Davey (TA D & D Media) (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.

Exclusivity*

It is understood that D & D Media is the exclusive Videographer retained by the client to cover the outlined event. Any conflicts with video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.

Permits/Permissions

Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for D & D Media at each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client agrees that he/she has the legal rights to anything D & D Meida will video at the wedding's ceremony. All other video content recorded on the day of the wedding will be the product of D & D Media for inclusion in the client's final video.

Audio*

D & D Media is not responsible for poor audio if the bride or groom does not agree to wear a covert lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow additional lighting provided by D & D Media at the reception, or electrical or mechanical malfunctions on location that are beyond our control.

Hours of work*

D & D Media will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive.

Freedom of use*

D & D Media reserves the right to use videos and photos for display, promotional purposes and to show other couples to generate more business. All final video masters, wedding ceremony footage, and audio captures remain the exclusive property of D & D Media. Such property will be provided to the client as it is specified with the selected video package (USB/Online in a final edited wedding film).

Style of the film*

Artistic Style. On its own behalf and on behalf of the subject: Client acknowledges that he/she is familiar with D & D Media's portfolio and is requesting services with knowledge of the videographer's style and that D & D Media’s work is constantly evolving; that D & D Media's services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos we shall use our own creative artistic judgment to create videos consistent with our personal judgment and consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, the client acknowledges that the videos shall not be subject to rejection on the basis of taste or esthetic criteria. Additonally it is the client's responsibilty to inform D & D Media of any specific shot selections in which the client would like captured.

Failure on my behalf

If D & D Media fails to comply with the terms of this agreement due to any event or at beyond the control of D & D Media, including but not limited to illness, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, D & D Media’s liability is limited only to a refund of all non-deposit related monies received.

Termination*

The client reserves the right to terminate the contract for any reason up to 5 days after the date of initial deposit. Should the client terminate the contract, all money paid minus the deposit retainer which is 20% of total cost will be refunded.

Guests*

D & D Media reserves the right to ask any wedding attendee in which may be inhibiting the ability of the videographer to capture footage to adjust their actions that are preventing the videographer's capturing of said footage. This includes, but is not limited to, standing in the aisle of the ceremony's location, the capturing of footage on the attendee's personal video recording devices, and the crowding of a select area in which the couple will be filmed.

Delivery*

Both the client and D & D Media agree to the terms of delivery which includes final video masterings between 2-3 weeks after the date of the contracted wedding.

Date Changes*

If for any reason the client chooses to change the contracted date he/she agrees to pay additional retainer costs for the second date.
Live Streaming*

Due to a 3rd party service provider being engaged and potential internet connectivity issues that may be encountered. In the rare event that issues are encountered, we will endeavour to address them at the time. If the issues are not able to be resolved immediately, the service will be re-streamed and available to view as soon as possible following the conclusion of the service. Experiencing Buffering? We are at the mercy of local Mobile Data Networks for live streaming. Whilst we do use multiple networks to gain a stronger signal, in some cases some buffering may occur due to circumstances beyond our control (network congestion, tower outages etc). A Full HD version of the video will be available on the same link, shortly after the conclusion of the original broadcast. Should there be any known issues, please check back a couple of hours after the original broadcast to watch in glorious Full HD. D & D Media cannot be held responsible for any interruption to the Live Streaming that may occur.

Running Over planned time*

Any overage time that exceeds 30 min will be calculated at an hourly basis of $150/hour. Additional hourly rate will be factored in once the overage time exceeds a 30 minute mark. To resolve this additional cost the client may request a staged couple walkout to be filmed. This decision must be brought to D & D Media's attention at least 1 hour in advanced of the staged walkout in order to give videographers time to plan accordingly. If the client fails to inform D & D Media of a staged walkout, then it is to be assumed that the night will go on as initially planned.
COVID-19 Clause*

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the Australian Health Department and many other public health authorities still recommend practicing social distancing. This policy will be adhered to by D & D Media at your event to avoid any potential breaches. In the event of a government instigated lockdown or gathering restriction that effect the ability for your wedding day to go ahead, all efforts will be made by D & D Media to accommodate a date change of your event. This change will come at no additional cost to you and the normal notice period restriction will be waived. If the new date clashes with another existing booking and D & D Media can not find a suitable talented and equally skilled replacement shooter for your event, a full refund (including deposit) of all paid monies will be given.
